CALL TO ORDER Vice -Chair Bandur called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission Chambers of City Hall located at 1 N Bluford Ave, Ocoee, Florida. A. INVOCATION: Member Brennan initiated the moment of silence. B. PLEDGE OF ALLEGIANCE: Member Lewis led the Board in the Pledge of Allegiance to the U.S. flag. C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared a quorum (4) present. PRESENT: Vice -Chair Bandur & Members: Lewis, Mann, & Brennan. Also present: Board Attorney Skip Fowler, Acting Support Services Director Doug Gaines, Code Enforcement Clerk Justin Mieras, and Code Enforcement Officer Loeffler and Rodriguez. ABSENT: Chair Odom is an excused absence. D. SWEARING OF OFFICERS / WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code Enforcement Officers and to anyone intending to speak regarding a case. II. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCTTHE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS CASE NO 2022-00392 OFFICER RODRIGUEZ 1 10 LAKEVIEW ST I CURRY, VINCENZA B Violation Cited: § 165-4.A.B(1)(a) Summary: § 165-4.A.B(1)(a) — Non -operational vehicles are considered abandoned and vehicles missing a valid registered license plate is considered non -operating. Observation: § 165-4.A.B(1)(a) — Untagged Vehicle on The Property Officer Rodriguez presented the case and gave its history. She further explained that as of October 25, 2022, the property is still in non-compliance. The City asked for an Order of Compliance by November 09, 2022, or thereafter to be fined $30.00 per day, until found in compliance. Member Mann, seconded by Member Lewis, moved that in Case #2022-00392 the respondent be found in violation as cited as of June 17, 2022, and be given until November 09 2022 to come into compliance or be fined $30 00 per day, until found in compliance. Motion carried unanimously. CASE NO 2022-00555 OFFICER LOEFFLER 1 1001 SAL ST Violation Cited: §108-24.D. & § 168-6.B.(1) HERNANDEZ, RAMIRO Summary: § 108-24.D — It shall be unlawful to use a residential property for the storage of any abandoned motor vehicle, ice box, refrigerator, stove, glass, building material, building rubbish or similar items. It shall be the duty every such owner and occupant to keep the premises of residential properties clean and to remove all such abandoned items. § 168-6.B.(1) — No owner, private property, shall consent to the parking or storing of vehicles on non -improved surfaces of the property. Observation: § 108-24.D — Untagged And/or Inoperable Vehicles Side Yard and Rear Yard Visible from Street Tall Weeds and Grass Underneath and Around White Truck Small Car. Stacked Building Materials, Old Car Tires/Wheel Misc. Debris. § 168-6.B.(1) — Vehicles Parked Upon Yard Grass / Unsurfaced Portions of Property. Officer Loeffler presented the case and gave its history. He further explained that as of October 25, 2022, the property is still in non-compliance. The City asked for an Order of Compliance by November 09, 2022, or thereafter to be fined $25.00 per day, per violation, until found in compliance. Member Bandur, seconded by Member Mann, moved that in Case #2022-00555 the respondent be found in violation as cited as of August 22, 2022 and be given until November 09 2022 to come into compliance or be fined $25.00 per day, per violation, until found in compliance. Motion carried unanimously. CASE NO 2022-00573 OFFICER LOEFFLER I 12 LAFAYETTE ST I HICKS, PHILLIP I Violation Cited: § 51-13. Summary: § 51-13. — It shall be a violation to do work related to construction without first obtaini Observation: § 51-13. — Driveway / Slab / Concrete Work. Stucco. a permit Officer Loeffler presented the case and gave its history. He further explained that as of October 25, 2022, the property is still in non-compliance. The City asked for an Order of Compliance by November 09, 2022, or thereafter to be fined $25.00 per day, until found in compliance. Member Mann, seconded by Member Lewis, moved that in Case #2022-00573 the respondent be found in violation as cited as of August 15, 202Z and be given until November 09, 2022 to come into compliance or be fined $25.00 per day, until found in compliance. Motion carried unanimously. CASE NO 2022-00599 OFFICER LOEFFLER 1 2039 APPLEGATE DR I AMH 2O15-1 BORROWER LP Violation Cited: §108-24.D., § 1 15-3.A.(3), & §143-27.A. Summary: §108-24.D. — It shall be unlawful to use a residential property for the storage of any abandoned motor vehicle, ice box, refrigerator, stove, glass, building material, building rubbish or similar items. It shall be the duty every such owner and occupant to keep the premises of residential properties clean and to remove all such abandoned items. §115-3.A.(3) — No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety and welfare. §143-27.A. — At non -pickup times, garbage carts shall be placed in side yards or rear yards and screened from view to the extent practicable. Except as provided herein, garbage carts shall at no time be placed in the front yard of the premises. Observation: §108-24.D. — Overgrown / Tall Weeds and Grass Rear and Side Yards. Misc. Junk, Scrap, Debris, Equipment Stored Along Side of House. §115-3.A.