Chambers at City Hall. Member Colburn led the Invocation and Member Wrobel led
the Pledge of Allegiance to the Flag; the Clerk called roll and declared a quorum.
PRESENT: Vice Chairman Cadle, Member Colburn, Member Carpenter and Member
Wrobel. Also present were City Planner Ruiner, Planner Jones, City Attorney Cookson,
and Deputy City Clerk Sibbitt.
APPROVAL OF MINUTES — MAY 14,2014
Member Colburn, seconded by Member Ca&penter, moved to oprove the minutes of
Mav 14, 2014. Motion carried 4-0.
NEWLON VARIANCE (304 Log Run Court)
Planner Jones presented exhibits and the staff report for the variance request by
applicant, James Newlon, for a rear yard setback fi-om 25 feet to 17 feet for a proposed
additional living space. The addition will not encroach into the 10 foot drainage easement
located at the rear of the property or affect any of the surrounding properties. There is also
no residential development behind the property.
Staff sent out a 300 foot notice to the surrounding properties and has not received any
correspondence pertaining to this variance.
BACKGROUND
The subject property is located on lot 117 of the Forest Oaks Unit I plat.
RECOMMENDATION
Based on the findings stated in the staff report, staff does find the variance requested by
James Newlon supportable.
Member Colburn inquired if staff knew what was going to happen to the vacant property
going p
behind the applicant's residence and if they knew who owned that property. City Planner
Rumer answered that they have entertained a number of people who have looked at the
property to buy it to someday subdivide it into three lots; however, it still sits vacant. He
further shared that he does not recall who owns the property.

James Newlon, applicant, said that he understands the property behind his home may be
owned by a private owner out in Las Vegas, Nevada and has always been vacant. He
further shared that the only access to that property is from his subdivision through a
narrow road making it a landlocked property which could be a reason it has not been
developed. Mr. Newlon commented that the addition to his home would be a taxable
favor to the City since the new construction addition would tip the value toward the
City's benefit.
Vice Chairman Cadle inquired if the amount of the variance requested could be reduced
by just moving the addition to the other side of the house so it does not encroach onto the
setback. Mr. Newlon explained that it would be awkward because the flow they are
trying to achieve is the living space into the sunroom (Florida room),
Member Colburn, seconded by Member Carpenter, moved to recommend to the Q
Commission approval of the NeiWon Variance based on factual interpretation of the code
requirements, as presented by staff and public testimonv related. Motion carried 4-0.
C. ROGER FREEMAN VARIANCE (UNADDRE SSED S. LAKESHORE DRIVE)
City Planner Rumer presented exhibits and the staff report for the variances requested
by applicant, C. Roger Freeman, for a variance approval of three variances for a proposed,
single-family dwelling unit: i) side -street setback variance fi-om 30 feet to 15 feet on
Magnolia Street, ii) rear yard setback variance from 35 feet to 25 feet, and iii) lot width
variance from 85 feet to 80 feet.
The property will require a septic drain field since there is no sewer in that area. The
intent of the applicant is to build a home that fronts the lake. The minimum living space
in a zoning designation of R-IAA is 1600 sq. ft. which helps to assure that a quality type
home will be built.
BACKGROUND
The subject property is located on Lot 17 and half of Lot 16 of Marion Park plat. The
parcel has been in its final configuration since 1966. The parcel is vacant.
RECOMMENDATION
Based on the findings stated in the staff report, staff does find the variance requested by
C. Roger Freeman supportable.
Member Colburn inquired about the existing home on the side lot. City Planner Ramer
advised that the existing home in questions is on part of Lot 16 and the applicant also
owns that home. Vice Chairman Cadle inquired if there is a restriction as to whether it

has to be a single story house. City Planner Rumer shared there are no restriction;
however, the maximum height is 35 feet in a residential zoning district.
Vice Chairman Cadle opened the public hearing. As no one wished to speak the public
hearinc, was closed.

Member Wrobel, seconded by Member Carpentej° moved to recommend to the City
Commission approval of the of three variances requested by C. RoGer Freeman based on
factual interpretation of the code requirements, as presented by staff, and public
testimony related Motion carried 4-0.
City Planner Rumer briefly updated the board regarding the variances from the previous
regarding
meeting. The Blanks Variance was approved and the Patrick Variance was denied as
recommended by this board.
