I'M Mayor Johnson called the regular session to order at 6:14 PM in the Commission Chambers of City Hall. The invocation was led by Mayor Johnson, followed by the Pledge of Allegiance to the Flag led by Commissioner Firstner. City Cleric Sibbitt called the roll and declared a quorum present. Present: Mayor Johnson, Commissioner Wilsen, Commissioner Firstner, Commissioner Oliver Absent: Commissioner Brinson Also Present: City Manager Frank, City Attorney Cookson, City Clerk Sibbitt Mayor Johnson announced the following, "City Hall is open to the public; however, attendance inside the Ocoee Commission Chambers may be limited to accommodate social distancing and is subject to the Governor's Executive Orders. Anyone entering City Hall must wear a protective face covering. This meeting is broadcasted live on Spectrum Channel 493 with a live stream at www.Ocoee.org/197/Ocoee-TV. Any interested party may be heard during the public comments and public hearing portions of the meeting. In order to participate remotely, members of the public should call 407-554-7118 or email citizens@ocoee.org in advance and indicate the item you would like to address. At the appropriate time during the meeting, City Staff will contact you via phone and patch you into the live meeting where you can share your comments and/or questions. Comments and questions received via e-mail will become public records and be provided to the City Commissioners in advance of the meeting." PRESENTATIONS AND PROCLAMATIONS - 6:I7 P\A Presentation — Ocoee Youth Council (OYC) Chairperson Nathan Clarke and Member Garber highlighted the life and accomplishments of two African Americans in honor of Black History Month: Ray Charles, an American singer -songwriter, musician, and composer; and James Weldon Johnson, an American writer and civil rights activist. Member Ashley Clarke shared OYC's many accomplishments over the past year and highlighted several of their upcoming projects. OYC Coordinator Dillard requested the support and partnership of the Commission to distribute the signs. She offered each Elected Official five (5) signs to distribute within their district to citizens that reach out to them with concerns regarding speeding on their street. STAFF REPORTS AND AGENDA REVIEW - None COMMISSIONERS ANNOUNCEMENTS - 6.26 P'M Commissioner Wilsen — None Commissioner Firstner — None Commissioner Oliver — None Regular City Commission Meeting February 16, 2021 Mayor Johnson — Announced the following: 1) Each year Cities are asked to appoint a representative onto MetroPlan Orlando's Municipal Advisory Committee (MAC). Commissioner Firstner is currently designated to represent the City on this committee; and if he would like to continue, we need a motion for his reappointment. Motion: Move to reappoint Commission Firstner as the representative on MetroPlan Orlando's Municipal Advisory Committee (MAC); Moved by Mayor Johnson, seconded by Commissioner Oliver; Motion carried 4-0 with Commissioner Brinson absent. 2) The Woman's Club will host their Candidate Political Forum on Monday, February 22"d from 6 PM to 8 PM, in the Ocoee City Hall Commission Chambers. Due to COVID-19, only candidates may attend the event. The forum will be televised on Spectrum — Channel 493 and livestreamed on the City's website at which time residents may call or email with their questions. COMMENTS FROM CITIZENS/PUBLIC - None No speaker reservation forms, telephone calls, or emails were received. CONSENT AGENDA - 6028 PM Commissioner Oliver commented on Consent Agenda Item 2 advising residents that there are currently five (5) vacant seats on the Citizen Advisory Council for Ocoee Police Department (CACOPD). Consent Agenda Motion Motion: Move to adopt the Consent Agenda Items #1 - #6. Moved by Commissioner Firstner, seconded by Commissioner Wilsen; Motion carried 4-0 with Commissioner Brinson absent. 1. Approval of the Minutes for the Regular City Commission Meeting held February 2, 2021. (City Clerk Sibbitt) Approved on Consent. Motion carried 4-0 with Commissioner Brinson absent. 2.Approval of New Appointment to the Citizen Advisory Council for Ocoee Police' Department. (City Clerk Sibbitt)' Members of the Citizen Advisory Council for Ocoee Police Department serve a three-year term. ine Resolution creating the Board allows no more than fifteen (15) members. Currently, the Board has nine (9) members. An application was received by Patrick Holt who has shown an interest in being appointed to the Citizen Advisory Council for Ocoee Police Department for a term ending January 2024. Approval to Change the Preliminary/Final Subdivision Name from "Ciara Place" to "Labe Meadow Landing." (Development Services Director Rumer) The Ciara Place at Lake Meadow Preliminary/Final Subdivision Plan was approved by the Lity Lommisston on May 18, 2018. The final plans were approved by City Staff for construction on April 14, 2020, after going through a series of minor revisions. Ultimately, the applicant for the project decided not to go forward and sold the property and approved plans to David Weekly Homes. On December 2, 2020, David Weekly formally requested the change of name from Ciara Place at Lake Meadow to Lake Meadow Landing. Approved on Consent. Motion carried 4-0 with Commissioner Brinson absent. 