Mayor Johnson called the regular session to order at 6:15 PM in the Commission Chambers of
City Hall. The invocation was led by Brad Lonmeck, Ocoee Resident, followed by the Pledge of
Allegiance to the Flag led by Commissioner Brinson. City Clerk Sibbitt called the roll and
declared a quorum present.

Presentation
Stephanie Palacios, Second Harvest Food Bank of Central Florida, highlighted the mission of
their organization and provided an overview of their programs and partnerships. Commissioner
Oliver inquired if the organization could help with the summer feeding program for the youth in
Ocoee. Ms. Palacins addressed his request.
Thomas Lowrie, American Legion Post 109, shared a video about the upcoming Challenge 22
Walk and Picnic, an event being held to raise money and awareness to help eliminate veteran
suicide due to PTS. He provided the date, time, and location, and encouraged citizens to support
and attended

Commissioner Oliver requested a point of order recalling the City Commission meeting held on
October 18, 2022, and inquired about the HRDB discussion that was to be placed on the Agenda.
City Clerk Sibbitt shared that the vote was to place the item on the Agenda following the 2022
Ocoee Remembrance — Unity Fesitval.

The Code Enforcement Board (CEB) was created by Ordinance No. 741 on June 16, 1981, with the most recent
revision by Ordinance 2017-005 on January 17, 2017. The purpose of this Board is to review residential
property infractions of the City Technical Codes, negotiate compliance and impose fines for failure to comply.
The Code Enforcement Board is to have a Board Attorney, seven (7) regular members and two (2) alternate
members with a three-year term. Currently, the Board has five (5) regular members and zero (0) alternate
members.
Members of the Parks and Recreation Advisory Board (PRAB) serve three-year terms. The resolution provides
that the PRAB shall consist of nine (9) members, and only legal residents of the City of Ocoee or who are
members of a City sporting organization that utilize the Ocoee parks shall be eligible for membership.
Currently, the board has eight (8) members. The terms of Jane Rainer (District 4) and Qubeliah Graham (District
4) end in October of 2022. Members Rainer and Graham have indicated they are willing to serve another three-
year term, if reappointed. One new application has been received by Tino Sangster (District 2) who wishes to
be appointed to the PRAB with a term ending October 2025.

The City needs to acquire certain property for the City of Ocoee Taylor & Franklin Streets Intersection
Improvement Project.

The 850 Ocoee Apopka Road (the "Property") has been utilized as an approved mulching business in
accordance with an approved Large -Scale Site plan and Orange County Environmental Protection Permit. The
Property owner has applied for and will receive a permit from the Orange County Environmental Protection
Division to continue the mulching business (the "New Permit"). The City may need an alternate site for the
storage of disaster debris generated in the City following hurricanes, tropical storms or other weather -related
disasters pursuant to Section 403.7071 Florida Statutes. In exchange for a five-year extension of the use of the
Property as mulching business, the Property Owner and the City may enter into a separate agreement for the
storage of disaster debris on the Property.

The Inland Group building is located on the northeast comer of Palm Drive and E. Crown Point Road. The
property consists of (1) a two-story, 14,710-square-foot office building. The infrastructure improvements
include potable water, sanitary sewer, other private utilities, a stormwater collection system, and associated
landscaping. Identified punch list repairs are currently being completed, and the developer is nearly ready to
start the two-year warranty period for the public improvements. As a requirement of the Land Development
Code, the developer is required to furnish the City a Surety to cover any possible damages discovered during
the next two years. Should the developer not choose to make those repairs, Inland Group LLC has provided the
City with an Escrow in the amount of 10% of the constructed improvements. The Escrow provided is for a
grand total of $2,020.00. The Maintenance, Materials, and Workmanship Agreement acts as the executable
document between the developer and the City. The Surety will be returned to the developer upon completion
of the two-year warranty period and the repair of any damages caused over those two years.

GPK OET LLC (GPK) is currently under contract to purchase 17.96 acres of land located on the northeast
comer of Ocoee Apopka Road and Fullers Cross Road from the City. The parcel is a Tract of Land within the
Crown Point PUD. GPK has submitted a Preliminary Site plan for a mixed use development consisting of
multifamily apartments and retail. Portions of the Tract under contract for sale were utilized as part of the Ocoee
Apopka and Fullers Cross Road intersection improvements that were completed late last year. Additionally, the
design of the project indicated an additional stormwater need for improvements to the intersection. Staff is also
evaluating the future stormwater needs for the eventual widening of Ocoee Apopka Road and identified that
the 6.8 acres Tract of land on the north side of SR 429 is suitable and sufficiently located to provide an
opportunity for a City Owned and Maintained Joint Use Master stormwater pond. The utilization of the Tract
as a Master Stormwater pond would provide a location for stormwater for the GPK site, intersection
improvements, future land widening of Ocoee Apopka Road, and provide additional storage for City owned
properties in the area. With the approval of the Memorandum of Agreement, GPK will design, engineer and
construct a Master Stormwater pond to accommodate both their projects. The approval will also be included in
a Development Agreement for GPK's Mixed Use at Fullers Cross Large Scale Site Plan.

