NOTES: BREEDERS In recent allegations on social media, 4 breeders were mentioned out of the hundreds we purchased from. There are claims that we purchased puppies from a breeder that has a relative with issues. A person isn't guilty by association simply because they are related to someone so it's not relevant. The breeder in question is Federally licensed and inspected. We purchased approximately a dozen puppies from this breeder between 2020 and 2021. Online federal inspection reports show that every single inspection report, a total of 8 inspections dating back to 2015, shows ZERO violations. Daniel Gingerich- Another recent allegation claims that we have been purchasing puppies from a breeder that is now facing a federal lawsuit, that is false. We DID purchase some puppies from this breeder after reviewing his online inspection reports and seeing multiple inspections with ZERO violations from 2019 through March of 2021, along with 2 non critical violations which the United States Department of Agriculture defines as quote "something that is not having a serious or severe impact on the welfare of an animal at the time of inspection — such as a clogged drain outside an animal enclosure" unquote. As SOON as we saw that he began to have serious violations on his inspection, we stopped buying puppies from him. We didn't continue to buy puppies, and we stopped well BEFORE all of this became public. This is a clear example of the animal welfare regulations working. The breeder started out ok and for whatever reason, became a bad apple. We utilized the system and stopped using a bad apple as soon as we became aware of it. Every single USDA inspection report from 2021 going back all the way to 2015, seven years worth of inspections, has not shown a single violation for this breeder. These federal inspection reports show ZERO violations going back 5 years, as far back as 2016. In 2016 and 2015, inspection reports shows some "non -critical" violations. I believe that the CountV Commissioners realize that a solid NO as policy is better, and in this case more humane, and can be enforced, rather than the bad policy Ocoee is proposing. Ocoee Commissioners don't want to follow County Ordinances ("home rule"), but yet Ocoee Commissioners expect the Orange COUNTY Animal Services to enforce the Ocoee CITY Ordinance. That is passing the buck. Literally. And when, not if, a violation is incurred, the Ocoee Commission thinks that Chews is going to willingly let you know? Isn't that asking the fox to guard the hen house? Again, the Ocoee Ordinance passes the buck on to the potential buyer to request pertinent information about the puppy's health and where the puppy came from. How long does Chews A Puppy have to provide that information? Weeks after purchase? That's too late; this information should be posted on each kennel of each puppy. And the consumer is supposed to know how to verify this paperwork? I think Chews should be forced to put a hold on any puppy to give the potential buyer time to verify the information about the puppy. And a DNA test should be included with the information to prove that the animal is truly what Chews A Puppy says it is. The proposed Ocoee ordinance is bad policy. I had hoped that the City of Ocoee officials had done their due diligence and investigation of Chews A Puppy before letting this proposed ordinance get this far. Unanswered is the documentation that Rosina McVicker submitted on September 19th, before the last commission meeting. I'll summarize the documentation she submitted:. • An Orlando Weekly article about sick puppy mill animals going to Florida. • ASPCA.ORG paper showing Chews A Puppy receiving puppy .mill animals. • Bailing Out Benji found that the USDA has filed a lawsuit against Maple Hill Puppies, a known supplier of puppies to Chews A Puppy. • Chews Adoption, their nonprofit rescue was formed in 2018, dissolved and reinstated twice in 3 years. There are no filings with the Florida Department of Agriculture and Consumer Services showing financial status of this non profit charity and Sunbiz shows principal place of registered agent, Crystal Grastara, at 502 Stoneybrook West, ste 104. That is the Stoneybrook Mail Center. • Chews A Puppy has ignored the BBB complaints, Mr. Grastara stating at the last Commission meeting they rather deal face to face with customers. Each BBB complaints state the customer did attempt to deal with the store and were not helped. Not only is this Ordinance bad policy, but it would also allow a dishonest cruel business to remain in Ocoee. The proposed ordinance requires the business .Chews a --.Puppy to post a conspicuous notice as to where a -customer may file'a complaint with the City, Orange County Animal Services and- the Consumer Protection Division. of the Attorney General regarding unfair ; or deceptive trade practices. Absent is any requirement fora nbtice'.about filing a report with the -Department of Agriculture regarding the statutes and regulations about.the transport of animals"for sale into the State of Florida, or,with the Better Business Bureau. In fact, complaints have already been filed against this,business with the Better Business J Bureau and the Department of Agriculture. The City needs to conduct -due,diligence in investigating these existing complaints before granting such a sweeping exemption. At the -last hearing,,Chews a Puppy represented that it does not respond to complaints 'filed with entities such as the Better Business .Bureau, preferring to deal directly with the customers. The Better Business Bureau has seventeen ,unresolved complaints. on file'. In each -case the complainant first attempted to resolve the issue directly,with Chews a Puppy. These complaints included: • issues with sick animals • unpaid vet bills covered by the guarantees • failure to provide the agreed upon breed • oral misrepresentations •.