HomeMy WebLinkAboutOrdinance 92-06 ORDINANCE NO. 92- 06 AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA RELATING TO AND AMENDING THE FEES FOR THE ISSUANCE OF BUILDING FEBHITS, MECHANICAL PERMITS, PLUMBING AND GAS PERMITS AND ELECTRICAL PERMITS; REPEALING IN ITS ENTIRETY THE CURRENT CHAPTER 5, SECTION 5-44, CHAPTER 9, SECTIONS 9- 32, 9-35 AND 9-47, CHAPTER 14.5, SECTIONS 14.5-33, 14.5-37, 14.5-38 AND 14.5-47 AND CHAPTER 18, SECTIONS 18-35, 18-42, 18-43 AND 18-50; CREATING A NEW CHAPTER 5 SECTION 5- 44, CHAPTER 9, SECTIONS 9-32, 9-35, AND 9-47, AMENDING THE CURRENT CHAPTER 9, SECTION 9-44 CREATING A NEW CHAPTER 14.5, SECTIONS 14.5-33, 14.5-37, 14.5-38 AND 14.5-47 AND CHAPTER 18, SECTIONS 18-35, 18-42, 18-43 AND 18-50; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE. BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE; SECTION 1. The present Chapter 5, section 5-44 as created by Ordinance No. 89-13 of the Code of Ordinances of the City of Ocoee, Florida is hereby repealed in its entirety. SECTION 2. A new chapter 5, Section 5-44 of the Code of Ordinances of the City of Ocoee, Florida is created to read as follows: section 5-44 Application for permit; fees. (A) Application for permit shall be submitted on forms provided by the Building Department and shall be accompanied by a plot plan and such plans and/or specifications as are necessary to describe the work to be done. Such application shall also be accompanied by a non-refundable plan review fee, as applicable. (B) The valuation of all buildings, structures or alterations requiring a permit shall be performed by the Building and Zoning Official. The Building and Zoning Official shall base his valuation of the building and calculation of permit fees on the following: 1. Building permit fees for one and two family residential construction is $30.00 plus $3.50 per $1,000.00 of Residential Construction Cost. 2 . Residential Construction calculated as follows: Cost shall be a) Up to 1,000 square feet - $25.00 per square foot or actual construction cost, whichever is greater. b) 1,001 square feet to 2,000 square feet - $30.00 per square foot or actual construction cost, whichever is greater. 1 c) 2,001 square feet and over - $35.00 per square foot or actual construction cost, whichever is greater. 3. Permit fees for commercial (all construction other than one and two family residential construction) are $30.00 plus $3.50 per $1,000.00 of Commercial Construction Cost. 4. Commercial, Construction Cost (construction other than one and two family residential construction) shall be calculated as follows: a) Up to 2,000 square feet $33.00 per square foot or actual construction cost, whichever is greater. b) 2,001 square feet and up - $35.00 per square foot or actual construction cost, whichever is greater. 5. Building permit fees for additions, alterations, or repairs shall be calculated at the above rates. 6. Screen enclosures are $30.00 plus $3.50 per $1,000.00 of actual construction cost. 7. Sign permits are $1. 00 per square foot of sign. 8. Seawalls, boat docks and boat houses, are $30.00 plus $3.50 per $1,000.00 of actual construction cost. 9. Moving an existing building or structure is as follows: a) To outside of city expenses. $100.00 plus b) Into or within the City - $200.00 plus expenses. c) Relocation on same lot expenses. $50.00 plus d) Demolishing any building or structure - $30.00. 10. For factory built housing (mobile homes) park and tie-down the Permit fee is $100.00. In addition to the $100.00 permit fee, there shall be a $50.00 non-refundable inspection fee plus $1.00 per mile for any mobile home inspection that is located over 50 miles from the City Limits of Ocoee. If the application is approved, the $50.00 inspection fee shall be applied to the park and tie-down permit fee. 11. Fences - (all types) are $30.00. 12. Temporary construction trailers or structures are $30.00. 13. Roofing: a) New residential and commercial is $30.00. 2 b) Re-roofing or roofing repairs is $30.00. 14. Paving, sidewalks, curb, gutter and subdivision walls including, (all types of materials) shall be calculated as $30.00 plus $3.50 per $1,000.00 of actual construction cost. 15. Water and sewer distribution systems installed by developers or developer's contractor shall be calculated as two (2) percent of contract price. 16. Land clearing or tree removal shall be calculated as the fee shall be $10.00 per lot for each lot contained in the legal description of the property to be cleared or twenty-five dollars ($25.00) per acre, whichever is greater. (C) Subject to approval of the Building and Zoning Official, actual construction cost may be determined by using the contract price of construction. Contract price of construction shall include structural, electrical, plumbing, interior finish, normal site preparation, (excavation and backfill for building), architectural and engineering fees. A copy of the itemized contract shall be required in all instances where contract price is used to determine actual construction cost. (D) A permit shall not be issued until the fees prescribed in this section have been paid, nor shall an amendment to a permit be released