Orange County and the City have been working together on a solution to address erosion on the County
maintained ditch along the north side of Thornebrooke Drive which is affecting the subdivision wall along the
south side of the City's Meadow Ridge neighborhood. Following several field meetings, and an initial in-house
design by the City, it was determined the most effective solution would be to pipe the ditch to eliminate erosion
of the slopes which were affecting the Meadow Ridge wall. Orange County agreed to split the cost with the
City and an interlocal agreement was drafted. The cost for the work as estimated by Public Works is
$400,000.00. This will provide an exfiltration pipe system to enclose the ditch and simplify maintenance which
will be taken over by the City.

With respect to Major Community Residential Homes (CRH)s, Table 5-1 allows a Major Community
Residential Home (CRH) use in the agriculture zoning districts (A- I and A-2) and all of the residential zoning
districts (RCE-1 through R-3) as a permitted use by right; however, Section 5-15B(3) of Article V stipulates
that a conditional use permit and Planning and Zoning Commission/City Commission approval are required.
Due to this discrepancy, staff has identified the need to amend the relevant provisions of the Code relative to
Major CRHs in order to eliminate the discrepancy and establish clear processes and expectations for this use.
City Attorney Cookson read the title of the ordinance.
Mayor Johnson announced this will be presented as a second reading and public hearing at the
next scheduled City Commission meeting on November 15, 2022, at 6:15 PM or soon thereafter.
READING OF ORDINANCE — PUBLIC HEARING - W8 PM I
The First Reading for the Substantial Amendment to the PUD was held on October 4, 2022. This item was
continued from the October 18, 2022, public hearing at the request of the applicant. The subject property is
zoned PUD and is located on the east side of Lake Johio Road, north side of E. Silver Star Road, approximately
770 feet cast of the intersection of N. Clarke Road and E. Silver Star Road. The subject site is located on Tract
4 of the PUD and is approximately 1.76 acres in size, currently undeveloped, and is the only remaining project
in the Ocoee Landings PUD. The proposed Ocoee Landings Mixed Use Building PUD Land Use Amendment
consists of a 51,680 square foot Mixed Use Building consisting of I" Floor: 8,000 square foot of retail; 1,757
square foot of apartment leasing space, and four (4) apartments. The 2n' and 31d Floors contain 42 apartment
units ranging fi-om 1-3 Bedrooms, The total amount of apartment units is 46.

Development Services Director Rumer presented a brief overview of the Substantial
Amendment to the PUD/Land Use Plan and Large -Scale Preliminary/Final Site Plan request for a
vacant parcel, approximately 1.76 acres, and located on the east side of Lake Johio Road, north
side of E. Silver Star Road, approximately 770 feet east of the intersection of N. Clarke Road and
E. Silver Star Road. The proposed Ocoee Landings Mixed Use Building PUD Land Use
Amendment consists of a 51,680 SF Mixed Use Building consisting of I't Floor: 8,000 SF of retail;
1,757 SF of condominium leasing space. The 2 nd and 3 d floors contain the 42 condominium units
ranging from 1-3 Bedrooms.

He shared the commitments made by the developer following the two community meetings that
were held after the Planning and Zoning Commission Meeting with neighboring residents.
The public hearing was opened
Robert Phillips, Ocoee Resident, voiced his contention on the proposed change in land use from
commercial to mixed -use, the height of the building and lack of privacy to the surrounding
neighbors, and noise concerns. He shared information on the community meetings which lie felt
were short noticed and had low attendance.
Tara Tedrow, Applicant, Loivndes, Orlando, FL, shared a presentation on the subject property
and explained the existing uses under the current PUD. She further explained the proposed
mixed -use project, parking code requirements, voluntary conditions of approval, landscaping
enhancements, and the projects consistency with the Comprehensive Plan and Code.
Jim Taylor, Ocoee Resident, commented on the project, and shared no objections as he is not a
neighboring resident, but inquired if there will be sufficient parking.
Jason Crews, Ocoee Resident, shared concerns on the height of the proposed project and parking.

