HomeMy WebLinkAbout03-22-2022 Minutes CITY OF OCOEE Code Enforcement.Board March 22,2022 I.CALL TO ORDER Chair Odom called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida. A. INVOCATION: Member Johnson initiated the moment of silence. B. PLEDGE OF ALLEGIANCE: Member Lewis led the Board in the Pledge of Allegiance to the U.S.flag. C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared a quorum of four(4) present. PRESENT: Chair Odom & Members: Bandur, Lewis, Mann, &Johnson. Also present: Board Attorney Skip Fowler, Assistant Support Services Director Doug Gaines, Code Enforcement Clerk Justin Mieras,and Code Enforcement Officer Rey. ABSENT: Member Mirza & Brennan are unapproved absences. D. SWEARING OF OFFICERS / WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code Enforcement Officers and to anyone intending to speak regarding a case. II.CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BYA MEMBER OF THE BOARD,IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. ORDER OF CONTINUANCE: CASE NO 2021-00969 OFFICER DIAZ 200 FRANKLIN ST TOM WEST INC Continued to April 27, 2022 Member Bandur,seconded by Member Mann,moved that the consent agenda be accepted as presented. Motion carried unanimously. III. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS CASE NO 2022-00036 OFFICER REY 9051 A D MIMS RD BOYER SKAFF Violation Cited: §115-4. Summary: §115-4.—Owners shall control excessive weed or grass growths, as enumerated in § 115-3,on the property and on the portion of the adjoining public right-of-way between the property and the street of each lot. Observation: §115-4.—Grass on Right of Way in Front of Property Uncut and Overgrown. Officer Rey presented the case and gave its history. Officer Rey further explained that as of March 22, 2022,the property is still in non-compliance. The City asked for an Order of Compliance by April 05, 2022, or thereafter to be fined $25.00 per day, until found in compliance. Member Bandur,seconded by Member Mann, moved that in Case#2022-00036, the respondent be found in violation as cited as of February 11,2022, and be given until April 05, 2022, to come into compliance or be fined$25.00 per day, until found in compliance. Motion carried unanimously. CASE NO 2022-00052 OFFICER REY 2705 COVENTRY LN BIEBERLE, DARIUS J PROTO, KAREN ANNE Violation Cited: §165-3.A. & §168-6.B.(1) Summary: §165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property. §168-6.B.(1)—No owner, private property,shall consent to the parking or storing of vehicles on non-improved surfaces of the property. Observation: §165-3.A.—Non-operational,abandoned vehicle parked on driveway. §168-6.B.(1)—Vehicle parked on grass(unimproved surface) in front yard. Officer Rey presented the case and gave its history. Officer Rey further explained that as of March 22,2022,the property is still in non-compliance. The City asked for an Order of Compliance by April 05, 2022, or thereafter to be fined $25.00 per day, per violation, until found in compliance. Member Bandur, seconded by Member Mann, moved that in Case#2022-00052, the respondent be found in violation as cited as of February 17, 2022, and be given until April 05, 2022, to come into compliance or be fined$25.00 per day, per violation, until found in compliance. Motion carried unanimously. IV. CASE RESOLUTION CASE NO 2021-00821 OFFICER LOEFFLER 409 CABALLERO RD WATTERS ROSEMARY M EST Violation Cited: §108-23.I. &J., §108-24.D., &§143-27.A. Summary: §108-23.I. &J.—Every window sash shall be fully supplied with glass window panes or an approved substitute which are without open cracks or holes. Window sashes shall be fully supplied with glass window panes or an approved substitute which are without open cracks or holes §108-24.D.—It shall be unlawful to use a residential property for the storage of any abandoned motor vehicle, ice box, refrigerator, stove,glass, building material, building rubbish or similar items. It shall be the duty every such owner and occupant to keep the premises of residential properties clean and to remove all such abandoned items. §143-27.A. —At non-pickup times, garbage carts shall be placed in side yards or rear yards and screened from view to the extent practicable. Except as provided herein, garbage carts shall at no time be placed in the front yard of the premises. Observation: §108-23.1. &J.—Two (2) Front Glass Windows Visible from Street Broken/Shattered Glass §108-24.D.—Large Pile Of Junk, Debris, Etc.Along Side of Property and Scattered Around §143-27.A.—Waste/Garbage Cans Stored In Prohibited Location Assistant Support Services Director Doug Gaines explained that as of March 22, 2022, the property is still in non- compliance.The City asked for an Order Imposing Fine. Member Bandur, seconded by Member Lewis, moved that in Case#2021-00821, the Board impose fines as of March 10, 2022, as previously set by this Board. Motion carried unanimously. CASE NO 2021-00901 OFFICER REY 2651 CEDAR BLUFF LN NELSON, NAOMI MARGARETTE Violation Cited: §6-4.H.(6)(b). Summary: §6-4.H.(6)(b).—Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it is located behind the front yard building line and screened with a six-foot high opaque fence with gate. Observation: §6-4.H.(6)(b).—Camper trailer parked on property. Officer Rey explained that as of March 22, 2022,the property is in compliance. No further action requested. V.COMMENTS Code Enforcement Clerk Mieras notified the Board that Mr.Shropa has resigned and that Mr. Mirza will be removed from the Board. Assistant Support Services Director Doug Gaines reminded the Board to RSPV for the Volunteer Appreciation Dinner.
