HomeMy WebLinkAbout05-22-2007 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING MAY 22, 2007 CALL TO ORDER Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order at 7:00 p.m. in the Commission Chambers at City Hall. Member Hopper led the Invocation and Member M. Godek led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Godek, Members M. Godek, Hopper, Morton, Stanley, Alternate Member Lowery, and Alternate Member Ahmad. Also present were Code Enforcement Supervisor Loeffler, Code Enforcement Officer Siegrist, Code Enforcement Officer Ramos, Division Chief Stanley, Permitting Clerk Everett, Attorney Lynn Vouis, and Records Coordinator Rittenhouse. ABSENT: Member Chancey was absent excused and Member Ballard was absent unexcused. GUESTS: None. Permitting Clerk Everett administered the oath to Code Enforcement Officer Loeffler, Code Enforcement Officer Siegrist, Code Enforcement Officer Ramos, Division Chief Stanley and anyone intending to speak regarding a case. CONSENT AGENDA ALL MATIERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED ROUTINE BY THE CODE ENFORCEMENT BOARD AND WlLL BE ACTED UPON BY ONE MOTION. Officer Siegrist gave a detailed history of the case and provided exhibits. He further announced that as of May 21, 2007, the respondent was in compliance. Anita Jean Wade, 240 Taylor Street, stated this is her first time having to come before the board. She added that her daughter's ex-boyfriend brought the whole issue about. She apologized for the problem. Case No. 07-052 - Charles Butterfield 716 Crystal Drive Officer Siegrist Violation Cited: 165-3, 108-23, 115-6, 115-3,6-4 04-02-07 NOCV Re-Inspection Date: 04-25-07 05-03-07 SOY 05-03-07 NOH Meeting Date: 05-22-07 05-03-07 POS Certified Mail Observation: 1) Ford Ranger XLP Pick-up truck/red/FL Tag# F17 4KD/expired Dec. 2006, full of misc. trash and debris; also Ford T-bird Ired/no tag; also, Mercury Grand Marquis/tan/no tag, 2) Fence in disrepair (6 ft. wood in backyard), 3) Swimming pool without safety fencing, 4) Miscellaneous trash and debris, 5) One (1) black utility trailer in front yard and one (1) boat/trailer on side yard. Officer Siegrist gave a brief history of the case and provided exhibits. He further announced that as of May 22, 2007, the property remained in non-compliance of 165-3. All other violations were in compliance. Charles Butterfield, 716 Crystal Drive, stated that the Mercury is the only vehicle that he has and it needs repair. The other two vehicles belong to his sons. They will get the vehicles tagged and insured within a few weeks. Member Godek inquired as to when the vehicles would be in compliance. Mr. Butterfield stated that he could have the tags by next month. Alternate Member Lowery stated that the vehicles must have been purchased from individuals. If they had been purchased from a dealer, a tag would have been required. He added that Mr. Butterfield is the homeowner and he is responsible for the fact that vehicles aren't in compliance. The sons need to take care of the vehicles, and if they don't have the money, then they need to get rid of them. Officer Siegrist Officer Siegrist gave a detailed history of the case and provided exhibits. He further stated on May 22,2007, the property was re-inspected and found to be in non-compliance. Charles Butterfield, 716 Crystal Drive, stated that half of the contents belong to him and the other half to his son. He stated that his house was supposed to be done the beginning of April but wasn't finished on time. He believes it has been there for approximately a month. He is hoping to get it out by the 10th of June. Member Hopper inquired as to what the deal is with PODS, is a permit required? Officer Siegrist stated it is vague, there are no specifications. Generally they allow one to be there for a month. Member M. Colonial Drive Division Chief Stanley Violation Cited: NFPA 10111.1.5 05-03-07 NOCV Re-Inspection Date: 05-09-07 05-11-07 SOY 05-11-07 NOH Meeting Date: 05-22-07 05-11-07 POS Certified Mail Observation: Extension cord(s) being used in place of penn anent wiring. Division Chief Stanley gave a brief history of the case. He further stated as of May 22, 2007, the property was re-inspected and found to be in non-compliance. Tom Huynh, 11137 W. Colonial Drive, stated there was a misunderstanding because he thought the only violation was the television. He later found out that the violation was the soda machine. They have fixed that. Division Chief Stanley stated that Tom needed to notify them that they had fixed the problem in order for them to come back out and re-inspect. Division Chief Stanley requested that this case be continued to the next meeting, as it appeared that the respondent may be in compliance. He further stated