Code Enforcement Board
January 26, 2021
I. CALL TO ORDER
Chair Odom called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission Chambers of
City Hall located at 150 North Lakeshore Drive, Ocoee, Florida.
A. INVOCATION: Member Mirza initiated the moment of silence.
B. PLEDGE OF ALLEGIANCE: Member Lewis led the Board in the Pledge of Allegiance to the U.S. flag.
C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared
a quorum (4) present.
PRESENT: Chair Odom & Members: Lewis, Mirza, & Stewart.
Also present: Board Attorney B. Scott George, Assistant Support Services Director Doug Gaines, Code
Enforcement Clerk Justin Mieras, and Code Enforcement Officers Rodriguez, Siegrist, Diaz, & Loeffler.
ABSENT: Members Mann, Bandur, & Shropa are excused absences.
D. SWEARING OF OFFICERS / WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code
Enforcement Officers and to anyone intending to speak regarding a case.
II. CONSENT AGENDA
ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT
BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS
DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK
TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY.

Member Stewart, seconded by Member Mirza, moved that the supplemental consent agenda be accepted as presented.
Motion carried unanimously.
Member Lewis, seconded by Member Stewart, moved that Case #2020-02121 be moved to the beginning of the agenda
and then revert to the original order with Case#2020-02101 and all subsequent cases. Motion carried unanimously.
III. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS
CASE NO 2020-02121
OFFICER DIAZ 317 LEE ST ZABRPP CORP
Violation Cited: §115-3.A.(3) & 165-3.A.
Summary:
§115-3.A.(3) — No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public
health, safety and welfare.
165-3.A.— No person shall keep any abandoned or junk vehicle on any public property or any private property.
Observation:
§115-3.A.(3)—Piles of miscellaneous junk/debris on property.
§168-6.B.(1)—Junk vehicle(s) untagged, abandoned and inoperable on property
Officer Diaz presented the case and gave its history.Officer Diaz further explained that as of January 26,2021,the property
is still in non-compliance.The City asked for an Order of Compliance with a fine of$25.00 per day, per violation until found
in compliance.
ZABRPP CORP Attorney Roger Kelly explained his client is trying to evict the tenants. Only after doing so will the owner
be able to bring the property in compliance but their eviction efforts were halted due to Covid-19 regulations preventing
evictions. The regulations have now expired. The owner believes they should be able to complete eviction proceedings
within 3 months .
Member Stewart, seconded by Member Mirza, moved that Case in#2020-02121, the respondent be found in violation as
cited as of October 21, 2020, and be given until April 26, 2021, to come into compliance or be fined$25.00 per day, per
violation that remains in non-compliance. Motion carried unanimously.
CASE NO 2020-02101
OFFICER RODRIGUEZ 1434 VICKERS LAKE DR SMALLEY CRAIG W

Violation Cited: §51-13.
Summary:
§51-13.—It shall be a violation to do work related to construction without first obtaining a permit
Observation:
§51-13.—Driveway extended without required permits, approval and inspections
Officer Rodriguez presented the case and gave its history.Officer Rodriguez further explained that as of January 26, 2021,
the property is still in non-compliance. The City asked for an Order of Compliance by February 10, 2021 or thereafter to
be fined $50.00 per day until found in compliance.
Member Mirza, seconded by Member Stewart, moved that Case in#2020-02101, the respondent be found in violation as
cited as of October 14, 2020, and be given until February 9, 2021, to come into compliance or be fined$50.00 per day, per
violation until found in compliance. Motion carried unanimously.
CASE NO 2020-02165
OFFICER RODRIGUEZ 104 OLYMPUS DR HILL, CLIFFORD
HILL, MILDRED
Violation Cited: §6-4.H.(6)(b)
Summary:
§6-4.H.(6)(b)—Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it
is located behind the front yard building line and screened with a six-foot high opaque fence with gate.
Observation:
§6-4.H.(6)(b) — Trailer in the garage still can be viewed from the street, having part of trailer out of garage having it
impossible to close the garage door
Officer Rodriguez presented the case and gave its history.Officer Rodriguez further explained that as of January 26,2021,
the property is still in non-compliance. The City asked for an Order of Compliance by February 10, 2021 or thereafter to
be fined $50.00 per day, per violation until found in compliance.
Member Stewart, seconded by Member Lewis, moved that Case in#2020-02165, the respondent be found in violation as
cited as of November 05, 2020, and be given until February 10,2021, to come into compliance or be fined$50.00 per day,
per violation that remains in non-compliance. Motion carried unanimously.
CASE NO 2020-02207

Violation Cited: §6-4.H.(6)(b) & §168-6.B.(1)
Summary:
§6-4.H.(6)(b)—Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it
is located behind the front yard building line and screened with a six-foot high opaque fence with gate.
§168-6.B.(1)—No owner, private property, shall consent to the parking or storing of vehicles on non-improved surfaces
of the property.
Observation:
§6-4.H.(6)(b)—Trailer parked in front of the property.
§168-6.B.(1)—Black vehicle continually parked on the grass and not moved
Officer Rodriguez presented the case and gave its history.Officer Rodriguez further explained that as of January 26, 2021,
the property is still in non-compliance. The City asked for an Order of Compliance by February 10, 2021 or thereafter to
be fined $50.00 per day, per violation until found in compliance.

cited as of November 10,2020, and be given until February 10,2021, to come into compliance or be fined$50.00 per day,
per violation that remains in non-compliance. Motion carried unanimously.