4. Approval of Third Amendment to the Development Agreement for Arden Park PUD. (Development Services Director Rumer) On November 21, 2006, the City Commission approved and executed a Devetopment Agreement wrtn Arden Park Ventures, LLC, for the Development of property for the Arden Park Planned Community. As Phases 5 and 6 were going through the development review permitting process, City staff under the direction of the City Manager, worked with Lennar Homes and their engineer to see if the construction of the southern portion of the widening as per the Development Agreement and adding the extension south to the A.D. Mims Road area was feasible financially and could be completed under Lennar's participation. City Staff gave a presentation to the City Commission on December 15, 2020, requesting direction to continue forward with Lennar Homes as the preferred method for the widening of Clarke Road utilizing an amendment to the previous Development Agreements. Staff and Lennar Homes are now in agreement on a Third Amendment to the Development Agreement facilitating the widening of the southern section of Clarke Road. Approved on Consent. Motion carried 4-0 with Commissioner Brinson absent. 5. Approval of Prairie Meadows Plat. (Development Engineer Keaton) Prairie Meadows subdivision is located in Tract "C" of the Prairie Lake PUD. The subject property is located on the east side of N. Clarke Road and north of A.D. Mims Road, at the northeast corner of the intersection of Clarke Road and A.D. Mims Road. This Plat is required in order to create the 78 lots for the residential subdivision, associated street right-of-way, and tracts for open space, recreation, and retention facilities. The Prairie Meadows subdivision is platting prior to receiving a Certificate of Completion; therefore, the developer is required to provide a Surety covering the outstanding proposed improvements as approved in the Preliminary / Final Subdivision Plans for Prairie Meadows. The Developer, Meritage Homes, has provided the City with a Letter of Credit in the amount of $1,246,366.17. Approved on Consent. Motion carried 4-0 with Commissioner Brinson absent. 6.Approval of Lake Prima Vista Treatment with Wood Environment & Infrastructure Solutions, Inc. (Public Works Director Krug) Wood Environment & Infrastructure Solutions, Inc. (Wood) determined the existing take sediments are the primary contributing source of impairment, requiring a chemical treatment of the lake in order to inactivate sediment phosphorus, improve light transparency, reduce algal growth and encourage desirable submersed aquatic plants. Public Works has incorporated this chemical treatment in the current Stormwater budget for which Wood secured a partial grant from the St. Johns River Water Management District (SJRWMD). The cost for the flocculent treatment and associated reporting is $131,177.00. This cost has increased $3,000.00 over the original budget due to FDEP's new permit requirements. Public Works recommends the Commission approve proceeding with the work for which the City will receive a reimbursement from SJRWMD in the amount of $42,336.00. Approved on Consent. Motion carried 4-0 with Commissioner Brinson absent. 31 Page Regular City Commission Meeting February 16,2021 PUBLIC HEARING - None FIRST READING OF ORDINANCE - None SECOND READING OF ORDINANCE — PUBLIC HEARING - None REGULAR AGENDA - F:55 P1W 7. Appointment of Members to the 2021 Canvassing Board. (City Clerk`Sibbitt) In accordance with Section C-50 of the Ocoee City Charter, the Canvasing Board will consist of three (3) citizens appointed by the City Commission, On February 5, 2013, the consensus of the Commission was that the Mayor and two (2) Commissioners whose district seats are not part of the election should each select one (1) member for the Canvassing Board. In keeping with that practice, Mayor Johnson, Commissioner Brinson and Commissioner Firstner would each need to appoint a member for the Canvassing Board. City Cleric Sibbitt advised, in accordance with the City's Charter, the Mayor and two (2) Commissioners whose district seats are not part of the upcoming election each need to appoint one (1) member to make up the Canvassing Board to canvass the City's March 9th election. Consensus of the Board was to allow the Mayor, Commissioner Brinson and Commissioner Firstner to submit one (1) member each to be appointed to the Canvassina Board outside of this meeting. STAFF ACTION ITEMS - None COMMENTS FROM CITIZENS/PUBLIC - 6e31 PM, Heard out of Agenda Order Mayor Johnson said he has a speaker form from Cherice Gertsman and Joel Doss. Joel Doss owns property located at 750 Richmond Avenue, which is currently for sale and adjacent to the City's Cemetery. The owner is seeking easement rights in order to sell his property. However, the Mayor expressed he would like the City Commission to consider purchasing the Doss property to expand the City's existing cemetery because currently it is at capacity. Development Services Director Rumer explained the owners of this property came to the City back in 2019 indicating they would like to sell this property in the future, and inquired if the City would be interested in purchasing it. They are here requesting an easement off of Richmond Avenue in order to sell their property because the parcel is landlocked. He presented maps of the property and explained there are some wetlands; however, he believes approximately 145 cemetery plots could be added with twelve (12) columbariums. There is a mobile home on the property which could be utilized, or removed completely. Commissioner Firstner inquired if the purchase of the land would include the wetland area, and was answered in the affirmative. Discussion ensued regarding the wetlands and how it could be utilized as a passive reflective park. Commissioner Wilsen inquired on the purchase price, and was answered $425,000. 