(3) — Tall Weeds and Grass Rear and Side Yards; Misc. Junk Debris Stored Along Side of House §143-27.A. — City Issued Waste Cans Stored in Prohibited Location Officer Loeffler presented the case and gave its history. He further explained that as of October 25, 2022, the property is still in non-compliance. The City asked for an Order of Compliance by November 09, 2022, or thereafter to be fined $25.00 per day, per violation, until found in compliance. Member Mann, seconded by Member Lewis moved that in Case #2022-00599 the respondent be found in violation as cited as of September 10, 2022 and be given until November 09 2022 to come into compliance or be fined $25.00 per day, per violation, until found in compliance. Motion carried unanimously. CASE NO 2022-00653 OFFICER LOEFFLER 1 321 NEW MEADOWS CT I MERLOS, I AGUILAR VASQUEZ Violation Cited: § 51-13. Summary: § 51-13. — It shall be a violation to do work related to construction without first obtaining a permit Observation: § 51-13. — New Roof Without Permit Officer Loeffler presented the case and gave its history. He further explained that as of October 25, 2022, the property is still in non-compliance. The City asked for an Order of Compliance by November 09, 2022, or thereafter to be fined $25.00 per day, until found in compliance. Member Mann, seconded by Member Lewis, moved that in Case #2022-00653, the respondent be found in violation as cited as of September 07, 2022, and be given until November 09, 2022, to come into compliance or be fined $25.00 per day, until found in compliance. Officer Loeffler explained that as of October 25, 2022, the property is still in non-compliance. The City asked for an Order Imposing Fine. Member Mann, seconded by Member Lewis moved that in Case #2022-00300 the Board impose fines as of September 27, 2022, as previously set by this Board. Motion carried unanimously. CASE NO 2022-00316 OFFICER DIAZ I 17 CEDAR KEY CT MEDINA, SANDRA MEDINA, SERGIO Violation Cited: §51-13. §51-13. — It shall be a violation to do work related to construction without first obtaining a Observation: §51-13. — Tarp Installed Without Required Permits, Plans, Approval and Inspections. rmit. Officer Diaz explained that as of October 25, 2022, the property is still in non-compliance. The City asked for an Order Imposing Fine. Member Mann, seconded by Member Lewis moved that in Case #2022-00316 the Board impose fines as of September 07, 2022, as previously set by this Board. Motion carried unanimously. CASE NO 2022-00440 OFFICER LOEFFLER I 2609 HORNLAKE CIR I J JOSEPH, RENEE E Violation Cited: §108-24.D. Summary: §108-24.D — It shall be unlawful to use a residential property for the storage of any abandoned motor vehicle, ice box, refrigerator, stove, glass, building material, building rubbish or similar items. It shall be the duty every such owner and occupant to keep the premises of residential properties clean and to remove all such abandoned items. Observation: §108-24.D. — Old Car Bumper Cover Side Yard. Misc. Junk Debris Tires Back Yard. Officer Loeffler explained that as of October 25, 2022, the property is in compliance. No further action requested. CASE NO 2022-00510 OFFICER LOEFFLER I 2500 TWISTING SWEETGUM WAY I PROG BORROWER LLC L HVH Violation Cited: §115-3.B. Summary: §115-3.B. — No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds, grass, undergrowth or other dead or living plant life. Observation: §115-3.B. — Tall Weeds and Grass Rear And Side Yards Officer Loeffler explained that as of October 25, 2022, the property is in compliance. No further action requested. CASE NO 2022-00523 OFFICER DIAZ 1 402 S CUMBERLAND AVE 1 2017-2 IH BORROWER LP Violation Cited: § 95-3. & § 115-3.B. Summary: § 95-3. — A fence constructed under the provisions of this chapter shall be kept in good order and repair and any advertisements thereon shall be regulated by the zoning ordinances. § 115-3.13. — No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds, grass, undergrowth or other dead or living plant life. Observation: § 95-3. — Fence Slats Down Leaving Swimming Pool Exposed. § 115-3.13. —Over Grown Grass and Weeds, Not Maintaining Property. Officer Diaz explained that as of October 25, 2022, the property is in compliance. No further action requested. CASE NO 2022-00525 OFFICER DIAZ 6 SUNSET KEY CT NIETO, JOSE OSCAR MANZANO Violation Cited: §115-3.A.(3) & §115-3.B. Summary: §115-3.A.(3) — No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety and welfare. §115-3.B. — No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds, grass, undergrowth or other dead or living plant life. Observation: § 115-3.A.(3) — Trash/Debris Throughout the Property. § 115-3.B. —Over Grown Grass and Weeds, Not Maintaining Property. Officer Diaz explained that as of October 25, 2022, the property is in compliance. No further action requested. VI. NOVEMBER & DECEMBER MEETINGS Member Lewis, seconded by Member Mann, moved to cancel the November 22 2022 and December 27 2022 Code Enforcement Board meetings.
