Planner Hinesexplained the subject 0.18acreproperty is located at 511 Whittier Avenue, which
is approximately 700 feet north of E. Silver Star Road and 600 feet south of Center Street.The
Orange County Property AppraiserParcelIdentification Number is 17-22-28-3624-02-221. The
applicant is requesting approval to annexinto the City limits as a condition to receive city potable
water connection.The parcel will receive an “R-1” (Single-Family Dwelling) zoning upon
annexation.The proposed annexation is a logical extension of the City limits, urban services can
be provided, and the annexation meets state and local regulations.
Development Review Committee (DRC) Recommendation: On December 1, 2020, the DRC met
to determine if the proposed annexation and rezoning were consistent with the City’s regulations
and policies. When the discussion was finished, the DRC voted unanimously to recommend
approval of the annexation and rezoning for the Campos Property.
Staff Recommendation: Based on the above analysis and the subsequent DRC recommendation,
Staff recommends that the Planning & Zoning Commission, acting as the Local Planning Agency,
recommend approval of the annexation and rezoning from “Orange County” R-1 (Single Family)
to “City of Ocoee” R-1 (Single-Family Dwelling) of the property known as the Campos Property.

C.Arden Park North Phase 6 Large Scale Preliminary/Final Site Plan

Development Services Director Rumer explained the Arden Park PUD was initially approved
by the City Commission on November 21, 2006, and amended on February 19, 2013. Arden Park
North consists of the northern phases (2-6) of the PUD. Arden Park North is located on the north
side of Clarcona-Ocoee Road and situated between Hobson Road and Ingram Road. Arden Park
North is approximately 308 acres of which 54.44 acres are identified as wetlands/Lake Sims.
The Arden Park North Phase 6 (PSP/FSP) is a residential subdivision that proposes a total of 67
single-family residential lots. The minimum residential lot standards are from 45 feet by 120 feet,
55 feet by 120 feet, and 65 feet by 120 feet. All corner lots in the development will be required to
maintain a 20-foot setback from the side streets.Orange County will provide potable water and
sewer services. The City of Ocoee will provide solid waste services, reclaimed water, police, and
fire protection.

Development Services Director Rumer announced December 17is the official ribbon cutting
ceremony of the Clarke Road extension, which runs from Clarcona Ocoee Road to McCormick
Road. This is the last phase of Arden Park.
Development Review Committee (DRC) Recommendation: The Development Review Committee
(DRC) met on December 1, 2020, and reviewed the Preliminary/Final Subdivision Plan for Arden
Park North Phase 6. The DRC voted unanimously to recommend approval of the Preliminary/Final
Subdivision Plan, subject to the resolution of any remaining staff comments
Staff Recommendation:Based on the recommendation of the DRC, Staff recommends that the
Planning and Zoning Commission recommend approval of the Preliminary/Final Subdivision Plan
for Arden Park North Phase 6, subject to resolving any remaining staff comments before the City
Commission meeting.

Discussion:
The applicant waspresent for questions.
Member Mellenasked what the initial amendmentwasin 2013.Development Services Director
Rumerexplained they made the roads private and gated with multiple access points.
Member Forgesasked what the total number of homes is with all phases combined. Development
Services Director Rumerstatedit is just 35 homes shy of the maximum 800.
Member Williamsinquired how the HOAis set up.Development Services Director Rumer
indicated he believes there is a master HOA, one for the North and one for the South.
Member Melleninquired if there is a timeframe on the expansion of a turn lane from Clarke Road
onto Clarcona Ocoee Road. Development Services Director Rumersaid the City is looking at
some options in that vicinity.

Vice-Chair Lomneckasked questions on the drainage.Development Services Director Rumer
explained all surrounding lakes are closed basins,it has met the 100-year floodplain; and further,
the additional houses have their own stormwaterpond.
Member Williamsstated there sometimes is conflict between the rights of a developer and the
residents who are currently living in a developing community;and if there are opportunities for
the City to bridge thegap,that should be done.Development Services Director Rumersaidhe
personally has attendedtwo meetings with the residents of Arden Park; and further, the developer
slowed their building to construct the new road extension in order to ease traffic concerns.
Member Forgesquestioned the engineer on whether they have seen the water level increase.
Benjamin Beckham, PE,Madden Moorhead & Stokes, 431 E. Horatio Ave., Maitland, said they
have been informed about the water levels rising; however, the proposed homes are at least seven-
and-a-half feet above the highest predicted levels of the ponds.

