The subject property is located at 101 West Silver Star Road and is zoned C-2 (Community Commercial District). Per Table 5-2 of the Land Development Code (LDC), the minimum zoning regulations for development within the C-2 zoning district are as follows: Lot Size Front Setback Side Setback Rear Setback Lot Width Max Building Covera a Maximum Impervious Max Building Height Minimum Living Area 1 AC 25 FT 10 FT 20 FT 150 FT 30% 70% 45 FT N/A The subject property is located in the northwest corner of West Silver Star Road and North Cumberland Avenue and is adjacent to the CSX Transportation railroad right-of-way. In late 2021, the property received site plan approval and permitting for the construction of a one (1) story 6,300 SF office building with 1,200 SF of covered porch area. Construction of the project is currently underway, and CSX Transportation asserts that it owns fifteen (15) feet of the property shown as part of the subject property on the project's boundary survey (prepared in 2017), which was included in the small-scale site plan set. The applicant states that, although it is not clear that the Railroad's understanding of the ROW line location is correct, they were not made aware of this issue until the building foundation and walls were in place. Because of the financial risk of waiting to confirm the railroad ROW location, the applicant is conceding the ROW line as presented by CSX Transportation and proposes to remove the portion of the building in the alleged ROW and an additional three (3) feet buffer (resulting in a loss of 300 SF of office space) in order to allow at least a 3-ft separation of the building from said railroad ROW. Because the proposed 3-ft buffer is less than the minimum 10-ft side yard setback requirement, the applicant is seeking a variance to reduce the side yard setback to 3 feet. According to Chapter 4-9 A., the variance application/applicant must demonstrate: (1) Special conditions and circumstances exist that are peculiar to the land, structures, or required subdivision improvements involved and are not applicable to other lands, structures, or required subdivision improvements. (2) That a literal interpretation of the provisions of these regulations would deprive the applicant of rights commonly enjoyed by other properties with similar conditions. (3) That the special conditions and circumstances do not result from the actions of the applicant. (4) That the granting of the variance requested will not confer on the applicant any special privilege that is denied by these regulations to other lands, structures, or required subdivision improvements under similar conditions. Staff Analysis: The City and applicant relied on a survey prepared in early 2017, which was based on the legal description and bearings per plat. The applicant proceeded to obtain and the City approved, in good faith, a small-scale site plan, site work permit and building permit for the office building, and construction began. It was not until the building construction was underway that the railroad right-of-way boundary line issue arose. Staff finds that there is a unique circumstance existing to the subject property in that CSX Railroad has determined they own additional lands outside what is shown on both the survey and what is depicted on the Orange County Property Appraiser's map. The circumstances of this variance did not result from the actions of the applicant and that the literal interpretation of the minimum side setback at this juncture, post the issuance of a site work permit and building permit, poses a financial risk to the applicant. Lastly, staff does not find that the granting of this variance will confer any special privileges to this applicant that was denied others under similar conditions. Issue: Should the Honorable Mayor and City Commission approve a variance to reduce the minimum side building setback from ten (10) feet to three (3) feet for the VMG Shoppes development, located at 101 W. Silver Star Road and assigned parcel ID number 18-22-28-4100-00-171, to resolve a property line discrepancy with the railroad right-of-way? Planning and Zoning Commission Recommendation: At the time this staff report was prepared, this item had not yet been before the Planning and Zoning Commission for a public hearing. The PZC public hearing is scheduled and advertised for July 12, 2022. Staff Recommendations: Based on the findings stated above and the requirements of Article IV, Section 4-9, staff recommends that the City Commission approves the variance to reduce the minimum side building setback from ten (10) feet to three (3) feet for the VMG Shoppes development, located at 101 W. Silver Star Road and assigned parcel ID number 18- 22-28-4100-00-171, to resolve a property line discrepancy with the railroad right-of-way.
