Minutes of the Planning and Zoning Commission Meeting held on June 12, 2007 MINUTES OF THE PLANNING AND ZONING COMMISSION ACTING AS THE LOCAL PLANNING AGENCY MEETING HELD TUESDAY, JUNE 12, 2007 CALL TO ORDER Chairman West called the meeting to order at 7:01 p.m. Following a moment of silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared present. PRESENT: Chairman West, Members Campbell, Morris, Rhodus, and Sills. Also present were City Attorney Palmer, Community Development Director Wagner, Senior Planner Howell, Principal Planner Fabre, Principal Planner Rumer and Recording Clerk Moseley. ABSENT: Vice Chair Golden (excused), Members Conkling (excused), Dillard (unexcused), and McKey (excused). CONSENT AGENDA Minutes of the Planning and Zoning Commission Regular Meeting held on Tuesday, May 8, 2007. Member Sills, seconded by Member Rhodus, moved to accept the Minutes of the May 8 2007 Planning and Zoning Commission meeting. Motion carried unanimously. OLD BUSINESS None NEW BUSINESS GLAD TIDINGS ASSEMBLY OF GOD CHURCH — SPECIAL EXCEPTION AMENDMENT Principal Planner Fabre stated the subject property #2-06-SE-008 is located on the north side of Fuller's Cross Road, approximately 750 feet east of Ocoee - Apopka Road. The future land use is residential, single-family low -density, and the zoning is R-1A; both of which allow for church use. There is an existing church right now that is approximately 1200 square feet and has parking. The retention area was built in anticipation of their expansion to the rear. The applicant was given preliminary and final approval for building the church and the associated uses and infrastructure. Subsequently, they bought a parcel that is required to have a special exception use permit obtained, prior to the final site plan submittal. It is his understanding that they are ready to submit for Phase 2; at the same time, they can get a preliminary site plan on the ultimate build out. Planning and Zoning Commission Regular Meeting June 12, 2007 Principal Planner Fabre showed the boundary survey of the property and additional land and right-of-way. He also showed a depicted color graph of the phases. The second phases consists of a two-story 34,000 square feet (footprint 20,000 square feet) school and office building addition expanding the rear of the existing church structure. This phase will include a 5,380 square feet play area for children and associated additional parking. For Phase 3, the plan illustrates a 5,000 square foot office building addition expanding the front of the existing church structure. The ultimate build -out (Phase 4) will consist of a 26,000 square foot church sanctuary addition expanding to the east on the acquired land. It was agreed that the traffic impact study would be completed during the Phase 2 of the construction. He announced that a copy of the preliminary site plan was included in the packets for review. DEVELOPMENT REVIEW COMMITTEE The Development Review Committee (DRC) met on May 29, 2007, and reviewed the Special Exception application and Preliminary Site Plan. There were several minor technical issues to be addressed from the City Attorney's Office and Planning Division that were identified in written staff comments and presented verbally. All of the issues were discussed and a few minor changes to the plans were agreed upon. When the discussion was finished, the DRC voted unanimously to recommend approval of the Special Exception for Glad Tidings Assembly of God Church, subject to the applicant making changes specified in the reports. These changes were made and shown on the plans date stamped received June 4, 2007. However, three items were not properly addressed; the following items are: 1. Revising Condition of Approval #5 to actually reflect the agreed upon language outlined in the staff review comments (Planning Division dated May 29, 2007) "Left turning lanes at each project entrance shall be provided based on the Phase 2 traffic analysis at the sole cost of the developer." 2. The additional road right-of-way should be labeled Tract "A" and "B" accordingly as referenced on Condition of Approval #2. 3. Indicate total square footage for Phase 2 (20,000 square feet footprint + 14,000 square feet for 2nd floor) 34,000 square feet. STAFF RECOMMENDATION Staff recommends that the Planning and Zoning Commission recommend approval of the Glad Tidings Assembly of God Church/Special Exception and the 2 Planning and Zoning Commission Regular Meeting June 12, 2007 Preliminary Site Plan for Special Exception subject to incorporating the three items mentioned above before the City Commission meeting. DISCUSSION Chairman West asked why it had to be a special exception. Principal Planner Fabre said daycares and churches require special exceptions and they had it on the original church, but now that the land has changed they need another one. The Public Hearing was opened for the Glad Tidings Assembly of God Church/Special Exception. Clinton Howell, Executive Pastor of Glad Tidings, 2009 Fuller's Cross Road, said he was here tonight with his contractor, engineer, and a member in case the board had any questions. He stated