Prior to removal of that portion of the agenda, the Mayor and City Clerk staff met and reviewed meeting minutes and it was confirmed that during most meetings the announcements were being deferred to the Comments from Commissioners portion of the meeting. Therefore, the agenda was updated to reflect the current practice of the City Commission. Issue: Should the Commissioners Announcements portion remain on the agenda? Recommendation: Staff recommends the Mayor and Commissioners determine if the Commissioners Announcements portion should remain on the agenda. COMMENTS FROM CITIZENS/PUBLIC -None STAFF REPORTS AND AGENDA REVIEW- 6:19 PM Assistant City Manager Shadrix announced staff conducted research to obtain quotes on costs for mailing a city-wide transportation improvement flyer. He said mailing the flyer city-wide by direct mail will cost$12,621.75;however,inserting the flyer in the utility bill will cost$1,522.50. Discussion ensued regarding this flyer being distributed every year. Motion: Move to approve $2,500.00 from Contingency Funds for the transportation improvement flyer to be inserted with the mailout of the utility bills; moved by Commissioner Brinson, seconded by Commissioner Wilsen; Motion carried unanimously. COMMISSIONERS ANNOUNCEMENTS—6:23 I'M Commissioner Oliver—None Commissioner Firstner—None Commissioner Wilsen—None Commissioner Brinson—None Regular City Commission Meeting January 21,2020 11ay_o4Ohnson—Announced the following: 1) The State of the City will be presented at the next Regular City Commission meeting on February 4, 2020 at 5:45 pm in City Hall. 2) The next Community Redevelopment Agency meeting is scheduled for February 18, 2020 at 5:00 pm in City Hall. 3) Informed the Board that, along with several staff, he will be attending the ICSC ReCon Conference during the week of the May 19th Regular City Commission meeting and inquired if that meeting should be canceled. Motion: Move to cancel the May 19, 2020 Regular City Commission meeting; moved by Commissioner Wilsen, seconded by Commissioner Oliver; Motion carried unanimously. ; ommissioner Wilseri— Inquired if the workshop scheduled for the next meeting on February 4th will be before the State of the City, or whether it should be postponed. (City Clerk Sibbitt) Approved on Consent. Motion carried 5-0. 2. Approval to Extend.the Existing Contract for Traffic Signal Maintenance. . (Public Works Director Krug) The City entered into a contract with Control Specialists Company (CSC) in 2009 to provide traffic signal maintenance by piggybacking off of an existing City of Maitland contract. Public Works has continued to utilize Maitland's contract; however, there is merit for Ocoee to issue an independent traffic signal maintenance contract in order to have better control over the terms and duration.Public Works and Finance are in the process of issuing a Request For Proposal(RFP)for the signal maintenance;however,the current term of the Maitland contract has expired. Public Works is requesting Commission approval to extend the existing contract with CSC until such time as the new RFP is awarded in order to provide continuity of maintenance for the thirty (30) traffic signals for which the City is responsible. Public Works recommends approval of the extension as CSC continues to provide a proactive maintenance program with quick response for emergency situations. 2IPage Regular City Commission Meeting February 4,2020 COMMISSIONERS ANNOUNCEMENTS - 6:33 PM Commissioner Brinson—None Commissioner Wilsen — Thanked the Human Relation Diversity Board for their assistance on the Martin Luther King Parade, and noted it was a wonderful event. Approval of the Minutes for the Regular City Commission Meeting held January 21, 2020. (City Clerk Sibbitt) Approved on Consent. Motion carried 4-0 with Commissioner Oliver absent. 2. Approval of Appointments to the Ocoee Youth Council(OYC). (City Clerk Sibbitt) Members of the Ocoee Youth Council(OYC)serve one-year terms.The Resolution creating the Board allows no more than fifteen(15)members who are residents of Ocoee and entering grades 9-12 in a high school that serves Ocoee students. Currently,the board has three(3)members. Two(2) applications have been received by Chelsea Mendes and Gabrielle Dillon who have shown an interest in being appointed to the Ocoee Youth Council for a term ending July 2021. Approved on Consent. Motion carried 4-0 with Commissioner Oliver absent. 