August 23,2022
I.CALL TO ORDER
Chair Odom called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission Chambers of
City Hall located at 1 N Bluford Ave,Ocoee, Florida.
A. INVOCATION: Member Johnson initiated the moment of silence.
B. PLEDGE OF ALLEGIANCE: Member Mann led the Board in the Pledge of Allegiance to the U.S.flag.
C. ROLL CALL AND DETERMINATION OF QUORUM:Code Enforcement Clerk Mieras performed roll call and declared
a quorum (4) present.
PRESENT: Chair Odom & Members: Bandur, Mann, &Johnson. Member Brennan arrived at 7:02pm.
Also present: Board Attorney Skip Fowler, Assistant Support Services Director Doug Gaines, Code
Enforcement Clerk Justin Mieras, and Code Enforcement Officers Tobe, Loeffler, and Diaz
ABSENT: Member Lewis is an approved absence.
D. SWEARING OF OFFICERS / WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code
Enforcement Officers and to anyone intending to speak regarding a case.
II.CONSENT AGENDA
ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT
BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS
DISCUSSION IS DESIRED BYA MEMBER OF THE BOARD,IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK
TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY.

of the agenda, and then revert to the original agenda with Case#2022-00316 and all subsequent cases. Motion carried
unanimously.
Member Bandur,seconded by Member Mann, moved that the consent agenda be accepted as presented. Motion carried
unanimously.
III. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS
CASE NO 2022-00300
OAJACA RAMIREZ, ROSA
OFFICER LOEFFLER 470 FORT COLLINS CT AMARILIS
IBARRA,ALBERTO
Violation Cited: §51-13.
§51-13.—It shall be a violation to do work related to construction without first obtaining a permit.
Observation:
§51-13.—Construction Without Required Permit(s) Enclosing Rear Patio Screen Room
Officer Loeffler presented the case and gave its history. He further explained that as of August 23, 2022, the property is
still in non-compliance.The City asked for an Order of Compliance by September 22,2022,or thereafter to be fined$50.00
per day until found in compliance.
Respondent Rosa Oajaca explained they had problems finding someone to make the requested drawings to get the permit
approved.She secured someone today and testified that the construction work has stopped since the Code Enforcement
notice.
Member Bandur,seconded by Member Mann, moved that in Case#2022-00300, the respondent be found in violation as
cited as of May 18,2022, and be given until September 26, 2022, to come into compliance or be fined$25.00 per day until
found in compliance. Motion carried unanimously.
CASE NO 2022-00525

Violation Cited: §115-3.A.(3) &§115-3.B.
Summary:
§115-3.A.(3)—No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public
health,safety and welfare.
§115-3.B.—No person shall allow or permit excessive growth,ten inches or more on property owned,of weeds,grass,
undergrowth or other dead or living plant life.
Observation:
§ 115-3.A.(3)—Trash/Debris Throughout the Property.
§ 115-3.B.—Over Grown Grass and Weeds, Not Maintaining Property.
Officer Diaz presented the case and gave its history.She further explained that as of August 23,2022,the property is still
in non-compliance. The City asked for an Order of Compliance by September 06, 2022, or thereafter to be fined $25.00
per day, per violation, until found in compliance.
Respondent Oscar Manzano explained the grass has been cut and the 14 days should be enough time to correct the
remaining issues.
Member Bandur, seconded by Member Mann, moved that in Case#2022-00525, the respondent be found in violation as
cited as of July 28, 2022, and be given until September 06, 2022, to come into compliance or be fined$25.00 per day, per
violation, until found in compliance. Motion carried unanimously.
CASE NO 2022-00316

Violation Cited: §51-13.

per day until found in compliance.
Member Bandur, seconded by Member Mann, moved that in Case#2022-00316, the respondent be found in violation as
cited as of May 23,2022, and be given until September 06,2022, to come into compliance or be fined$25.00 per day until
found in compliance. Motion carried unanimously.