until the additional fee, if any, due to an increase in the estimated cost of the building, structure, electrical, plumbing, mechanical or gas systems, has been paid. (E) Any person or entity who commences any work on a building, structure, electrical, gas, mechanical or plumbing system or other activity requiring a permit hereunder, before obtaining the necessary permits, shall be subject to a penalty of 100% of the usual permit fee in addition to the required permit fees. (F) Minimum permit fee shall be $30.00 for permits with a construction valuation over $1,000.00 dollars and $15.00 for all permits with a construction valuation of less than $1,000.00 (G) Plan Review, and Inspections and Re-inspections. In addition to any permit fees payable as provided in this Chapter, the following plan review and inspection fees must also be paid prior to the issuance of any permit. 1. Plan review and inspection fees: a) Residential - 1/2 of permit fee for plan review, in addition to permit fee. b) Commercial 1/2 of 1% of value of construction for plan review, in addition to permit fee. 3 2. Plan review fees shall not be charged for construction projects when construction plans or drawings are not required. 3. Reinspection fees: a) First reinspect ion $15.00 b) Second reinspect ion for the same non-compliance $30.00 c) Subsequent reinspect ions for same non-compliance $30.00 4. Requests for special after-hours (other than normal working hours, weekend or holidays) inspections shall be submitted to the Building and zoning Official in writing by the contractor forty-eight (48) hours in advance of the requested inspection. The minimum number of hours that will be approved is three (3) hours. No inspection(s) will be approved until the inspection fees have been paid. The rate per hour for special after-hours inspections is $50.00. SECTION 3. The present Chapter 9, sections 9-32, 9-35 and 9- 47 of the Code of Ordinances of the City of Ocoee, Florida are hereby repealed in their entirety. SECTION 4. A new Chapter 9, Sections 9-32, 9-35 and 9-47 of the Code of Ordinances of the City of Ocoee, Florida are created to read as follows: Section 9-32. Electrical Permit Fees. Applications for permits shall be submitted on forms provided by the Building Department. Such application shall be accompanied by the following permit fees: (A) Standard fees for commercial and residential electrical permits of 1000 volt amperage or less are based on the total amperage of the service installation. One electrical permit is required for each recording watt-hour meter service. Should circumstances make it practical to issue one permit involving more than one watt-hour recording meter service, the fee shall be calculated using the sum of the fees of the total number of individual watt- hour meter services. For all commercial and residential additions, alterations, or repairs not requiring a new service, the fee shall be $30.00 plus $10.00 per $1,000.00 or fraction thereof of contract price over $3,000.00. Sanitary Lift stations/ Similar uses $ 30.00 30.00 30.00 Section 9-35. Permit. Fee When Work Commenced Before Obtaining Any person or entity who commences any electrical work which requires a permit before obtaining the necessary permit, shall be subject to a penalty of 100% of the usual permit fee in addition to the required permit fee. section 9-47. Reinspection and Reinspection Fees. In the event the building inspector, upon inspection, shall find any work not in compliance with this Chapter, the person doing said work shall promptly do everything necessary to bring said work within the requirements of this Chapter. The building inspector shall then, upon notice from such person, reinspect said work after payment of the following fees: First Reinspection $ 15.00 ( Second reinspect ion for same non-compliance $ 30.00 Subsequent reinspect ions for same non-compliance $ 30.00 section 9-44. Inspections required. The following is hereby added to the current Chapter 9, section 9-44 of the Code of Ordinances of the City of Ocoee, Florida: Request for special after-hours (other than normal working hours, weekend or holidays) inspections shall be submitted to 5 the Building and zoning Official in writing by the electrical contractor forty-eight (48) hours in advance of the requested inspection. The minimum number of hours that will be approved is three (3) hours. No inspection(s) will be approved until the permit fee has been paid. The rate per hour is $50.00. SECTION 5. The present Chapter 14.5, sections 14.5-33, 14.5- 37, 14.5-38 and 14.5-47 of the Code of Ordinances of the city of Ocoee, Florida are hereby repealed in their entirety. SECTION 6. A new Chapter 14.5, Sections 14.5-33, 14.5-37, 14.5-38 and 14.5-47 of the Code of Ordinances of the city of Ocoee, Florida are hereby created to read as follows: Section 14.5-33 Conditions, form for issuance of permits. A permit shall not be issued until the permit fees prescribed in this section have been paid, nor shall an amendment to a permit be released until the additional fee, if any, due to an increase in the estimated cost of the mechanical system, has been paid. permi ts shall be issued in