his appreciation for the board hearing his case. The Public hearing was closed. Member Campbell said it looked like a nice program. He asked if the plans would have to come back before the board again. Principal Planner Fabre said Phase 2 will bring plans back to the board and the City Commission meeting. The office portion of it could be handled administratively. Member Morris, seconded by Member Sills, moved to approve the Glad Tidings Assembly of God Church Special Exception and Preliminary Site Plan for Special Exception, Protect 02-06-SE-008. Motion carried unanimously. THOMAS PROPERTY — ANNEXATION AND REZONING Principal Planner Rumer stated the subject property is located on the east side of Lauren Beth Avenue, 600 feet south of the intersection of Clarcona Ocoee Road and Lauren Beth Avenue. The existing land use designation contains low - density residential (allowing up to 4 dwelling units per acre) and some conservation (covering some wetlands and 100 year flood area). He showed an aerial photo of the vacant property and explained that it is currently zoned agricultural in Orange County. The applicant intends to construct one single- family home at this time. The property meets the intent and the conditions of the JPA and Florida Statutes for voluntary annexation. 3 Planning and Zoning Commission Regular Meeting June 12, 2007 DEVELOPMENT REVIEW COMMITTEE On June 4, 2007, the Development Review Committee (DRC) met to determine if the proposed annexation was consistent with the City's regulations and policies. Based on the above analysis and subsequent discussions, the DRC recommend approval of the annexation and rezoning of the Thomas Property parcel as presented. STAFF RECOMMENDATION Based on the recommendation of the DRC, Staff respectfully recommends that the Planning and Zoning Commission recommend approval of annexation and rezoning to City of Ocoee "A-1" DISCUSSION Chairman West inquired if the applicant would be building the house in the back of the property and if the right-of-way was on south side. Principal Planner Rumer answered he could build where ever those wetlands would afford him and said there was enough land for a right-of-way. Chairman West asked if they get water and sewer from the City for this. Principal Planner Rumer said they have not requested that at this time, but it is nearby if they did want to hook onto it in the future. He said they are permitted to use a well and septic on property this large; however, if they do subdivide the property they will need to hook up with the City. Principal Planner Rumer said the small cut-out on the photo was in Orange County and would remain the same. The Public Hearing was opened for the Thomas Property Annexation and Rezoning. Dan Blankenship, 2201 Lauren Beth Avenue, said his property was connected to the north of the subject property. He asked why they are rezoning A-1 to A-1 and on the some City paperwork it says R-1A. Principal Planner Rumer said preliminarily the applicant requested R-1A because that is what they originally required. After review they found that R-1A allows them to build 10 homes on the property. Since then, they have revised it to A-1 from Orange County to bring it into Ocoee as A-1. He said that imposes 1 unit per acre and clarified it is just a change because it is from the county to the city. The Public Hearing was closed for the Thomas Property Annexation and Rezoning. Planning and Zoning Commission Regular Meeting June 12, 2007 Member Campbell, seconded by Member Morris, moved to recommend approval of the Thomas Property Annexation of ±18.698 acres of land and to rezone that to A-1 General Agriculture. Motion carried unanimously. OAK LEVEL HEIGHTS — ANNEXATION AND REZONING Principal Planner Rumer stated the subject properties were located on the south side of Clarcona Ocoee Road, at the southwest corner of the intersection of Clarcona Ocoee Road and Angola Street; it is directly across from the Golf Course. The current land use designation is low -density residential and the subject site consists of lots 3, 4, and 5. The existing zoning is Orange County A-1 and the applicant is proposing to annex and rezone to R-1, whereas the R-1 is currently to the east. Principal Planner Rumer said the staff reports given out include the history of the case. The property is able to ask for voluntary annexation and is contiguous to the City of Ocoee because we have the golf course to the north. It meets all other JPA and Florida Statute requirements. The applicant is seeking to connect to City water, which is available; however, City sewer is not currently available. DEVELOPMENT REVIEW COMMITTEE The Development Review Committee (DRC) met on June 4, 2007, to determine if the proposed annexation was consistent with the City's regulations and policies. Based on the above analysis and subsequent discussion, the DRC recommended approval of the annexation and rezoning of the Oak Level Heights parcels as presented. STAFF RECOMMENDATION Based on the above analysis and the subsequent DRC recommendation, Staff recommends that the Planning & Zoning Commission, acting as the Local Planning Agency, recommend