The subject property is located at 1910 Shari Lynn Terrace and is within the R-1 Single-Family Dwelling zoning district. Per Table 5-2 of the Land Development Code (LDC), the minimum zoning descriptions for development within the R-1 zoning district are as follows: Lot Size Front Side Rear Lot Max Maximum Max Minimum Setback Setback Setback Width Building Impervious Building Living Coverage Height Area 7,000 SF 25 FT 7.5 FT 25 FT 70 FT 40% 50% 35 FT 1,000 SF Section 5-6B states that accessory structures for the housing of persons, such as guest houses and garage apartments, shall not be located in any required yard. The required minimum rear yard setback is 25 feet, and the existing accessory structure that is proposed to be converted to an accessory dwelling is approximately 10.5 feet from the rear property line. Therefore, the applicant is requesting a rear setback reduction from the minimum 25 feet to 10 feet. According to Chapter 4-9 A., the variance application/applicant must demonstrate: (1) That special conditions and circumstances exist which are peculiar to the land, structures, or required subdivision improvements involved and which are not applicable to other lands, structures, or required subdivision improvements. Applicant Response: There is an existing structure previously permitted as a workshop located in the southwest corner of the property. Due to the location of the structure and the current costs of construction, 1 the applicant desires to repurpose the existing workshop into an in-law suite in lieu of removing the structure in order to complete an addition to the home. Staff Analysis: The existing structure is approximately 11.5 feet from the house; therefore, staff concurs with the applicant's statement that the existing structure is located too close to the house to allow sufficient space to accommodate a home addition while still meeting the requirement for a minimum 5-foot separation between structures on a lot. (2) That a literal interpretation of the provisions of these regulations would deprive the applicant of rights commonly enjoyed by other properties with similar conditions. Applicant Response: The structure meets the side yard setback requirements; however, a portion of the structure is located within the rear setback requirement for habitable space. Staff Analysis: The installation of accessory structures, such as sheds, guest houses, pools, etc., are rights commonly enjoyed by other properties within the City so long as they meet setbacks and do not exceed maximum impervious surface area. Since the accessory structure was built in 1999, staff finds that the literal application of Section 5-6.B would create a hardship for the property owners and deprive them of these commonly enjoyed rights. (3) That the special conditions and circumstances do not result from the actions of the applicant. Applicant Response: There are no special conditions or circumstances resulting from the current property owners/applicant as the structure was permitted and constructed prior to purchase of the property (shed completed in May 21, 1999). Staff Analysis: Staff concurs with the applicant. (4) That the granting of the variance requested will not confer on the applicant any special privilege that is denied by these regulations to other lands, structures, or required subdivision improvements under similar conditions. Applicant Response: Granting of this variance will not confer any special privileges on the owner as other homes in the community have similar structures and/or additions allowing for habitable space to be added to the existing homes. Staff Analysis: Staff concurs that the granting of this variance does not confer special privileges to the applicant that is denied by these regulations on other lands under similar conditions. Issue: Should the Honorable Mayor and City Commission approve one (1) variance as follows: 1) Minimum rear building setback reduction from 25 feet to 10 feet to allow for the conversion of an existing shed into an accessory structure for the housing of persons? 2 Planning and Zoning Commission Recommendation: The Planning and Zoning Commission (P&Z) reviewed the proposed variance and discussed the need for the variance, how the variance request met the criteria and whether approval of this 15-ft setback reduction variance would apply to just this structure or across the entire rear yard. Staff explained that the variance would only apply to this shed structure. Staff further explained that, in addition to the variance approval criteria, consideration was given to the use of the adjacent property in the rear as a retention pond tract, and thus the proposed conversion of this shed to a habitable space would not adversely impact any rear neighbors. Staff also explained that allowing the conversion of the shed to an accessory structure would increase housing choice and allow family members to live with or near each other. Lastly, staff explained that approval of this variance does not confer any special privileges to this applicant that is otherwise denied on other lands under these regulations. No citizens spoke for or against the request. The Planning and Zoning Commission voted unanimously to recommend approval of the variance request. Staff Recommendations: Based on the findings stated above and the requirements of Article IV, Section 4-9, staff finds that the variance is needed and justified and supports the variance request as proposed. Staff recommends that the City Commission approve a variance from Section 5-6B to grant a minimum rear building setback reduction from 25 feet to 10 feet for the Cataldo project located at 1910 Shari Lynn Terrace, assigned parcel identification number 08-22-28-7960- 00-390, to allow for the conversion of an existing shed into an accessory structure for the housing of persons.
