AN ORDINANCE OF THE CITY

WHEREAS, the City commission of the City desires to
establish the Combat Automobile Theft programs to prevent
automobile thefts with the City.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION ONE. Short Title and Authoritv.
(a) This Ordinance shall be known and may be cited
as the "Combat Automobile Theft Program."
(b) The City commission of the City of Ocoee has
the authority to adopt this Ordinance pursuant to Article VIII of
the Constitution of the state of Florida and Chapter 166 and
section 316.008, Florida Statutes.
SECTION TWO. A new Chapter 7A of the Code of Ordinances
of the City of Ocoee, Florida, is hereby created and reads as
follows:
SECTION 7A-l. Combat Automobile Theft program.
There is hereby established a Combat Automobile Theft
Program. In connection with the Program, the City shall
provide the following:
(a) Consent forms to be signed by motor vehicle
owners who volunteer to enroll their vehicles in the Program;
and
(b) Bright yellow decals indicate a vehicle's
enrollment in the Program.
SECTION 7A-2. Consent Forms.
The consent forms shall:
(a) Explain the general operation of the Program;
(b) Provide authorization for a law enforcement
officer to stop the vehicle when it is being driven between
the hours of 1:00 a.m. and 5:00 a.m., provided that a decal is
conspicuously affixed to the bottom left corner of the back
window of the vehicle to provide notice of its enrollment in
the Program;

(c) Advise the motor vehicle owner of the proper
means by which the driver of the vehicle should cooperate with
the law enforcement officer in such instance;
( d)

Provide that the owner of the motor vehicle is
for removing the decal when terminating
participation in the program, or when selling or otherwise
transferring ownership of the vehicle and for notifying the
City of Ocoee Police Department in writing of said
termination;
(e) Provide that the owner of the motor vehicle is
responsible for informing any person authorized to use the
vehicle that said vehicle is registered in the program;
(f) Clearly provide that participation in the
Combat Automobile Theft Program is strictly voluntary and may
be terminated at any time;
(g) Include a statement which indicates that the
consent form has been read and understood in its entirety,
including the procedures to be observed by the driver during
a stop by the City of Ocoee Police Department made in
connection with the Program; and
(h) Include any other provisions which the Chief of
Police or the City may deem appropriate.
SECTION 7A-4. Proqram Implementation.
The Combat Automobile Theft Program shall be implemented
upon approval of program materials and procedures by the Ocoee
Police Department, including guidelines and procedures for
making a stop of a vehicle bearing a decal by sworn officers
of the Ocoee Police Department. Such program materials and
procedures may be subject to periodic review and approval by
the Chief of Police of the Ocoee Police Department.
SECTION 7A-S. Jurisdiction.
This Chapter shall apply to the incorporated areas of the
City of Ocoee.
SECTION THREE.
Severability.
If any section,
subsection, sentence, clause, phrase or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion hereto.
SECTION FOUR. Codification. It is the intention of the
City commission of the City that the provisions of this ordinance
shall become and be made a part of the Code of Ordinances of the
ci ty; and that sections of this ordinance may be renumbered or
relettered and the word "ordinance" may be changed to "chapter",
"section", "article", or such other appropriate word or phrase in
order to accomplish such intentions; and regardless of whether such
inclusion in the code is accomplished, sections of this ordinance
may be renumbered or relettered and the correction of typographical
errors which do not affect the intent may be authorized by the City

Manager, without need of public hearing, by filing a corrected or
recodified copy of same with the City Clerk.
SECTION FIVE.
Effective Date.
This Ordinance shall
become effective immediately upon passage and adoption.
