Background Summary:
The applicant/property owner of Lot 2 of the Blackwood at Ocoee Commons, which was a Replat of Lot D1
of the Ocoee Commons Planned Unit Development (PUD), is requesting an amendment to the Ocoee
Commons PUD to amend Condition # 43 in the Conditions of Approval to allow a commercial lot to be less
than one (1) acre in size if the lot is served by a master stormwater pond. The Blackwood at Ocoee Commons
Replat divided Lot D1 into Lot 1 and Lot 2. Lot 1 was developed for restaurant use (Texas Roadhouse), and
Lot 2 is currently vacant. The property owner of Lot 2 (which contains 1.96 acres) seeks to split Lot 2 into a
future Parcel A with 1.15 acres (for a dental office) and Parcel B with 0.81 acres (for a future medical office).
Condition # 43 states that "all commercial lots will be a minimum of one acre in size." The applicant is
specifically requesting an amendment to Condition # 43 to read as follows:
"All commercial lots will be a minimum of one acre in size, unless the lot is served by a master stormwater
facility."
Staff supports the request based on the following findings.
1) Drainage. The Ocoee Commons PUD was approved to have a variety of uses, including single-family
residential, multi -family residential, commercial, office, and retail uses, as well as public infrastructure
and a master stormwater facility. Based on a review of drainage plans, Lot D1 was approved for 3.04
acres of impervious surface area (ISA) to be accommodated by the master stormwater facility. The
restaurant on Lot 1 utilized 1.46 acres of ISA, leaving Lot 2 with 1.58 acres of ISA to use. That portion
of Bentridge Street that is located on Lot 2 utilizes 0.2 acres of ISA, leaving 1.38 acres of ISA remaining
for Lot 2. The proposed dental office in the Future Parcel A of Lot 2 is currently undergoing site plan
review and proposes to utilize .71 acres (representing 62% ISA for Parcel A), leaving the Future Parcel
B with 0.67 acres of ISA to develop without the need for additional drainage capacity.
2) Public Improvements Not -previously Contemplated. The City is currently reviewing preliminary
designs for the North Blackwood Avenue Streetscape project, which includes a round -about at the
intersection of Blackwood Avenue and Montgomery Avenue. The southeast portion of the round -about
will clip the northwest corner of the Future Parcel A (dental office site) by approximately 4,887 SF
(0.11 acres), thus reducing the overall Lot 2 land area and impacting the dental office site plan in a
manner that results in an eastward shift of the parking area and a Future Parcel B size that is less
than the minimum one (1) acre requirement of the PUD.
3) Consistency with Section 4-5D. Section 4-5D establishes criteria for determining whether an
amendment is considered substantial. To summarize,
(i) Intensity: The Ocoee Commons PUD was approved for 131,500 SF commercial uses. To date,
approximately 117,987 SF of commercial and office uses have been developed, leaving a
remainder of 13,500 SF of development potential. The proposed dental office proposes 5,917 SF,
which would leave a balance of 7,500 SF for the Future Parcel B. The requested Amendment is
not seeking additional square footage and, thus, will not increase the land -use intensity without a
corresponding decrease in some other portion of the PUD.
(ii) Permitted Uses and Phasing: The requested Amendment will not 1) change the list of permitted
uses, 2) change a use type adjacent to a property boundary, or 3) affect the phasing plan of the
PUD.
(iii) Conditions of Approval: Although the request is to amend Condition # 43, Condition # 43 was not
a condition specific to Ocoee Commons as the one -acre minimum lot size is standard for all Office
and Commercial zoning districts in the City in order to ensure that a lot has sufficient land area to
accommodate for drainage and other infrastructure improvements. Since development within the
PUD is served by a master stormwater facility designed for 80% ISA, lots within the PUD can be
of a smaller size without affecting stormwater so long as the total ISA is not exceeded.

The proposed non -substantial Amendment will not adversely impact the surrounding areas or public facilities
and services as it does not affect the total development square footage of the PUD.
Issue:
Should the Honorable Mayor and City Commission confirm the Development Review Committee's approval
of the Non -Substantial Amendment to the Ocoee Commons Planned Unit Development (PUD) to allow a
commercial lot to be less than one (1) acre in size if the lot is served by a master stormwater pond?
Development Review Committee Recommendation:
The Development Review Committee (DRC) met on Tuesday, April 11, 2022, to review the proposed
Amendment to the Ocoee Commons Planned Unit Development (PUD) and determined that the Amendment
is non -substantial and approved the amendment as a non -substantial amendment.
Recommendations:
Based on the findings outlined in this staff report, staff recommends that the Honorable Mayor and City
Commission approve the Non -Substantial Amendment to the Ocoee Commons Planned Unit Development
(PUD) to modify Condition # 43 to read as follows: "All commercial lots will be a minimum of one acre in size
unless the lot is served by a master stormwater facility."