that on May 17,2007, the property was re-inspected and found to be in compliance and they are recommending a cost recovery fee for administrative time of $111.08. Member M. Division Chief Stanley Division Chief Stanley gave a detailed history of the case and provided exhibits. He further stated on May 07, 2007, the property was re-inspected and found to be in compliance and they are recommending a cost recovery for administrative time of $100.54. Officer Siegrist gave a detailed history of the case and provided exhibits. He further stated that upon re-inspection on April 30, 2007, the property was found to be in compliance. Member Hopper inquired if it is the owner's responsibility to maintain the right-of-way. Case No. 07-051 - Teresita Leyva 2440 Stricker Drive Officer Siegrist Violation Cited: 119-28,115-3,6-4,108-22,6-10 04-04-07 NOCV Re-Inspection Date: 04-24-07 05-03-07 SOY 05-03-07 NOH Meeting Date: 05-22-07 05-03-07 POS Certified Mail Observation: Operating a business within Corporate City limits, from residence, NOT within terms and conditions of City Occupational License. Multiple trailers on site. Misc. trash and debris, as well as bldg. supplies on property. Also, electrical work without permit: exterior electrical panel box cover removed, exposed electrical wiring, hanging conduit, and spliced wiring. Also, tree removed in backyard without permit. Officer Siegrist gave a detailed history of the case and provided exhibits. He further stated the violation cited in 6-10 was incorrect and should be removed. He added that as of May 22, 2007 the property was still in non-compliance with 119-28, 115-3 and 108-22 and in compliance with 6-4. Teresita Leyva, 2440 Stricker Drive, (Translated by Carmen Ramos), stated that she bought the house 10 months ago and they were working on repairing the house. That is why the trailer was there. They are also trying to fix the backyard, but have not finished. The trailer is there because they are repairing the house and doing work on the roof. She rented a place in Apopka and they just need to take the scaffolds there to store them. She stated that she has permits for the roof and stucco. She added that she took the permits down a week ago because they were finished. Officer Siegrist stated that he did not see any permits when he inspected. He added that she has a roof permit, a stucco permit and a tree removal permit. She also has an occupational license. The storage, trash/debris and electrical issues have not been addressed as of today. Ms. Leyva (translated by Carmen Ramos) stated that the only thing that is business related are the scaffolds, which are going to Apopka for storage. Alternate Member Lowery stated that it does not appear that the house is being worked on; it looks like the items are being stored at the home. He also stated that the electrical issues needed a permit and need to be brought to code. Officer Siegrist stated that no permit has been issued for electrical. Ms. Leyva (translated by Carmen Ramos) stated that they were working on the stucco, which is why the electrical box was removed. Chairman Godek asked Ms. Leyva when the property will be in compliance. Trailers must be stored behind front building line. (Small bed dump truck without tag and jet ski on trailer in front of house.) Officer Ramos gave a detailed history of the case and provided exhibits. She further stated that as of May 22, 2007, the property was in non-compliance. Officer Loeffler stated that he was there at the time when the Proof of Service was delivered and the property owner did come outside. Member M. Occupied by homeless persons. No water or electric utilities and Page 8 of 12 Code Enforcement Board Minutes May 22, 2007 related sanitary issues. Entrance door missing. Structure unsecured. Exterior siding loose and mold- covered. Roof leaking: water damage to interior areas. Broken/missing windows. Lot over-grown with weeds and grass. Conditions creating an attractive nuisance, blight and danger to the public health, safety and welfare. Structure is a public nuisance and not safe for human occupancy. Occupancy cannot be permitted with respect to City Ordinances and Florida Building Codes. Officer Loeffler gave a detailed history of the case and provided exhibits. He further stated that the violation was in full compliance and has been demolished. Member Stanley stated that she felt that a $500 fine should be assessed to recover staff time spent on this case. Officer Loeffler stated that he did not feel that was necessary and not too much time was actually needed for this case. Member M. Colonial Drive Officer Siegrist Violation Cited: 51-13, 115-3 04-17-06 NOCV Re-Inspection Date: 05-03-07 05-04-07 SOY 05-04-07 NOH Meeting Date: 05-22-07 05-04-07 POS Certified Mail Observation: At least three (3) clothing donation boxes ("Childrens Rights Foundation") on property without permits. Also, clothing and furniture items (trash and debris) strewn thru parking lot. Officer Siegrist gave a brief history of the case and provided exhibits. He further added that the property remained in non-compliance as of May 22, 2007. He also stated that Childrens Right Foundation removed their boxes and they are in compliance as of May 14,2007. This case is only against Orlando Punit, LLC. Member Morton. seconded bv Member M. Godek. moved in Case No. 07-061 to find the respondent in violation as cited as of April 27. 