D.Innovation Montessori School Phase 3LargeScale Preliminary Site Plan
(PSP).(Advertised in the West Orange Times on Thursday, November 26, 2020) (Development

Development Services Director Rumer explained theInnovation Montessori School is currently
located on 20.16 acres. The parcel consists of three buildings and includes 800 students in Pre-K
through 8th grade. In October of 2018, the school was able to purchase and combine an additional
2.59 acres to the campus. TheproposedPhase 3 is a LargeScale Preliminary Site Plan to add a
two-story High School with an increase of 288students. The High School would be located within
the 2.50 acres purchased in 2018. Onsite stormwater,72 parking spaces andan additional access
point onto Fullers Cross Road will beprovided. The new high school building will be two stories
and be similar to the existing building architecture.Temporary portables are being requested by
the school to start the high school, and the City Commission will set an end date for the portables.
Development Review Committee (DRC) Recommendation: The Development Review Committee
(DRC) met on November 17, 2020, and reviewed the DRC voted to recommend approval of the
Large-Scale Preliminary Site Plan, subject to the resolution of the remaining staff comments.
Staff Recommendation: Staff recommends that the Planning and Zoning Commission
recommend approval of the Large-Scale Preliminary Site Plan for Innovation Montessori School
for the addition of a two-story high school building to add 288 students.
Discussion:

Member Mellenasked if there is a timeframe on portables.Development Services Director
Rumer said thisprocesshas been done in the past with a church, and the timeline was five to
seven years.
Chair Kellerasked where the portables will be located while they are building.
Bob Ziegenfuss, PE,Z Development Services, 708 E. Colonial Drive, Suite 100, Orlando,
explained the temporary portables will remain while the building is constructed. Once the building
is finished, the area where the portables are proposed to be placed will become an activity area for
the students. The expected timeframe for the portablesis one year,startingin 2021forthe
upcoming school year.

Chris Adkins,Ocoee resident,asked the Board if they see any correlation with the Charter or
Montessori schools affectingplans for Orange County Public Schools in placingrelief schools in
the city.
Chair Kellersaid he believes in the past it was more of a political issue.

developments to rectify service issues. Ocoee and Wachovia High Schools are currently not over
capacity.

Development Services Director Rumerupdated the Board with the following:
The City Clerk hasrequestedthe P&Z Boardto consider canceling the March 9,
2021 Planning and Zoning Commission meeting, because it fallson the same night
as the city election.

scheduled for March 9, 2021; Moved by Member Mellen, Seconded by

A new public road on the southside of the turnpike for Inspirationis in its final
inspection.
The Ocoee Business Park is finishing up a 490,000 square-footbuilding.
The Ocoee Apopka & Fullers Cross intersection improvements are underway. The
City is currently logging some adjacent lands for future development.
Sonny’ssite plan is finishedand ready to go.
The Maine Street alignment, Bluford Avenue to Blackwood Avenue, remains
closed for the City Center construction entrance.
The City’s new Park Campus & City Hall Plans won theOutstanding Development
Award from the Florida Planning and Zoning Association.
The new City Hall is scheduled to be open in April of 2022.

approval of Crossings at Maguire PUD, Annexation, Rezoning to Planned Unit Development
(PUD) & Small-ScaleLand Use Amendment from Professional Offices and Services to
Commercial?
BACKGROUND:
General Location:The subject propertiesarelocated on the westside of Maguire Rd. and600
feet north of Roberson Road.
Parcel Identification Numbers:31-22-28-0000-00-012 (2647 Maguire Road),& 31-22-28-0000-
00-023 (2663 Maguire Road)
Parcel Size:5.611Acres Total. 2663 Maguire Rd. is .61 acres and 2647 Maguire Rd. is 4.92
acres.
Actualland use and unique features of the subject properties: The parcels each contain an
existing single-family dwelling and associated accessory buildings.
Proposed Development:The applicants propose to develop the 5.611acres as a mixed-use
commercialPUDconsisting of four (4) buildings: Building one (1) is proposing a 2,510 sf coffee
shop, building two (2) is proposing a 6,400 sf office/commercial building, building three (3) is
proposing an 85,140 sf three-story Mini Warehouse/Storage Building, and building four (4) is
proposing a 3,500 sf bank/credit union.
Annexation:2647 Maguire Rd. consisting of 4.92 acres is requesting voluntary annexation. With
respect to State annexation criteria, Chapter 171.044 of the Florida Statutes grants municipalities
the authority to annex contiguous, compact, non-circuitous territory so long as it does not create
an enclave. The subject property is considered contiguous to the City of Ocoee since it is adjacent
to property located within the Ocoee City limits on thenorth, south, east, and west sides.

