ORDINANCE NO. 97- 32
AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA
RELATING TO PERSONNEL RULES AND REGULATIONS;
AMENDING ORDINANCE NO. 93-18, AS AMENDED BY
ORDINANCE NOS. 95-27,97-05, AND 97-29 BY AMENDING
SECTION 8.01 TO ADD MARTIN LUTHER KING, JR. DAY
AS AN OFFICIAL CITY HOLIDAY AND TO CHANGE THE
CHRISTMAS EVE HOLIDAY TO EITHER THE DAY
BEFORE OR THE DAY AFTER THE CHRISTMAS DAY
HOLIDAY; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Ocoee desires to amend the City
of Ocoee Personnel Rules and Regulations adopted in Ordinance No. 93-18, as amended by
Ordinance Nos. 95-27, 97-05, and 97-29, to revise the schedule of holidays.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION 1. Authority. The City Commission of the City of Ocoee has the
authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of
Florida and Chapter 166, Florida Statutes.
SECTION 2. Section 8.01 of Article 8 of the City of Ocoee Personnel Rules
and Regulations is hereby amended to read as follows:
8.01 Days Observed
A. When a holiday falls on Saturday or Sunday, the Friday preceding or
Monday following shall be designated a substitute holiday and observed
as the official holiday.
B. The observed holidays are:
January 1
January - 3rd Monday
New Year's Day
Martin Luther King. Jf. Day
May - Last Monday
July 4
September - First Monday
November - Fourth Thursday
November - Day after Thanksgiving
December 24
Deeember - Day before or after
Christmas Day Holiday
as determined by City
Commission
Memorial Day
Independence Day
Labor Day
Thanksgiving Day
Christmas Eve
Deeember 25
Two (2) Personal Days
Christmas Day
C. The City Manager will determine which departments or operations will be
closed in observance of the holiday.
(Additions underlined; deletions are shown by strike thru).
SECTION 3. Severability. If any section, subseetion, sentence, clause,
phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any
court of competent jurisdiction, such portion shall be deemed a separate, distinct, and
independent provision and such holding shall not affect the validity of the remaining portion
hereto.
SECTION 4. Codification. It is the intention of the City Commission of the
City that the provisions of this Ordinance shall become and be made a part of the Code of
Ordinances of the City; and that seetions of this Ordinance may be renumbered or relettered and
the word "ordinance" may be changed to "chapter", "section", "article", or such other
appropriate word or phrase in order to accomplish such intentions; and regardless of whether
such inclusion in the code is accomplished, seetions of this Ordinance may be renumbered or
relettered and the correetion of typographical errors which do not affect the intent may be

authorized by the City Manager, without need of public hearing, by filing a corrected or
recodified copy of same with the City Clerk.
SECTION 5. Effective Date. This Ordinance shall become effective
immediately upon passage and adoption.