41 Page Regular City Commission Meeting February 16, 2021 Development Services Director Rumer explained the Parks and Recreation Department has funds in place to purchase a fence for the west side; however, if the City purchases this property that fence would not be needed. Commissioner Oliver inquired about the appraisal price of the land, and was advised an appraisal has not been done. City Manager Frank explained if the Commission is interested in purchasing this property, an appraisal will be required; and further, he recommended they consider granting a budget amendment with the funds coming from reserves. He advised a budget amendment is forthcoming within the next two months for stormwater improvements. The following person addressed the City Commission: - Cherice Gertsman said her father, Joel Doss, a two-time war Veteran, is 72 years old and rapidly declining. They are trying to sell this property as soon as possible in order to utilize the funds received for his care. She explained they need this easement in order to sell the property and asked the City to move forward with the easement. Mayor Johnson expressed he hopes the City buys the property for the residents; however, if the Commission does not approve to buy the property, the easement should be approved. Commissioner Wilsen shared she would like to move forward with the appraisal. Commissioner Firstner agreed that it is absolutely necessary to move forward with the appraisal. Commissioner Oliver said he felt it was reasonable to set aside $5,000 for the appraisal. Motion: Move to approve $5,000 from Contingency Funds for an appraisal on the Doss property located at 750 Richmond Avenue; Moved by Commissioner Oliver, seconded by Commissioner Wilsen; Motion carried 4-0 with Commissioner Brinson absent. No ficrther speaker reservation forms, telephone calls, or emails rt)ere received COMMENTS FROM COMMISSIONERS - 6,57 PlU Commissioner Oliver — Commented on the following: 1) Shared the Clarice Road sign on Colonial Drive when traveling east needs to be replaced. Commissioner Wilsen explained she spoke to Staff at Public Works and shared it is on order as it was damaged by a car fire. 2) Inquired if a plan for the City to educate residents with regard to trash collection has been determined. City Manager Frank explained what had been done in the past, and shared that the current vendor is providing the services the City is paying for as outlined in their contract. He felt it was a learning curve and suggested periodically placing information in with the water bill. 3) Inquired about the status of the Clarice Road widening project. City Attorney Cookson shared it was approved on the consent agenda tonight, Item #4. Mayor Johnson requested a timeline for what can be expected. Development Services Director Rumer explained the process and shared that it will take roughly 18 months from the recording date to complete the project. Mayor Johnson inquired about the total cost of the project. Assistant City Manager Shadrix shared it 51 Page Regular City Commission Meeting February 16, 2021 is roughly 4.63 million, and elaborated that by partnering with Lennar Homes the price is significantly less than it would be if it was a City Staff managed project. 4) Shared that he recently visited the Reserve Subdivision and took photos where the sidewalks need to be repaired, and explained the damage appeared to be caused by tree roots. City Manager Frank addressed his concerns. 5) Stated, historically, local elections have a very low voter turnout, roughly 7%, and explained why municipal elections are so important. He encouraged all residents to get involved and go out to vote on March 9th. 6) Reminded everyone that he challenged citizens to a "Call to Action." He then shared on President's Day they were able to feed 54 cars that went through a local drive thru. He encouraged others to do something nice, and elaborated that "Charity starts here at home." 7) Read the poem, "I shall pass this, way but once" written by Etienne de Grellet. Commissioner Firstner — Commented on the following: 1) Announced COVID-19 vaccinations are becoming more available, that several local retailers have implemented a sign-up procedure, and encouraged residents to inquire. Commissioner Wilsen — Commented on the following: 1) Announced the City's first dog park, will be opening soon at Montgomery Park, and thanked City Staff for their hard work and dedication in making this project a success. Mayor Johnson — Commented on the following: 1) Announced the Woman's Club of Ocoee will host their Candidate Political Forum on Monday, February 22nd fiom 6 PM to 8 PM, in the Ocoee City Hall Commission Chambers. Due to COVID-19, only candidates may attend the event. The forum will be televised on Spectrum — Channel 493 and livestreamed on the City's website at which time residents may call or email with their questions. 2) Shared that the work on Oakland Avenue has commenced; encouraged citizens to slow down when traveling in the area, and to be extra cautious during this time. 3) Informed residents the homes along Cumberland Avenue and Franklin Street have been removed to make way for growth, and expressed both a park and retention ponds will be added to those sites. 4) Thanked staff for the landscape work along Highway 50. 5) Suggested educating residents on the City's trash services every six (6) months, and encouraged residents to follow the provided trash service guidelines. 6) Reminded residents that the City's Municipal Election will be held on Tuesday, March 9th Residents of District #2 can vote at the Lakeshore Center, and residents of District #4 can vote at the Jim Beech Recreational Center.