Joint Planning Area Agreement:The subject property for annexation is located within the Ocoee-
Orange County Joint Planning Area (JPA). An applicable amendment to the JPA is required to
amend the Land Use from Professional Office and Services to Commercial.
Orange County has been notified of this petition in accordance with Subsection 13-A of the City
of Ocoee-Orange County Joint Planning Area Agreement.
Rezoning: The applicant has requested a City of Ocoeezoning designation of PUD (Planned Unit
Development). According to the Land Development Code, the PUD zoning designation is
intended for all areas shown on the Future Land Use Map. The PUD zoning designation is
consistent with the proposed future land usedesignation of Commercial.
Comprehensive Plan: The annexation is consistent with the Future Land Use Element Policy 2.5
that states in part, “The City shall consider requests for voluntary annexation into the City when
those lands are logical extensions of the existing City limits, when services can be properly
provided, and when proposed uses are compatible with the City's Comprehensive Plan, the JPA
Agreement, and the City’s Annexation Policy….” \[Emphasis added\]. The rezoning is consistent
with Future Land Use Element Policy 1.15 that states in part, “The City may assign an initial
zoning, after annexation, which is consistent with both the Future Land Use Map and the JPA
Agreement…”

Floodplain Impacts:
Based on FIRM map number 12095C0220H, the site does contain some 100-year floodplainin
zone “A” with no base elevation.
Wetland Impact:
Based on the PUD Land Use Plan, there are wetlands associated with the property. A
further review from the National Wetlands Mapping Source, there is a small pondthat is

Endangered and Threatened Wildlife:
Athreatenedand endangered species studywill be provided at the site plan level review.
Utilities:
The site is located within the City of Ocoee utility service area and proposes connectingto public
utilities for water and sewer. There is an existing 12” water main running along the westside of
Maguire Roadand a 10”Sewer main running along the east side of Maguire Road. Approval of
the proposed water and sewer utility plan is required prior to the final site plan's approval.

The proposed PUD accesses Maguire Road via one entrance.The development will generate
1,637 new net daily trips, 120 new net a.m. peak hour trips,and 139 new net P.M. peak hour trips.
Maguire Road is programmed to a Level of Service (LOS) “D” and operates at a LOS of “C.”With
current traffic and the proposed development, the LOS will remain at “C.”The study intersections
are currently operating at satisfactory Levels of Service. The intersections will continue to operate
satisfactorily at the project buildout in 2022. The site is proposed to be served by a driveway
connection for Maguire Road opposite the Publix driveway. Due to the stop control, the
eastbound/westbound approaches will experience some delays but with v/c ratios less than 1.00
during peak traffic operations.
Schools:
No school impacts are proposed since the proposed use is Commercial.
Public Safety:
The nearest Fire Departmentis approximately 980 feet away. Station #39 is located on Maguire
Road. The estimated response time is 2-4 minutes. The Police Station response time is 3
minutes.
Drainage:
The subject site is located within the Johns Lake Drainage Basin. Additionally, the drainage
system's designwill have to evaluateimpacts to wetlands and existing drainage flowsin more
detail prior to final engineering approval.

DEVELOPMENT REVIEW COMMITTEE (DRC) RECOMMENDATION:
The Development Review Committee (DRC) met on 2/2/2021to determine if the proposed
annexation,PUD Land Use Plan, and Small-Scale Land Use Map Amendment is consistent with
the City’s regulations and policies. Based on the above analysis and subsequent discussions,
the DRC recommended approval of the annexation and rezoning of the Crossings at Maguire.
STAFF RECOMMENDATION:
Staff recommends that the Planning and Zoning Commission / Local Planning Agency
recommend approval of the 1) annexation of the 4.92+/-acres of land, 2) rezoning from Orange
Country A-1 (Agriculture)and Professional Office to Planned Unit Development (PUD); 3) Small
Scale Land Use Amendment from Professional Office and Servicesto Commercialsubject to the
adoption of an applicable amendment to the Ocoee/Orange County Joint Planning Area (JPA)
Boundary Map and JPA Land Use Map.
