Subject: Change in proposed use ; relating to contract for purchase of 17.96 acres of City -owned
property located at the northeast corner of Fuller's Cross and Ocoee Apopka Road by GPK Investments,
Inc.
Background Summary:
On August 4, 2020, the City Commission directed staff to proceed with preparation of a contract for
the sale of 17.96 acres of City -owned property located at the northeast corner of Fuller's Cross and
Ocoee -Apopka Road (the "Agreement"). This direction followed a presentation by staff and the
City Attorney of the results of the City's Request for Proposals solicited for this Property. GPK
Investments proposed the highest sales price. In addition, the City Commission's prior direction
came after a presentation by Charlie Vickers, a representative of GPK Investments, with respect to
the intended development of the Property for commercial uses consistent with the City's plan for
the area.
On October 12, 2020, the City and GPK entered into the Agreement. The Agreement sets a
Purchase Price of $3,560,000.00 with closing to occur once GPK secures Final Site Plan approval
and other development approvals. This Agreement was subsequently approved by the City
Commission.
GPK has now approached the City and no longer wants to develop a commercial project on the
site. Instead, GPK is proposing that the site be developed as a townhome or apartment
development that includes first floor residential on the buildings that front the corner of Fuller's
Cross and Ocoee Apopka Road.
Issue:
Given GPK's proposed change in intended use for the Property from a commercial project to a
townhome or apartment project, City Staff desires to receive input from the City Commission as to
such proposed use as a mixed use commercial/townhome or apartment project.
