CALL TO ORDER
Vice Chair Cadle called the meeting to order at 5:59 p.m. in the Commission Chambers
at City Hall. Member Colburn led the Invocation and Alt. Member Carrington led the
Pledge of Allegiance to the Flag; the Clerk called roll and declared a quorum.
PRESENT: Vice Chair Cadle, Members Colburn, Alternate Member Carrington and
Alternate Member Carpenter. Also present were City Planner Runner, Assistant City
Attorney Drage, and Deputy City Clerk Sibbitt.
ABSENT: Chairman Wilsen, Members Warren and Wrobel.
APPROVAL OF MINUTES — MARCH 21,2013
Member Colburn, seconcled by Alt. Member Carrinf"ton, ironed to approve the inintiles
of March 21, 2013. Motion carried 4-0.
NEW BUSINESS
STEVENS VARIANCE (913 GROVESMERE LO(LP)
City Planner Rumer presented exhibits and the staff report for the variance request by
applicant, Jeffrey Stevens, for a side street setback variance to encroach 10 feet into the
15 foot setback for the construction of a PVC fence, The lot is a corner parcel that
contains a cul-de-sac beyond the rear yard which makes the lot shape very unique. The
applicant intends to fence in the rear yard to secure an existing pool and to provide
security for household pets.
The subject property is located on lot 57 of the Plantation Grove West plat and has
received Home Owner Association approval.

Based on the existing conditions of the parcel and the unique parcel property lines, staff
does fine the variance requested by Jeffrey Stevens to be Supportable.
DISCUSSION
Jeffrey Stevens (applicant) briefly explained they are just trying to gain as much of their
yard as they can. If they currently -followed the City guidelines it would reduce the edge of
their yard due to the uniqueness of the lot. Mr. Stevens said the variance request is also
to gain privacy for their two dogs, any future children they may have, and the safety of
their pool which is currently screened but exposed to the neighbors,
Vice Chair Cadle inquired if a fenced yard is required for homeowners with swimming
pools. City Planner Rumer advised that pools are required to have a safety mechanism
such as a fence around the perimeter of the pool or some type of alarm from the home to

the pool. He further advised he is not aware if the screen enclosure has to have an alarm
as well, but depending on the year the home was built it may have predated the safety
requirements. Vice Chair Cadle inquired if the fence will match the existing fences in
the subdivision. City Planner Rumer provided exhibits which showed a white PVC fence
that bordered the retention pond and advised that the fence proposed will match what is
adjacent to the property. As well, in residential subdivisions, PVC is considered an
upgraded fence. Vice Chair Cadle, lastly commented, that he read in the staff report
something about palm trees being removed. Jeffrey Stevens (applicant) answered that the
previous owners had planted palm trees which the neighborhood is not very passionate
about, so part of the clause in the HOA approving the fence was that the palm trees would
be removed and replaced with something more appealing.
Alt. Member Carpenter advised that it seems the fence would be going into part of the
utility easement and inquired if a situation was to occur where the City was to bring in
reclaimed water would the fence than become an issue for the City. City Planner Rumer
advised that a fence is not considered a structure and during the building permit process
they are made aware of issues such just as stated,
Member Colburn, seconded by Alt. Member Carrington, moved to recommend to the
01v Commission approval of the Stevens 11'ariance as Presented by staff. Motion carried
4-0.