2IPage Regular City Commission Meeting February 18,2020 Commissioner Brinson inquired about the future development of the parcel in question. City Manager Frank addressed his questions. Commissioner Brinson and Commissioner Oliver shared concerns regarding infrastructure. Assistant City Manager Shadrix addressed their concerns. Motion: Move to approve Emergency Item#1, authorizing staff to order appraisals for and prepare Requests for Proposal for purchase of City-owned property located at the intersection of Fuller's Cross and Ocoee-Apopka Road. Moved by Commissioner Brinson, seconded by Commissioner Oliver; Motion carried unanimously. In an effort to reduce the spread of the virus,this City Commission meeting is being held in the City Commission Chambers without the public being present. However, public participation and input is still welcome. Anyone wishing to participate in the City Commission meeting is welcome to participate by e-mail or by phone. If you would like to participate, you can e-mail your question/comment to Citizens@ocoee.org or call 407-554-7118. City staff will be standing by to ensure that your questions/comments come before the City Commission during the meeting. Development Services Director Rumer stated no emails or phone calls were received for Public Comments. Proclamation — Water Conservation Month for April 2020, read and proclaimed by Mayor Johnson STAFF REPORTS AND AGENDA REVIEW- 6:18 PM City Manager Frank announced that staff is requesting to pull Consent Agenda Item #2, Approval of the Neighborhood Matching Grant Program Applicants, due to the revised staff report with regard to Roberts Rise HOA. COMMISSIONERS ANNOUNCEMENTS - 6:19 PM Commissioner Firstner—None Commissioner Wilsen — Pulled Consent Agenda Item #5, Approval of the Lake Prima Vista Sediment Nutrient Inactivation Grant. Commissioner Brinson—None Commissioner Oliver—Pulled Consent Agenda Item #3, Approval of Arden Park North Phase 6 Non-Substantial Amendment to the Planned Unit Development/Land Use Plan(PUD/LUP). Mayor Johnson — Announced that City staff will be standing by to ensure that questions/comments come before the City Commission during this meeting. Regular City Commission Meeting May 5,2020 City Manager Frank announced before them is a memorandum outlining the Ocoee Restaurant Outdoor Dining program in regard to relaxing regulations in order to encourage outdoor seating. An outdoor seating permit is required;however,the City is waiving the permit for 30 days or until full seating is allowed by the State of Florida. Consensus of the City Commission was to authorize the City Manager to take reasonable steps in relaxing regulations regarding the reopening of restaurants. City Manager Frank announced the City will be doing a soft opening in approximately a week. The City's COVID-19 Subcommittee/Task Force is evaluating certain departments that deal with the public and reconfiguring City Hall with one-way entrances/exits, and waiting areas to follow social distancing guidelines. They are also preparing staff with the essential PPE, cleaning supplies, and/or modifying their work spaces. COMMISSIONERS ANNOUNCEMENTS Commissioner Firstner — Thanked the Public Works Department and the contractors for the work being done in the medians on Maguire Road with regard to the Beautification Project; and further said it looks very good and brightens up the area. Commissioner Wilsen—None. Commissioner Brinson—None. Commissioner Oliver— Inquired how citizens that do not have cable, internet or social media can view the agenda items. Discussion ensued regarding different ways the citizens are able to get the information about the agenda items. Mayor Johnson—None. (City Clerk Sibbitt) Approved on Consent. Motion carried 5-0. 