-- failure -to disclose -interest rates and•finance charges before the -sale • administrative fees approaching' 50%.for the return of an animal.: The business has an " F" rating. ' The Department -of 'Agriculture has -also received seven complaints in the -past three. .years. Two of those complaints were referred to other agencies. Before they are granted an exclusive -monopoly on the commercial, sale of dogs and other animals, Chews a Puppy, should respond -'to the City regarding each of the. complaints filed-withthe Better Business Bureau. and the Department of Agriculture, J. including the efforts to resolve the complaint. UPDATE 912912021: The USDA has filed a lawsuit against Daniel Gingerich. Iowa currently has more than 400 active puppy mills with over 17,000 adult breeding dogs trapped. This one state exports tens of thousands of puppies and kittens annually to pet stores across the country, as well as online websites. Iowa was even the first to start the nationwide 'puppy laundering scheme', where puppy mills became licensed rescues to scam the public into thinking they were adopting. In 2020, Iowa Governor Kim Reynolds signed the Community and Pet Protection Act (HF737), which strengthened Iowa's Animal Cruelty and Neglect Code. Good afternoon Mayor and Commissioners, I want to start by thanking you for taking the time to investigate the business practices of Chews a Puppy in Ocoee as you consider a retail pet store ordinance. I've attached documentation from USDA inspectors and Iowa Department of Ag. These are reports we received from Orange County Animal Services as a request while we were contemplating the Orange County Ordinance. As you can see from these records Chews a Puppy was importing from identified inhumane dealers and breeders in the Midwest. One of their Iowa suppliers was cited for dozens of Animal Welfare Act violations, including dead and decomposing dogs on the property, severely emaciated dogs, dog kennels over capacity with no access to clean water or clean food. Please let me know if the records did not transmit properly or if you want to talk to the animal services staff member who researched these transactions and inspections. Chews a Puppy's business model also involves licensed dealers who add a layer of transaction so lines are more challenging to follow back to breeders. I was alarmed by the misleading testimony of Chews a Puppy owners during the last meeting. While the owners insist they vet their breeders, they also boast of selling 6000 puppies from a multitude of breeders. Several of those breeders are known violators as documented by USDA for inhumane conditions and lack of transparency. I heard from many residents about the predatory loan agreements they got tangled up in when they tried purchasing from Chews a Puppy and how they were left with vet bills on top of exorbitant interest rates from their original puppy purchase. The store owners claimed to take a "hands off' approach to the loan process but consumers reported no transparency in pricing and customers who qualified for loans seemed to get different purchase prices depending on their buying power. Hopefully your ordinance will require transparency in pricing for the protecting of consumers. According to the complaint, the defendants falsely claim the puppies for sale are already, or could be, registered with the American Kennel Club and make misrepresentations that puppies come from USDA breeders. The defendants allegedly purchase puppies from breeders for $225 or more per puppy and then sell the puppies from anywhere between $1,500 to more than $9,000. These hefty charges include hundreds of dollars in unwanted additional items through the defendants' required Puppy for a Lifetime Kit and Puppy Training Kit. In many instances, upon consumers discovering the puppies were sick or had died, the defendants allegedly failed to honor warranties related to the puppies and failed to provide appropriate refunds to consumers. The Attorney General's complaint seeks to enjoin defendants from further violations of the Florida Deceptive and Unfair Trade Practices Act, and Section 828.92, Florida Statutes. The filing also seeks an order requiring the defendants to provide restitution and reimbursements to consumers. r USDA Oversight Limitations • 2,000+ commercial dog breeding businesses licensed by the USDA. Only 100 inspectors • The Animal Welfare Act (AWA), a federal law enacted in 1966, requires commercial breeders to comply with minimal animal -care standards that, in reality, are little more than standards of survival. [ECF No. 2-4 ¶ 8]..APHIS inspectors have reported dogs with severe skin conditions, lesions, and matted hair. [ECF No. 2-16 at 2-5]. They have found dogs that are emaciated, [ECF No. 2-14 at 2-3], in "severe heat stress;' [ECF No. 2-17 at 2], and non- responsive, [ECF No. 2-15 at 21. The food and water provided to the dogs at Defendant's facilities, appear to be no better than the medical care they receive. Federal regulations require that the dogs receive food that is "wholesome, palatable, and free from contamination and of sufficient quantity and nutritive value to maintain all animals in good health." 9 C.F.R. § 3.129(a). Food must be stored "so as to minimize contamination by excreta and pests, and protected from rain and snow." Id. § 3.9(b). Water is likewise required to be "potable" and "continuously available to the dogs unless restricted by the attending veterinarian." Id. § 3.10(a). In the last six months alone, he has amassed at least 100 violations of the Animal Welfare Act at approved and unapproved facilities in Iowa. During one recent inspection, APHIS inspectors observed a severely emaciated golden retriever, several dogs with untreated and painful eye conditions, and a non -responsive puppy that died moments later. In September, the USDA determined that Gingerich is placing the health of the dogs in serious danger, in violation of the Animal Welfare Act, and its regulations and standards. The court agreed with the government's assessment, describing the medical care the dogs receive as "shockingly inadequate" and the food and water at the facilities as "no better." The court also held that once the United States makes a proper showing that the animals are in serious danger, injunctive relief is mandated by AWA.