writing upon forms provided by the Building Department. Section 14.5-37; Mechanical Permit Fees. Permit fees shall be based on the contract price or selling price of an installation or alteration. Permit fees for air conditioning, heating and ventilation installations or alterations are as follows: A) Up to and including the first $1,000.00 - $30.00. B) For each additional $1,000.00 or fraction thereof up to $25,000.00 - $10.00. C) For each additional $1,000.00 or fraction thereof over $25,000.00 - $6.00. section 14.5-38; Fee When Work Commenced Before Obtaining Permit. Any person who commences any work on a mechanical system before obtaining the necessary permit shall be subject to a penalty of 100% of the usual permit fee in addition to the required permit fee. section 14.5-47; Reinspection and Reinspection Fees. A. In the event the inspector, upon initial inspection, shall find said work not in compliance with this Chapter, the person doing said work shall promptly do everything necessary to bring said work wi thin the requirements of this Chapter. The inspector shall then, upon notice from such person, reinspect said work after payment of the following fees: ( 1) First reinspection $ 15.00 2) Second reinspection for same non-compliance 30.00 3) Subsequent reinspect ions for same non-compliance 30.00 B. Request for special after-hours (other working hours, weekend or holidays) shall be submitted to the Building Official in writing by the contractor than normal inspections and Zoning forty-eight 6 (48) hours in advance of the requested inspection. The minimum number of hours that will be approved is three (3) hours. No inspection(s) will be approved until the Permit fee has been paid. The rate per hour shall be $50.00. SECTION 7. The present Chapter 18, sections 18-35, 18-42, 18- 43 and 18-50 of the Code of Ordinances of the City of Ocoee, Florida are hereby repealed in their entirety. SECTION 8. A new Chapter 18, Sections 18-35, 18-42, 18-43 and 18-50 of the Code of Ordinances of the city of Ocoee, Florida are created to read as follows: section 18-35. Conditions, form for issuance of permits. A permit shall not be issued until the permit fees prescribed in this section have been paid, nor shall an amendment to a permit be released until the additional fee, if any, due to an increase in the estimated cost of the building, structure, electrical, plumbing, mechanical or gas systems, has been paid. Permits shall be issued in writing upon forms provided by the Building Department. section 18-42. Permit fees or plumbing and gas permits. A. All plumbing and gas permits for residential (one and two family homes) shall be $30.00 plus $3.00 per fixture or appliance. B. Commercial plumbing and gas permits shall be based on the contract or selling price of the installation or alteration. The permit fee shall be $30.00 plus $3.50 per $1,000.00 of actual cost or fraction thereof. C. All residential irrigation permits shall be $30.00. D. All commercial irrigation permits shall be $30.00 plus $3.50 for each $1,000.00 of actual cost or fraction thereof. section 18-43. Work Commencing Before Permit Issuance. Any person who commences any work on a plumbing or gas system before obtaining the necessary permits, shall be subject to a penalty of 100% of the usual permit fee in addition to the required permit fees. section 18-50. Reinspection and Reinspection Fees. A. In the event the inspector, upon initial inspection, shall find work not in compliance with this Chapter, the person doing said work shall promptly do everything necessary to bring said work wi thin the requirements of this Chapter. The inspector shall then, upon notice from such person, reinspect said work after payment of the following fees: ( 1) First reinspection $ 15.00 2) Second reinspect ion for same non-compliance 30.00 3) Subsequent reinspect ions for same non-compliance 30.00 7 B. Request for special after-hours (other than normal working hours, weekend or holidays) inspections shall be submitted to the Building and zoning Official in writing by the contractor forty-eight (48) hours in advance of the requested inspection. The minimum number of hours that will be approved is three (3) hours. No inspection(s) will be approved until the assessed fee has been paid. The rate per hour shall be $50.00. SECTION 9. Severability. If any section, subsection, sentence clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 10. Codification. It is the intention of the City commission of the City that the provisions of this ordinance shall become and be made a part of the Code of Ordinances of the city; and that sections of this ordinance may be renumbered or relettered and the work "ordinance" may be changed to "chapter", "section", "article", or such other appropriate word or phrase in order to accomplish such intentions; and regardless of whether such inclusion in the code is accomplished, sections of this ordinance may be renumbered or relettered and the correction of typographical errors which do not affect the intent may be authorized by the City Manager, without need of public hearing, by filing a corrected or recodified copy of same with the City Clerk.
