The subject property is located immediately east of Ingram Road between the Ingram Trails Subdivision and the
Brynmar Subdivision. Phase 5 comprises two (2) properties identified as parcel number 33-21-28-0010-06-041 and
33-21-28-0010-042. The total area of the Plat amounts to approximately 53.22 acres.
This Plat is required in order to create the 89 lots for the residential subdivision, associated street right-of-way, and
tracts for open space, recreation, and retention facilities. The Plat also includes easements for emergency vehicle
access, reclaim water lines, drainage, stormwater retention pond, and other public utility easements. In total, Phase
5 of the Arden Park Subdivision will take up approximately 53.22 acres.
The Arden Park Phase 5 subdivision is platting prior to receiving a Certificate of Completion; therefore, the
developer is required to provide a Surety covering the outstanding proposed improvements as approved in the
Preliminary / Final Subdivision Plans for Arden Park North Phase 5. The Developer, Lennar Homes, LLC, has
provided the City with a Letter of Credit (Fidelity Guaranty and Acceptance Corp Irrevocable Stand -By Letter of
Credit Number FGAC-20438) in the amount of $2,775,685.72.

Commission and to authorize the Mayor and City Clerk to sign the Plat.

payment of fees and with the power to assess the lots. Failure of the owners of the lots depicted hereon to pay such
fees or assessments may result in the attachment of a lien on the property of the owner which fails to pay such fees
or assessments by the Association, which may result in the foreclosure of said property.
5. A non-exclusive utility easement being 10.00 feet wide (denoted as U.E, on the plat) adjacent to the private
roadways/streets shown hereon (Tracts A3 and A4) is hereby dedicated and reserved in favor of public utility providers
for the installation and construction of public utilities to service the lots and tracts depicted an this plat only.
6. Unless noted differently on the Plat, all Lots are subject to a 5.00 foot private utility and drainage easement along
all side Lot lines and a 10.00' utility and drainage easement along all rear Lot lines. Said easements are for the benefit
of the Association and the Lot owners within this Plat and the local government/utilities, in order to serve the lots and
tracts depicted on this Plat, as appropriate. The fee simple owner of said lots and or tracts shall be responsible for the
grass and landscaping within all the easements located upon individual lots and or tracts.
7. An emergency access easement to the retention area and over all drainage easements shown hereon is granted to
the City of Ocoee for emergency maintenance purposes. The emergency access easement does not impose any
obligation, burden, responsibility or liability upon the City of Ocoee to enter upon the platted property or take any action
to repair or maintain the drainage system.
8. Orange County Utilities herein and its assigns shall have the right to clear and keep clear all trees, undergrowth and
other obstructions that reasonably interfere with normal operation or maintenance of the utilities and any facilities
placed thereon by Orange County Utilities and its assigns. The owner of the real property depicted on this Plat agrees
not to build, construct, or create any buildings or other structures on the herein granted Utility Easement that may
interfere with the normal operation or maintenance of the utility facilities installed thereon.
9. No trees are to be planted within 10.00' front utility easements adjacent to any public right-of-way, however all
utilities to be placed within the 10.00' utility easements along the front of each Lot will be placed around existing trees
to be preserved.
10. All development shall be in accordance with and subject to the City of Ocoee Land Development Code, as amended
from time to time, and oil Federal, State, County and City Rules, Regulations, Ordinances and Approvals.
11. The City of Ocoee is subject to the terms, provisions and restrictions of Florida Statute Chapter 163 concerning
moratoriums on the issuance of building permits under certain circumstances. The City has no lawful authority to
exempt any private entity, or itself, from the application of such State legislation and nothing herein shall be construed
as such as exemption.
12. The Members of the Association are ultimately responsible for payment of the costs of maintaining said tracts that
e to be owned by the Association and all lots depicted on this Plot ore subject to assessments, liens and foreclosure
for non-payment.
13. Tracts A3 and A4 are hereby reserved for Private Roadways/Streets and shall be conveyed by separate instrument
