Background Summary:
The compensation for the Mayor and Commissioners consists of three (3) categories: salary, stipend
and medical benefits:
Currently, the Mayor's salary is set at $4,500 per year and each Commissioner's salary is set at
$4,000 per year. These salaries were set by Ordinance No. 96-23 which became effective in 1998.
The salaries for members of the City Commission have not changed since 1998.
The current stipend, which is to offset local travel expenditures, is governed by Resolution 2001-13,
as amended by Resolution 2002-21. The annual stipend for the Mayor is set at $4,800.00 and the
annual stipend for each Commissioners is set at $3,900.00. The stipends for members of the City
Commission have not changed since 2001.
Additionally, the Mayor and Commissioners are eligible to receive individual and family medical
benefits. As of August 2019, the individual coverage is $5,592 and the family coverage is $15,480,
not including the use of the City's Clinic and medication dispensary.
Ocoee City Charter `specifically provides the manner in which salaries for the Mayor and
Commissioners are determined. Section C-16 of the Ocoee City Charter provides that the City
Commission may determine the annual salary of the Mayor and the Commissioners by ordinance.
However, the Charter specifies that no ordinance increasing salaries will take effect until the date of
commencement of the terms of members of the City Commission elected at the next regular city
election. Furthermore, the Charter provides that any ordinance increasing salaries must be adopted
at least six (6) months prior to the election after which the salary increases take effect. The next
regular city election will be in March 2023.
Thus, if an ordinance increasing salaries is adopted at any time prior to September 2022, the salary
increases will not go into effect until after the March 2023 election.
As part of the Final Budget Hearing on September 23, 2020, it was proposed that the salaries of the
members of the City Commission be increased by three percent (3%) per year commencing in 1998.
A three percent (3%) per year increase of salaries commencing in 1998 and continuing until such
salaries would be effective in 2023, results in a salary for the Mayor of $9,422.00 per year and a
salary for each District Commissioner of$8,375.11 per year.
Salary increases must be approved by ordinance which requires two (2) readings and a public
hearing.
Issue:
Should the City Commission adopt an Ordinance increasing the annual salary of the Mayor and
Commissioners by three percent (3%) per year from 1998 to 2023 (the earliest such ordinance could
be effective) which would result in a salary increase for the then Mayor from $4,500.00 per year to
$9,422.00 and increasing the annual salaries of each of the then Commissioners from $4,000.00 per
year to $8,375.11 per year?
Recommendations:
Staff recommends that in the event the City Commission desires to increase salaries for the members
of the City Commission by three percent (3%) per year from 1998 to 2023, the City Commission
should adopt this Ordinance which would become effective following the next City election in 2023.

Financial Impact:
Adoption of the proposed Ordinance would, commencing in 2023, increase the annual amount
budgeted for salaries for members of the City Commission from $20,500.00 to $42,922.44.

AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA
RELATING TO SALARIES AND COMPENSATION OF THE
MAYOR AND COMMISSIONERS; AMENDING SECTIONS
24-1 AND 24-2 OF CHAPTER 24 OF THE CODE OF
ORDINANCES OF THE CITY OF OCOEE; INCREASING
THE ANNUAL SALARY OF THE MAYOR OF THE CITY OF
OCOEE FROM$4,500.00 PER YER TO $9,422.00 PER YEAR
AND THE ANNUAL SALARY OF THE COMMISSIONERS
OF THE CITY OF OCOEE FROM $4,000.00 PER YEAR TO
$8,375.11 PER YEAR; REPEALING ORDINANCE NO. 96-23
OF THE CITY OF OCOEE; PROVIDING FOR
SEVERABILITY; PROVIDING FOR CODIFICATION;
PROVIDING AN EFFECTIVE DATE
WHEREAS, Section C-16 of the Charter of the City of Ocoee provides that the City
Commission may determine the annual salary of the Mayor, the Mayor pro tem and the
Commissioners by ordinance; and
WHEREAS, Section C-16 of the Charter of the City of Ocoee further provides that no
ordinance increasing such salary shall become effective until the date of commencement of the
terms of members of the City Commission elected at the next regular city election, provided that
such election follows the adoption of such ordinance by at least six (6)months; and
WHEREAS,the City Commission of the City of Ocoee desires to amend Section 24-1 and
Section 24-2 of Chapter 24 of the Code of Ordinances of the City of Ocoee in order to increase the
annual salary of the Mayor and Commissioners of the City of Ocoee; and
WHEREAS, the City Commission of the City of Ocoee desires to repeal Ordinance No.
96-23 of the City of Ocoee.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE
CITY OF OCOEE,FLORIDA, AS FOLLOWS:
SECTION ONE. Authority. The City Commission of the City of Ocoee has the authority
to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida, Chapter
166,Florida Statutes, and Section C-16 of the Charter of the City of Ocoee.
SECTION TWO. Amendments. Section 24-1 and Section 24-2 of Chapter 24 of the
Code of Ordinances of the City of Ocoee,Florida, are hereby amended to read as follows:
§24-1.Compensation of Mayor.

The annual salary of the Mayor is hereby established at NINE THOUSAND FOUR
HUNDRED TWENTY-TWO AND No/100 DOLLARS ($9,422.00), payable in twelve (12)
monthly installments.
§24-1.Compensation of Commissioners.
The annual salary of each Commissioner shall be established at EIGHT THOUSAND
THREE HUNDRED SEVENTY-FIVE AND 11/100 DOLLARS ($8,375.11), payable in twelve
(12)monthly installments.
SECTION THREE. Repeal. Ordinance No. 96-23 adopted by the City Commission of
the City of Ocoee on December 3, 1996 is hereby repealed in its entirety.
SECTION FOUR. Severability. If any section, subsection, sentence, clause, phrase or
portion of this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction,such portion shall be deemed a separate,distinct and independent provision
and such holding shall not affect the validity of the remaining portion hereto.
SECTION FIVE. Codification. It is the intention of the City Commission of the City
that the provisions of this ordinance shall become and be made a part of the Code of Ordinances
of the City; and that sections of this ordinance may be renumbered or relettered and the word
"ordinance"may be changed to "chapter", "section", "article", or such other appropriate work or
phase in order to accomplish such intentions; and regardless of whether such inclusion in the code
is accomplished, sections of this ordinance may be renumbered or relettered and the correction of
typographical errors which do not affect the intent may be authorized by the City Manager,without
need of public hearing, by filing a corrected or recodified copy of same with the City Clerk.
SECTION SIX. Effective Date. This Ordinance shall be effective on the first Wednesday
following the swearing into office of the newly-elected City Commissioners at the regular
municipal election schedule for March 2023 or, if necessary, the run-off election immediately
following the March 2023 election.
