Bluford Avenue ▪ Ocoee, Florida 34761 Phone: (407) 905-3100 ▪ www.ocoee.org STAFF REPORT Meeting Date: May 2, 2023 Item #: 10 Contact Name: Robert Frank Department Director: Robert Frank Contact Number: Ext. 6434 City Manager: Robert Frank Subject: Discussion and Direction on the Special Election. (City Manager Frank) Background Summary: On April 18, 2023, the consensus of the City Commission was to place an agenda item on the May 2, 2023, City Commission Meeting to discuss the special election, and include a second opinion on the interpretation of the City Charter as it relates to when the election can be held. The City Commission asked the City Manager to hire an attorney qualified on municipal election laws. City Manager Frank retained Attorney Richard Geller of Fishback Dominick LLP, who is board certified by the Florida Bar in City, County, and Local Government Law, for a second opinion on when the Special Election can be held in accordance with the City Charter. Mr. Geller has practiced law for over 30 years, the last 15 with Fishback Dominick, which is a premier local government law firm in the area. Mr. Geller has provided a letter explaining his interpretation of the City Charter and will present his findings. If the City Commission considers cancelling the June 13, 2023, special election for the District 4 Commission seat, and instead calls a general city election on March 19, 2024, the resolution provided by Mr. Geller would need to be adopted. Issue: Should the City Commission consider cancelling the June 13, 2023, special election for the District 4 Commission seat, and instead call a general city election on March 19, 2024? Recommendations: Staff recommends the Honorable Mayor and City Commissioners review Attorney Geller's professional opinion on when the City can hold the Election for the District 4 Commission seat in accordance with the City Charter. If the City Commission considers cancelling the June 13, 2023, special election for the District 4 Commission seat, and instead calls a general city election on March 19, 2024, the resolution provided by Mr. Geller would need to be adopted.