approval of the annexation of the .60 ±acres of land known as the Oak Level Heights, and rezoning to R-1 single-family dwelling, subject to the applicant entering into an annexation agreement which would waive the provisions of Section 5-10 (B) of the Land Development Code. DISCUSSION Principal Planner Rumer stated the non -conforming convenient store was taken out of the annexation. It will have to enter into an agreement to receive water and will annex in once the City asks them to. Member Campbell asked if this was three small plots for three small houses. Principal Planner Rumer said they would be on three platted lots and people E Planning and Zoning Commission Regular Meeting June 12, 2007 who are not contiguous have been coming to us regularly to get annexed into the City. The Public Hearing was opened for Oak Level Heights Annexation and Rezoning. George Laman, 1137 E. Plant Street, said he owns one of the lots and is representing two of them. He said that nobody he has talked to in Orange County can figure out why this subdivision of such small lots on such a small parcel is zoned A-1. The main reason he is trying to come into the City of Ocoee is because he realizes the convenient store is on a well, which is too close to him to maintain the required 75 ft. for his septic tank system. However, he can maintain 50 ft. by Florida Law with a variance. He didn't want a septic tank within 50 ft. of a well of a store that sells food. He thought he could annex into the City and obtain water for himself and then also for the convenient store next door so that they could eventually hook up to the City as well. Member Sills wished they could have gotten the store in, rather than leaving them an enclave, but he understands. Member Morris asked what the non -conforming use was. Principal Planner Rumer said the land use is low -density residential, but the zoning is agricultural. They would have had to rezone it to C-2, which would require a land use change. Martha Talia, 5144 Angola Street, asked for clarification of some rumors she has heard that apartments would be built on the subject property. Chairman West said it was single-family homes and no apartments or duplexes. Mr. Laman assured her that the three homes planned are 1531 square feet. The Public Hearing was closed for Oak Level Heights. Member Morris, seconded by Member Rhodus, moved that the Planning and Zoning Commission recommend approval of the Oak Level Heights Annexation and Rezoning, Protect AX-04-07-06 and RZ-07-04-07. Motion carried unanimously. PIONEER KEY REGIONAL POND — ANNEXATION AND REZONING Principal Planner Rumer said the City of Ocoee is the applicant on this case. He said the subject property is located west of Ocoee Apopka Road and north of Palm Drive. He showed an aerial photo of the property and pointed to a portion that the City currently owns, while the adjacent piece is in unincorporated Orange County. There is a regional stormwater pond on that piece of property and it 6 Planning and Zoning Commission Regular Meeting June 12, 2007 made more sense to annex it into the City. The future land use designation is commercial, but will be a regional stormwater pond and that is the only development proposed with the City. The property is contiguous on the east and south so they can do this voluntary annexation. There will be parking available to the south and a trail that leads to it for walkers. DEVELOPMENT REVIEW COMMITTEE The Development Review Committee (DRC) met on June 4, 2007, to determine if the proposed annexation was consistent with the City's regulations and policies. Based on the above analysis and subsequent discussions, the DRC recommended approval of the annexation and rezoning of the Pioneer Key Regional Stormwater Pond parcel as presented. STAFF RECOMMENDATION Based on the above analysis and subsequent DRC recommendation, Staff recommends that the Planning & Zoning Commission, acting as the Local Planning Agency, recommend approval of the annexation of the 4.752 ± acres of land known as the Pioneer Key Regional Stormwater Pond parcel, and rezoning to C-2 Community Commercial. DISCUSSION Chairman West asked about the piece of property due south and what that would be. Principal Planner Rumer said that would be a parking area with a path leading around it. Chairman West inquired about the trail and where that would play in to this area. Principal Planner Fabre stated that they are working with some of the property owners over there regarding the trail, but they are not there yet. The Public Hearing was opened for the Pioneer Key Regional Stormwater Pond. As there was nobody wishing to speak, the Public Hearing was closed. Member Campbell, seconded by Member Sills, moved to recommend approval of the Annexation of 4.75± acres of land known as Pioneer Key Regional Stormwater Pond, and rezoning of that plat to C-2 Community Commercial. Motion carried unanimously. Antonio Fabre, AICP, Principal Planner THROUGH: Russ Wagner, AICP, Community Development Director P/1 SUBJECT: Fountains West PUD Preliminary / Final Subdivision Plan Preliminary / Final Site Plan for Lot 6 Project # LS-2006-009 ISSUE: