Subject: FULLERS CROSS ROAD AND OCOEE-APOPKA INTERSECTION IMPROVEMENTS CHANGE ORDER NO. 04 Background Summary: The Commission awarded the Construction Manager At Risk contract for the Fullers Cross Road and Ocoee Apopka Road Intersection Improvements at the September 17, 2019 meeting to Oelrich Construction, Inc: The original Final Engineering Construction Plans from VHB did not include cross- sectional details of the proposed roadway pavement overbuild thickness. During construction it was discovered that the amount of asphaltic overbuild would exceed 14" in certain sections bf Ocoee- Apopka Road which.would vastly increase the overall cost of.the project. In order to reduce the amount. of asphalt needed for the project, Public Works Staff performed value engineering on the proposed roadway profile and, provided cross-sectional details every fifty feet. The redesigned roadway eliminated the need for asphalt overbuild on Ocoee-Apopka. To offset some of the costs, portions of the construction have'been reallocated to new subcontractors to reduce the costs of overhead and mark-up. Additionally, the City will mitigatecosts by electing to execute portions of the construction in-house. An additional 118 calendar days are required due to the delay caused by the conflict. The project will be substantial complete on October. 29th while the final completion date is December 8th. The cost of the change order is $111,915.50, which will bring the total cost of the contract to $2,360,045.87 with the change order to be funded from City Road Impact Fees. Public Works recommends approval of Change Order No. 04. Issue: Should the City Commission to approve and execute the Fullers Cross Road and Ocoee. REQUIRED CHANGES The scope of work for the Fullers Cross and Ocoee Apopka Intersection Improvements has changed due to a redesign of the pavement sections. The change in the project scope has caused additional time and labor to be required for the construction. Specifically, an additional 118 calendar days and labor will be required, at a cost of$120,620.09. This change order will also correct an error in Change Order 01,reducing the overall contract price by $8704.58. The final change order cost is $111,915.50. IL JUSTIFICATION The original Final Engineering Construction Plans from VHB did not include cross-sectional details of the proposed roadway pavement overbuild thickness.During construction it was discovered that the amount of asphaltic overbuild would exceed 14" in certain sections of Ocoee- Apopka Road which would vastly increase the overall cost of the project. NARRATIVE OF NEGOTIATIONS Public Works negotiated with Oelrich Construction to determine the scope and scale of the delay caused by redesign of the roadway cross-sections. IV. PAYMENT In accordance with the contract. V. APPROVAL AND CHANGE AUTHORIZATION The original project and funding allocation was established by issuance of a CITY purchase order, subject to the terms and conditions contained in the CITY's solicitation, Project Manual, Drawings, Specifications, and/or the CONTRACTOR's service and price proposal, which collectively form the terms of an agreement between the CITY and the CONTRACTOR for the Fullers Cross Road and Ocoee Apopka Road Intersection Improvements, Change Order#04 performance of the Work. This proposed change to the agreement requires approval by the City Commission under the CITY's Purchasing Rules and Regulations and is consistent with any prior action by the City Commission to award the Work to the CONTRACTOR. It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original agreement other than matters expressly provided herein. CONTRACTOR acknowledges, by its execution and acceptance of this Change Order,that the adjustments in contract price and time shown hereon constitute full and complete compensation and satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. On July 28, 2021, the City of Ocoee instructed Oelrich Construction to halt all roadway reconstruction operations to discuss a potential redesign which would eliminate excess overbuild asphalt in the project scope. On August 18, 2021, the City provided new construction plans that reduced the amount of asphalt required to complete the project scope of work and changed the grading profile of the roadway.These changes are documented in RFI#21-City of Ocoee Roadway Redesign and RFI#22-4" Reduction of the Black Base in the SE Quadrant. The scope can be summarized as follows: 1. • Discovery-Asphalt overbuild would exceed the 1" max allowance carried in the GMP, totaling over 14" in some locations. The City of Ocoee also wanted to address the super • slope's impact on drivers as they attempted to enter the left turn lane going northbound on • Ocoee Apopka Rd. • Redesign- Per request of the City, a new survey was completed of existing grades and after, discovering the existing grades shown on the Construction Plans dated February 3rd,2021 didn't accurately portray the current roadway conditions.Oelrich also maintained the current TTC(Temporary Traffic Control)during the redesign process. • RemobilizationlRework - To get the lowest possible cost associated with the new roadway design Oelrich Construction has removed scope carried in the"Earthwork" line item of the Schedule of Values (from Zorrn)and will contract directly with these vendors.