Violation Cited: §6-4.H.(6)(b)& §168-6.B.(1)
Summary:

property is still in non-compliance.The City asked for an Order of Compliance of 30 days or thereafter to be fined $50.00
per day, per violation until found in compliance.
Member Mirza,seconded by Member Stewart, moved that Case in#2020-02327, the respondent be found in violation as
cited as of January 11,2021, and be given until February 10,2021, to come into compliance or be fined$50.00 per day,per
violation until found in compliance. Motion carried unanimously.

Summary:
§6-4.H.(6)(b)—Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it

Observation:
§6-4.H.(6)(b)—Enclosed trailer parked in the front of property
Officer Rodriguez presented the case and gave its history.Officer Rodriguez further explained that as of January 26,2021,
the property is still in non-compliance.The City asked for an Order of Compliance by February 10, 2021 or thereafter to
be fined $50.00 per day, per violation until found in compliance.
Member Lewis, seconded by Member Mirza, moved that Case in #2020-02339, the respondent be found in violation as
cited as of December 08, 2020, and be given until February 12, 2021, to come into compliance or be fined$50.00 per day,
per violation until found in compliance. Motion carried unanimously.
CASE NO 2020-02401
OFFICER LOEFFLER 455 PALM DR FREEMAN CLIFFORD R ESTATE
Violation Cited: §115-3.A.(3)
Summary:
§115-3.A.(3)—No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public
j health, safety and welfare.
Observation:
§115-3.A.(3).—Complaint Received Misc.Junk, Rubbish, Debris Dumped At 455 Palm Dr. Next To Palm Park
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of January 26, 2021,the
property is still in non-compliance. The City asked for an Order of Compliance by February 10, 2021 or thereafter to be
fined$50.00 per day, per violation until found in compliance.The officer also asked the Board for permission to abate the
property.
Member Stewart, seconded by Member Lewis, moved that Case in#2020-02401, the respondent be found in violation as
cited as of January 08,2021, and be given until February 10,2021, to come into compliance or be fined$50.00 per day,per
violation until found in compliance and further moved to authorize the City to abate the property and assess the cost to
the fine. Motion carried 3 to 1 with Member Mirza Opposing.
IV. CASE RESOLUTION
CASE NO 2020-01950
OFFICER SIEGRIST 2488 TALL MAPLE LOOP CHAN SANDRA
Violation Cited: §45-13.A.
Summary:
§45-13.A. — No person shall cut down, destroy, remove, move, or damage any protected tree on private premises, or
authorize such work,without first obtaining a permit from the Building Department.
Observation:
§45-13.A.—Work Without Permit.Two (2) Oak Trees Removed From Front Yard.
Officer Siegrist explained that as of January 26, 2021, the property is still in non-compliance.The City asked for an Order
Imposing Fine.
Member Mirza, seconded by Member Odom, moved that Case in#2020-01950, the Board imposes fines as of December
04, 2020, as previously set by this Board. Motion carried unanimously.
CASE NO 2020-02072
OFFICER SIEGRIST 9051 A D MIMS RD BOYER SKAFF
Violation Cited: §165-3.A. & §168-6.B.(1)
Summary:
§165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property.
§168-6.B.(1)—No owner, private property,shall consent to the parking or storing of vehicles on non-improved surfaces
of the property.
Observation:
§165-3.A.—Multiple/numerous vehicles on property, some inoperable appearance and unknown tags.
§168-6.B.(1)—Multiple/numerous vehicles on property parked on grass.
Officer Siegrist explained that as of January 26,2021,the property was found in compliance. No further action requested.
CASE NO 2020-02148
OFFICER LOEFFLER 1828 LOCHSHYRE LOOP BARRON, WILLIE

Violation Cited: §54-3.A.(1), §115-3.B., &§165-3.A.
Summary:
§54-3.A.(1)—All buildings shall have the assigned building number properly displayed.
§115-3.B.— No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds, grass,
undergrowth or other dead or living plant life.
§165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property.
Observation:
§54-3.A.(1)—No Address Numbers Visible From Street On House Or Mail Box
§115-3.B.—Tall Weeds And Grass
§165-3.A.—Complaint Received &Observed;Vehicle (Blue Van) Flat Tire Expired Tag
Officer Loeffler explained that as of January 26, 2021,the property was found in compliance. No further action requested.
CASE NO 2020-02163
OFFICER LOEFFLER 2010 PAULA MICHELE CT THOMPSON, DANIEL
Violation Cited: §115-3.B.& §155-4.
Summary:
§115-3.B.—No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds, grass,
undergrowth or other dead or living plant life.
§115-4.—Owners shall control excessive weed or grass growths, as enumerated in § 115-3,on the property and on the
portion of the adjoining public right-of-way between the property and the street of each lot.
Observation:
§115-3.B.—Overgrown Tall Weeds And Grass
§115-4.—Easements And Pedestrian Sidewalks Tall Weeds And Grass
Officer Loeffler explained that as of January 26,2021,the property was found in compliance. No further action requested.