Should the Planning & Zoning Commission recommend approval of the Preliminary/Final Subdivision Plan and Preliminary/Final Site Plan (Lot 6) for Fountains West PUD? BACKGROUND: Fountains West PUD property is located on the northeast corner of the intersection of West Road and Ocoee -Apopka Road. The property encompasses approximately 43.03 acres of land of which approximately 4.73 acres will be designated as wetland/conservation to be dedicated to the City. Additionally as part of the onsite wetland mitigation, 1.1 acre will be dedicated to the City as a Public Trail (Tract G). The subject property is currently undeveloped and sparsely covered with a small mixture of sand pine, scrub and laurel oak trees and other varieties of trees scattered around the property. Moreover, most of the property was a former citrus grove that is now cleared. The Future Land Use designation is Commercial, Low Density Residential, Light Industrial and Conservation/Floodplains. Existing land use to the north is a water treatment facility (the City of Winter Garden treatment plant), zoned A-1; to the east across Ocoee -Apopka Road is the Vineyards and Westyn Bay both of which are single-family residential subdivisions, zoned R1- AA; to the west is vacant treed land zoned 1-1; and to the southwest across West Road is vacant land zoned C-2 in the City limits and to the southeast is residential land zoned agricultural located on unincorporated Orange County. The City Commission reviewed and approved the PUD Land Use Plan for Fountains West as presented on December 19, 2006. The submitted Preliminary/Final Subdivision Plan and the Preliminary/Final Site Plan for Lot 6 are consistent with the approved PUD Land Use Plan and the conditions set forth on the PUD Development Agreement. The Planning and Zoning Commission July 10, 2007 Page 2 of 3 DISCUSSION: The Preliminary/Final Subdivision Plan is proposed to be an eight (8) commercial lot subdivision of which one lot is designated as a supermarket shopping center (Lot 6-Publix Supermarket) and another as a large church facility (Lot 8-Living Waters Church). The permitted uses are indicated on a development matrix chart on sheet C-010 of the site plan. Essentially, lots 1 thru 3 were the most restricted due to the close proximity with the residential subdivision across the street. The proposed Subdivision Plan proposes four (4) outparcels along Ocoee -Apopka Road. The "Plans" also incorporates the Preliminary/Final Site Plan for Lot 6 (Publix Supermarket). The shopping center supermarket will be setback on an internal centralized location fronting on West Road. On -site water retention is proposed via a master stormwater pond (Tract B) for lots 1-7. Additionally, there will be a water feature with an environmental enhancement for the remnant wetland (Tract F) on the northeast corner of the newly created intersection of West Road and Ocoee -Apopka Road. The Fountains West project is proposed to preserve natural wetlands, provide for public trails, provide right-of-way dedication along Ocoee -Apopka Road, and enable realignment of West Road via a tri-party (City of Ocoee, Orange County, & Fountains West developers) development agreement. When the subdivision is completed, the intersection of West Road and Ocoee -Apopka Road will be realigned and improved with a traffic signal plus corresponding turn lanes. The detached West Road section will eventually be vacated and incorporated into adjoining parcels. This proposed roadway realignment and intersection improvements were identified in the City of Ocoee Comprehensive Plan adopted October 1, 2002. More specifically, the improvements were illustrated as part of the Roadway Improvement Master Plan for 2020 (Figure 11) in the Transportation Element of the Comprehensive Plan. The ultimate goal is to provide a new intersection that is properly aligned with the existing Ocoee Crown Point Parkway in order to facilitate traffic and reduce congestion to this area. Furthermore, the developer/owner is dedicating 30 feet wide of right-of-way (Tract D) along Ocoee -Apopka Road. This will result in a 120 feet wide right-of-way along the entire Ocoee - Apopka Road section adjacent to the site for any future roadway improvements. As shown on the plans, Road "A" will be dedicated to the City with corresponding roadway improvements and stormwater abatement. Left and right turn lanes will be provided at all site access points based upon the results of the traffic impact analysis. Water and sewer will be provided by Orange County. Reuse water will be eventually supplied by the City of Ocoee. Tract 1 is essentially a remnant of an original parent parcel of land for this project. Tract 1 will remain with its original 1-1 zoning but will be subject to the Conditions of Approval outlined on the Land Use Plan and Development Agreement. There was an issue with the coordination of the permanent realignment of West Road and the actual construction of the site permanent operational turnlanes. Staff and the Developer have agreed to resolve this issue by a mutually beneficial Development Agreement. The Development Agreement is included with the City