Violation Cited: §108-24.D.
Summary:
§108-24.D—It shall be unlawful to use a residential property for the storage of any abandoned motor vehicle, ice box,
refrigerator, stove,glass, building material, building rubbish or similar items. It shall be the duty every such owner and
occupant to keep the premises of residential properties clean and to remove all such abandoned items.
Observation:
§108-24.D.—Old Car Bumper Cover Side Yard. Misc.Junk Debris Tires Back Yard.
Officer Loeffler presented the case and gave its history. He further explained that as of August 23, 2022, the property is
still in non-compliance.The City asked for an Order of Compliance by September 07,2022,or thereafter to be fined$15.00
per day until found in compliance.
Member Bandur,seconded by Member Mann, moved that in Case#2022-00440, the respondent be found in violation as
cited as of July 01,2022, and be given until September 07, 2022, to come into compliance or be fined$15.00 per day until
found in compliance. Motion carried unanimously.

Summary:

Observation:

Officer Loeffler presented the case and gave its history. He further explained that as of August 23, 2022, the property is
still in non-compliance.The City asked for an Order of Compliance by September 07,2022,or thereafter to be fined$15.00
per day until found in compliance.
Member Bandur, seconded by Member Mann, moved that in Case#2022-00510, the respondent be found in violation as
cited as of July 21,2022, and be given until September 07,2022, to come into compliance or be fined$15.00 per day until
found in compliance. Motion passed 4-1 with Chair Odom opposing.
CASE NO 2022-00523
OFFICER DIAZ 402 S CUMBERLAND AVE 2017-2 IH BORROWER LP
Violation Cited: §95-3. &§ 115-3.B.
Summary:
§ 95-3. — A fence constructed under the provisions of this chapter shall be kept in good order and repair and any
advertisements thereon shall be regulated by the zoning ordinances.
§ 115-3.B.—No person shall allow or permit excessive growth,ten inches or more on property owned,of weeds,grass, •
undergrowth or other dead or living plant life.
Observation:
§95-3.—Fence Slats Down Leaving Swimming Pool Exposed.
§ 115-3.B.—Over Grown Grass and Weeds, Not Maintaining Property.
Officer Diaz presented the case and gave its history.She further explained that as of August 23,2022,the property is still
in non-compliance.The City asked for an Order of Compliance by September 02, 2022, or thereafter to be fined $100.00
per day, per violation, until found in compliance.
Member Bandur, seconded by Member Mann, moved that in Case#2022-00523, the respondent be found in violation as
cited as of July 25,2022, and be given until September 02,2022, to come into compliance or be fined$100.00 per day,per
violation, until found in compliance. Motion carried unanimously.
IV. CASE RESOLUTION
CASE NO 2022-00418
OFFICER LOEFFLER 1908 LAUREN BETH AVE SALCEDO, MIGUEL
BEDOLLA,CYNTHIA
Violation Cited: §150-20&§168-6.B.(1)
§150-20—It shall be unlawful for any person to knowingly discharge or to cause or permit discharge of any organic or
inorganic matter which causes or tends to cause pollution into any natural waters, receiving waters, outlets or storm
water management systems within the City.
§168-6.B.(1)—No owner, private property,shall consent to the parking or storing of vehicles on non-improved surfaces
of the property.
Observation:
§150-20—(5' Of Dirt Was Blocking Storm System) Heavy Amount of Sediment Erosion (From Vehicle Egress)
§168-6.B.(1)—Vehicle Parking on Grass; Heavy Amount of Sediment Erosion (From Vehicle Egress)
Officer Loeffler explained that as of August 23, 2022,the property is in compliance. No further action requested.
V.COMMENTS
The Board commented on the new meeting location and the completion of the new City Hall building.
Assistant Support Services Director Doug Gaines explained this meeting was not televised but the City plans to resume
televising soon.
Clerk Mieras mentioned the November and December meetings would be close to holidays and asked the Board for
direction on whether cases should be scheduled for these meetings,or if the Board plans to cancel them.The Board tabled
the discussion for the September meeting.
Assistant Support Services Director Doug Gaines introduced the new Code Enforcement Officer,Officer Tobe.