2007. and to find the Childrens Rights Foundation comvliant as of Mav 14. 2007. with Orlando Pun it. Officer Siegrist gave a detailed history of the case and provided exhibits. He further stated that the property remained in non-compliance as of May 22, 2007. Guiliano 2348 Holly Ridge Drive Violation Cited: 115-6,115-3,108-35 04-04-07' NOCV Re-Inspection Date: 04-14-07 04-10-07 SOV 04-10-07 NOH 04-10-07 POS 04-10-07 POS 04-10-07 POS 04-24-07 CO Officer Loeffler Meeting Date: 04-24-07 Certified Mail Regular Mail Unsuccessful Hand Delivery Found in Violation as cited. Given until 04-25-07 to be in compliance or be fmed $250.00 a day/per violation. 04-24-07 City given permission to secure property and lien for costs involved. Observation: Citizen generated e-better complaint: Vacant structure with unsanitary/green water in-ground swimming pool. Observed un-secured open access to in-ground swimming pool. Pool water green and unsanitary. Pool accessible via missing, ripped enclosure screens and 2 unlocked enclosure doors. Structure unsecured. Evidence of open-window egress via pool-side window. All windows unsecured. Evidence of unauthorized water use discovered and water dispatched to lock meter. Officer Loeffler stated that this is the case where the board wanted the City to secure the doors and the property owners would be responsible for cleaning the pool. He added that he did secure the doors with pad locks. The pool had not been cleaned. The next day, he returned to the home and it appeared that someone had removed his locks and secured the doors. At that time, there were holes cut into the screens to allow additional access into the home. The property owners have not taken any of the required action. Member M. Godek. seconded bv Member HODDer. moved that in Case No. 07-041. a lien be imposed at the request of the Citv for this proverty. Motion carried unanimous Iv. Page 10 of 12 Code Enforcement Board Minutes May 22, 2007 Alternate Member Lowery stated that he foresees the screen issue being a continuous problem. Officer Loeffler stated that the Code Enforcement Board could issue an order to have the pool drained. The City would then contract with a company to drain the pool. Member Hopper stated that there is still a danger with the pool drained. The property needs to be secured. COMMENTS Code Enforcement Officer Loeffler presented the activity synopsis for April 2007: APRIL 2007 Minimum Housing Standard Inspections Pre -existing Housing Stock = 79 (2006 = 72) Occupational License Inspections = 17 (2006 = 17) E-Better Place Complaint Investigations = 10 (2006 = 12) Complaint & Nuisance Investigations = 191 (2006 = 145) 83 via call-in, walk-in, e-mail, flag down 16 via other city departments/divisions Remainder pro-active/self-initiated Nuisance Signs/Street-Spam Removed = 96 (2006 = 119) Code Enforcement Officer Loeffler displayed before and after pictures of a nuisance on North Lakewood. Code Enforcement Officer Siegrist stated that Officer Ramos did a great job. Code Enforcement Officer Ramos thanked the board for their support and added that she loves her new position. Alternate Member Lowery stated that everyone was doing a great job and a lot of issues are being addressed for the City. Alternate Member Ahmad thanked the board for welcoming him so warmly. Member Hopper stated that the self-initiated process is very important and he thanked the officers for their hard work. He also encouraged the residents to utilize the E-Better concept. Member Morton inquired as to the status of Colony Plaza situation. Chairman Godek thanked everyone for getting through the case load so rapidly. He also announced that Member Morton will be resigning in a few months. He would like to stay on the board through August. Chairman Godek recommended that Alternate Member Lowery become a permanent member and seek another alternate candidate. Chairman Godek also discussed the session regarding Colony Plaza. He stated that himself and Member M. Godek will be unable attend to the first weekend in November. Member Chancey will be gone October 20th and 27th.