Commission packet and should be approved together with the Plans. The agreement essentially allows for the City to design, permit and construct the "West Road Turnlanes", and in turn, the Developer will pay the City the lump sum of $200,000 dollars. The Planning and Zoning Commission July 10, 2007 Page 3 of 3 DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) reviewed the Fountains West PUD on June 28, 2007. There were minor technical issues to be addressed from the City Attorney and Engineering Department that were identified in written staff comments and presented verbally. All of the issues were discussed and all changes to the "Plans" were agreed upon. The applicant proposed some revision changes to the "West Road Turnlanes" Development Agreement. Staff and the developer compromised and collectively agreed upon some of the revision changes. After discussion was completed, the DRC voted unanimously to recommend approval of the Fountains West Preliminary/Final Subdivision Plan and Preliminary/Final Site Plan for Lot 6, subject to the changes discussed being made to the plans (date stamped June 13, 2007) and approval of the "West Road Turnlanes" Development Agreement. STAFF RECOMMENDATION: Based on the recommendation of the DRC, Staff respectfully recommends that the Planning and Zoning Commission recommend approval of Preliminary/Final Subdivision Plan and Preliminary/Final Site Plan for Lot 6, as date stamped received by the City on June 13, 2007, subject to resolving the last remaining issues addressed in the attached City Attorney's review memorandum and the Engineering Department review memorandum prior to the Pre - Construction Meeting for the project; and further, subject to approval of the "West Road Turnlanes" Development Agreement. If you have any questions pertaining to the requested information, please contact our office. L-16. Resolved 17. (Repeat Comment) Pond Sections A -A and B-B indicate slopes steeper than 5:1. The City of Ocoee Land Development Code does not allow slopes steeper than 5:1. Also indicate the slope from the top of bank to the retaining wall. A 10 foot maintenance berm around the pond is required. A 5:1 side slope is required in the pond area as well as leading to the pond maintenance berm. If this is not possible the use of structured walls and/or railing may be required for safety. Please indicate how the slopes will be stabilized with a detail. There was also discussion in the TSRC that indicated a geomat would be used to stabilize the 2:1 slopes. Be advised that sheet C301 was missing in the latest submitted set. 18. (Repeat Comment) Please add the City of Ocoee water details to the plan set. These details will apply to the reclaimed water system. Contact the City of Ocoee Engineering Department to receive the City Details in AutoCAD format. Please contact Ryan Howard in the Engineering Department for the latest City details to be emailed in CAD format. Remove the cul-de-sac and the water main thrust collar details. Add the restraint table and locating wire details. Modify the PVC pipe locating detail to reference all pipe instead of PVC pipe. This includes changing the title. 19.-25. Resolved 26. (Repeat Comment) A copy of SJRWMD, Orange County Utilities, and Orange County Public Works permits will be required before final approval will be issued. A meeting with Orange County on June 8th indicated that the current turn lane on Ocoee -Apopka Road as shown on the plans does not meet the Orange County Public Works requirements. Orange County stated that the Ocoee -Apopka Road turn lane is required to have a 200 foot que with an 85 foot taper section. 27.-30. Response letter from VHB dated June 12, 2007; 2. Owner's Affidavit signed by Thomas Crociata, First Vice President of SunTrust Bank; 3. Draft Conservation Easement in favor of SJRWMD (the "SJRWMD Conservation Easement"); 4. Fountain West Lot 7 Peak Runoff Discharge Calculations; 5. Recorded Master Easement Agreement (Book 8548, Page 2643) (the "Recorded Master Easement Agreement"); 6. Recorded Declaration of Covenants, Operations & Reciprocal Easements (Book 8574, Page 0127) (the "Recorded Declaration"); 7. Preliminary/Final Subdivision Plan for Fountains West PUD and Preliminary/Final Site Plan for Lot 6 prepared by VHB (the "Plan"). This memorandum supersedes our previous memoranda dated January 31, 2007, April 24, 2007 and May 31, 2007. Based upon our review of the documents noted above and pursuant to the Land Development Code, we have the following comments: ORLA_448037.2 FOLEY FOLEY S LARDNER LLP I. COMMENTS DIRECTED TO CITY STAFF The following comments are addressed to and/or request direction from City Staff and, unless otherwise noted, do not require any response from the Applicant. These comments should be discussed as TSRC so that the Applicant and City Attorney are fully advised regarding City Staffs direction. None. II. REPEAT COMMENTS The following comments were included in the City Attorney's prior memoranda regarding the Plan, however, they were not fully addressed as part of the Applicant's current submittal. The following comments may also relate to prior comments provided by other City Departments that were not fully addressed as part of the Applicant's current submittal. 