2IPage Regular City Commission Meeting June 2,2020 Funding Projects, and the Water and Wastewater Fund. She noted that the City received an unmodified audit opinion, which is the best opinion any city can receive. For 2019 the City was subject to a federal single audit as a result of the FEMA grant activity, and their testing noted no issues of internal controls. She shared the 2018 CAFR received the Certificate of Financial Achievement from the GFOA. Commissioner Oliver shared his feelings of discontent about the CAFR, which he feels does not reflect the trend of the City. He further shared he will continue to push for an independent audit. Commissioner Wilsen confirmed with Ms. Campbell that the audit her firm conducted is considered an independent audit as required by Florida Statute. Ms. Campbell answered in the affirmative,and shared that she believes the audit Commissioner Oliver is seeking is an operational audit, which is separate from a financial report audit. (City Clerk Sibbitt) Approved on Consent. Motion carried 5-0. 2. Approval of Reappointment to the Code Enforcement Board. (City Clerk Sibbitt) The Code Enforcement Board was created by Ordinance No. 741 on June 16, 1981.The purpose of this board is to review infractions of the City technical Codes, negotiate compliance, and impose fines for failure to comply. The Code Enforcement Board shall consist of seven (7) regular members and two (2) alternate members,all with three-year terms.There are no applications currently on file.The three-year term of Member Warren Lewis expires June 2020. Member Lewis has expressed an interest in being considered for reappointment.In 2019 Member Lewis attended five(5)out of ten(10)meetings. Approved on Consent. COMMISSIONERS ANNOUNCEMENTS - 6:59 i'N1 Commissioner Brinson—None Commissioner Oliver— 1) Asked for a system to be in place for the Elected Officials to be able to meet with the City Attorney on Attorney Day.He shared his discontent with the current process. City Attorney Cookson shared he works at the Commissions pleasure, and can be contacted at any time they would like to speak with him. He shared he could also extend his time on Attorney Day to meet individually with Elected Officials. Commissioner Oliver requested that during his one on one meeting that he is briefed by the attorney on any items that pertain to his district. City Attorney Cookson advised he would address any items that he wishes to be briefed on. 2) Shared he is requesting that a disclaimer be placed on correspondences when an Elected Official is sending out a letter using City letterhead to a resident expressing their own personal thoughts. City Manager Frank shared that individual letterheads can be created for each Elected Official. A brief discussion ensued. Consensus of the City Commission was to create personal letterheads for each Elected Official. Amended Motion: Move to allow the HRDB Board to work collaboratively with Sentor Bracy to hold an event on a date to be determined. Moved by Commissioner Oliver, seconded by Commissioner Brinson; After discussion, Motion failed 3-2 with Mayor Johnson, Commissioner Wilsen, and Commissioner Firstner opposing. Motion: Move to designate the dates of October 31st - November 8th for the HRDB Board to coordinate all programs and efforts on a Memorial Program. STAFF REPORTS AND AGENDA REVIEW- 6:20 I'M City Manager Frank announced that City staff is requesting to pull Item #3 which is the addendum to the lease agreement with TNXL Baseball Academy as staff is still finalizing the agreement. Additionally, City staff has asked him to inform the City Commission that for Item #7 Approval to Award RFP #20-004 Fuel Island Upgrade, an additional protest was received but staff is recommending they proceed with approval. STAFF REPORTS AND AGENDA REVIEW- 6:23 PM City Manager Frank announced before them is the following: Emergency Item#1 -Extension of Employer Provided Sick Leave in Consideration of Expiration of the CARES Act City Manager Frank briefly explained the CARES Act, as provided by the Federal Government expired on December 31, 2020. The expiration resulted in the cessation of the 80 hours of Employer Provided Sick Leave (PSL) for employees with symptoms of COVID-19. It is anticipated that the Federal Government will soon pass a new CARES Act by the end of March, but at this point in time there are no guarantees that it will include reimbursement for PSL to be extended past December 31, 2020. If the City Commission chooses to provide this benefit until a new CARES Act is passed,it is anticipated that it would cost approximately $15,000 per month. Motion: Move to approve per staffs recommendation the authorization for the City Manager to extend PSL for employees under COVID-19 protocol retroactive to January 1, 2021.