Commissioner Brinson shared he met with the developer and understands the concerns of the
residents, but feels the developer has made many of the accommodations that were requested
during their community meetings. He voiced his support on the amendment to mixed -use
residential.
Commissioner Firstner shared he did not have an issue with the mixed -use residential and prefers
that concept versus the three-story commercial. He commended the developers on the changes to
their orginal plans and for working with the residents and City staff.
Commissioner Oliver commented on past experiences he had with two major developers and the
problems he endured with them to include getting a traffic light to limit accidents. He shared his
support on the project and stated that all his concerns have been addressed by the developer.
Mayor Johnson shared concerns with the Commissioner for that District not being in attendance.
He further commented that he is not in favor of the project due to the mixed -use residential as he
felt the condominimums will be rented out as apartments, traffic will increase on Silver Star Road,
and parking will be an issue. He shared his support on the Planning and Zoning Commission
recommendation of denial.

COMMENTS FROM CITIZENS/PUBLIC - 7:22 PIVI
Harry Singh, Ocoee Resident, spoke about cultural events that he would like to bring to Ocoee
and requested financial assistance as well as the use of the Lakeshore Center and Bill Breeze Park.
He then inquired about any old computers that are no longer being used and requested to have
them donated to his charity for use in schools in Guyana.
Cate lannello, Ocoee Resident, recalled comments made at a previous City Commission meeting,
noted that truth statements and subjective statements are not the same, and outlined the difference.
Jim Taylor, Ocoee Resident, requested an update on the hurricane debris and large bulk item
removal. He further inquired about the suspension of the bulk pick-up as this is a paid service and
wanted to know when it would resume. City Manager Frank shared that his office was unaware
of the suspension of bulk pick-up, and offered to look into the matter. Mayor Johnson offered to
have Public Works Director Krug contact him directly to address his concerns. Mr. Taylor then
shared that the City's website needs to be updated to help accurately inform residents.

Commissioner Oliver — Commented on the following:
I)Thanked Ms. lannello and agreed with her comments about truth statements and subjective
statements.
2) Shared the importance of voting and provided the Supervisor of Elections (SOE) contact
information.
3) Read information on Breast Cancer Awareness Month.
4) Shared a short video on the Ocoee Unity Family Festival and announced the date, time, and
location.
5) Shared a quote by Frederick Douglass.

Commissioner Firstner — Commented on the following:
1) Inquired about the D-snap program scheduled at the West Oaks Mall. City Manager Frank
addressed his question.
2) Announced the upcoming Veteran's Day Ceremony and provided the date, time, and location.
3) Announced Daylight savings time.
4) Shared that November is Native America Heritage month, and noted that he would like to see
the HRDB find a way to honor this heritage.
5) Announced the next local One Blood Drive date, time, and location.
Commissioner Brinson — Commented on the following:
1) Announced the upcoming Marine Corps Birthday, and Veteran's Day.
2) Reminded residents of the upcoming holidays and reminded them that it is very important to
remain vigilant sand be safe.
3) Spoke about infrastructure and construction around town and encouraged patience.
4) Commented on speeding and reckless driving. Expressed discord with impatient drivers
crossing the double yellow line to navigate around another vehicle and asked for police assistance.
Police Chief Plasencia addressed his concerns.
5) Responded to the request by Mr. Singh, and encouraged him to contact the HRDB.
6) Encouraged any resident with debris removal concerns to contact Public Works, and provided
their phone number.
7) Spoke about the D-Snap program.
8) Commented on the importance of voting, and encouraged anyone with questions to contact the
SOE.
9) Reiterated multiple upcoming events in the area and encouraged patience and safety.
Mayor Johnson — Commented on the following:
1) Shared the importance of voting in both General and Municipal elections, and announced the
2023 Municipal Election date.
2) Inquired about street resurfacing and sidewalk repairs, and requested a work, plan.
3) Recalled multiple discussions regarding the need for speed tables along Flewelling Avenue,
near the Central Park Little League Fields, and Sal Street near Spring Lake elementary school.
City Manager Frank addressed his concerns.
4) Inquired about the Christmas decorations. City Manager Frank addressed his question.
5) Commented on the success of the Ocoee High School Homecoming Parade and encouraged
making it an annual event.
6) Inquired about the start date for the Clark Road Expansion Project. City Manager Frank and
Development Services Director Rumer addressed his question. Mayor Johnson explained the
process.
7) Commented on the hurricane debris/yard waste concerns.