2. [Revised Comment] COA No. 29 on Sheet C-009 of the Plan requires that the Developer provide a draft Master Easement Agreement to the City for review with the Plan. We consider the previous submittals to satisfy the requirement for a draft document and have provided our comments with respect thereto. This will need to be finalized and agreed upon prior to Plat approval. 3. [Revised Comment]. COA 67 is inconsistent with our previous comment. Revise the first sentence by deleting the words "mutually" and "and the Developer" so that the first sentence will read as follows: "A Master Easement Agreement acceptable to the City will be recorded in connection with the platting of the Property." 4. [Revised Comment]. COA 68 is inconsistent with our previous comment. Revise the first sentence by adding the word "northern" so that the sentence will read as follows: "The Developer will design, engineer, permit and construct a 12" reuse line extension from the northern boundary of the property to ....." 5. [Revised Comment] Per the response letter, please provide updated title prior to the City Commission meeting. 6. [Revised Comment] An Agreement will be required addressing the design, permitting and construction of the West Road turnlane improvements. This Agreement must be approved contemporaneous with the P/FSP approval. NEW COMMENTS IN RESPONSE TO THIRD SUBMITTAL The following comments are based on changes made to the Plan since the Applicant's first submittal or relate to new information or documents that have been provided since Applicant's prior submittals. 7. ORLA_448037.2 FOUNTAINS WEST: OUTLINE OF PROPOSED RESOLUTION OF WEST ROAD TURN LANE ISSUES City agrees, at the City's expense, to design, permit and construct "West Road Turnlanes". At option of City, turnlane construction may occur after completion of County West Road Realignment Project or be incorporated into the County project. 2. Developer will pay the City the sum of $200,000 by the earlier of (i) the holding of the preconstruction meeting for the subdivision improvements, or (ii) 10 days after FSP approval. The payment constitutes the Developer contribution towards the West Road Turnlanes. No road impact fee credits are provided in connection with this contribution. 3. VHB to certify to the City that the design for the Developer's Project as shown on the FSP meets the grades and elevations proposed by the County for the West Road realignment based on the Clarcona-Ocoee Road 100% Submittal, dated September 7, 2001, County Project #CIP 3038 West, as prepared by Inwood Consulting Engineers (the "County's West Road Plans"). The City assumes no obligations with respect thereto in the event of a conflict between the FSP and the County's West Road Plans. Subject to receipt of such certification, the Developer will not be required to modify the FSP sheets dealing with the West Road Turnlanes. 4. Developer is required to construct all improvements adjacent to West Road which are within the boundaries of the Developer's Property as shown on the FSP. 5. Developer is required to construct the sidewalks located within West Road as shown on the FSP and to obtain the necessary permits from the County to do so. Developer will need to coordinate timing of such construction with the County and its contractor. These sidewalks are not part of the West Road Turnlanes to be constructed by the City. The City has determined that there is no conflict between the sidewalk plans shown on the FSP and the County's West Road Plans. If the Developer gets the County to agree to relocate and construct, at no cost to the City, the sidewalks that the County has proposed from the location that the County currently depicts on the County's West Road Plans, to the location preferred by the City, for which the Developer is obligated to construct, then the Developer will not be required to construct such sidewalks. 6. Developer will not be required to construct West Road Turnlane improvements shown on FSP (either the temporary or permanent turnlanes); provided, however, that the Developer will be required to design and construct its on -site improvements so as to meet the appropriate elevations shown in the County's West Road Plans. 7. Given the construction of the Permanent Realignment Improvements by the County and the West Road Turnlanes by the City, the completion of such improvements will not be a condition to the issuance by the City of building permits, certificates of completion or certificates of occupancy for the Fountains West Project. 8. City has elected not to design, permit, and construct the Temporary Realignment Improvements as set forth in the West Road Realignment Agreement. City and ORLA 455999.3 6/29/07 Developer will acknowledge that the Permanent Realignment Improvements will be constructed in lieu thereof. 9. The foregoing will be documented in an agreement between the City and Developer to be approved contemporaneous with the FSP. In the event of any conflict between the FSP and such Agreement, then such Agreement shall control. 10.
