...TrTIM, Id City Hall Demolition (Steve Krug) Demolition of the Old City Hall was originally scheduled for the first week of August; however, the contractor was delayed in finishing a larger project in the 1-4 corridor and will begin the demo project for Ocoee on August 201n Floral Avenue Sewer (Jamie Croteau) The procurement for the guaranteed maximum price (GMP) is on the August 15tn Commission Meeting agenda for approval. We have taken a number of steps to help keep the project on track. Due to the concern over product availability we ordered water pipe for the project several months ago and it is on site at Utilities. There is currently an 8-week lead time on sewer structures and those have also been ordered. They are expected to start arriving at the site on or around September 131n. Prep work for the project will begin the first and/or the second week of September. This will include removal of trees in the right of way, fencing of the contractor's lay down yard, etc. This will involve sporadic lane closures. Floral Avenue will be closed to through traffic starting September 17t". The contractor plans on completing the work on Floral before moving to Cumberland; it is anticipated the work on Floral will take approximately 5 months. This is provided everything goes smoothly and we have approval for the GMP on August 15t". Of note, the City's Parks and Recreation Department has been coordinating with Public Works and Utilities so that downtown events may be scheduled around the numerous closures that will occur over the next few months in our downtown area. Lake Apopka Natural Gas in the Downtown (Mike Rumer/Steve Krug) April 16, 2019 - Presentation to City Commission on benefits and cost to run natural gas in the downtown (via Bluford Ave). November 19, 2020 - Lake Apopka Gas reaches out to the City about the funding and getting the project moving forward. November 30, 2020 - As -built Survey of Bluford Avenue (Post construction of new streetscape). December 9, 2020 - Lake Apopka Gas identifies west side of Bluford to run line. Public Works Identified a conflict with running line on Bluford. December 16, 2020 - Public Works identifies an alternate route. Lake Apopka Gas provides cost to run a modified rote to get the project going. The line is now going to run on Bluford from W Columbus Street to Ohio Street. September 21, 2021 - Lake Apopka Gas provides an update to City Commission. February 2022 - Lake Apopka Gas submits a permit to run from Ohio to Cumberland and up to McKey Street. April 20, 2022 - Path on Cumberland Ave at Floral St. is shown to cause a conflict. April 2022 - Lake Apopka Gas has been coordinating with the Engineer and Contractor for the Floral Street sewer improvements. Plans were sent to Lake Apopka Gas on May 26th with a proposed route. August 10, 2023 - Randy Cook, Construction Project Manager states a permit should be submitted by Friday, August 11. Construction should take two (2) months. August 15, 2023 — Permit submitted electronically to the City West Oakland Avenue (Steve Krug) Below is the timeline for West Oakland Avenue: - Aug 24th: CPH is scheduled to have the 100% Construction Plans and Summary of Pay Items complete - Week of Aug. 28th: Documents can be ready for Bid o Once the City receives the 100% Plans and Summary of Pay Items, City Staff will take 3-4 days to review and complete the Bid Documents. o The requested contractors Bid Period will be 45-60 days - Late October -Early November: Bid Awarded - December: Issue Notice to Proceed o Construction to begin pending material deliveries Concurrent to Bidding Process - Late August -September: Property Acquisition o A verbal agreement with the Tom West property owners has been reached for the removal of the weigh scale in the right-of-way and the acquisition of a small clip of property needed for roadway construction. A formal agreement needs to be drafted by the new City attorneys. This agreement can be worked on during the Bid review period. The attorneys will need direction on the particulars of the verbal agreement. Late August -September: Meetings with W Oakland Residents o Temporary Construction Easement meetings are ongoing with residents on W Oakland. Thus far we have meet with 3 of the 8 property owners with 1 more meeting scheduled for Thursday Aug. 10t". The TCE meetings can continue during the Bidding period and documents will be completed before construction begins. Mid -September: Duke Energy Underground Power Work (First Phase) o Duke Energy has released their work order for the first phase of underground power construction (portion east of the railroad crossing) with a tentative start date for mid -September. The City is working with the Tom West property owners for a Duke Energy Easement which is necessary to bury power on W Oakland west of the railroad crossing. The City is also working to get a Duke Energy Easement for a switch gear south of the W Oakland/N Cumberland intersection. All other private utility providers have moved their facilities to the edge of the right-of-way. Some adjustments may need to be made during construction, but the bulk of work for the other private utility providers have been completed. Since the workshop, staff has been engaged with moving forward with actions necessary to propose a CRA for downtown, and has been working with GAI consultants on those steps. Below is the update on where we are currently: Task 1 — Finding of Necessity Update GAI is preparing an update to the expansion area Finding of Necessity Analysis study completed in 2006 and related services in accordance with the following: Specifically, the expanded study area will include - recently incorporated enclaves and the West Oaks Mall and the Downtown FON Study Area. Status: 100% - Base Map and Parcel databases lists compiled. Identify elements contributing to potential slum or blight as outlined in 163.340(7) or (8), Florida Statutes, and conduct the required analysis to determine the extent, if any, of such slum or blight within the suggested expansion area within the attached proposed CRA W-. .. Status: 30% On Site visits completed. data gathering and desktop Prepare map(s) of the expanded area, based on the land use within the district that would require supporting capital projects within the proposed CRA Area. completed.Status: 70% F v Study Area maps completed. Initial site visits and photographic data collection photographic evidence of "slum" and "blight" conditions. Prepare "Slum and Blight Matrix" memo that outlines the perceived presence of conditions of "slum" and "blight" as defined in Section 163.3640 (7), (8), Florida Statutes. Provide a draft Finding of Necessity evaluation to staff and assist in presenting blight factors to CRA and City Commission. Clarke Road (Steve Krug) Lennar has finalized their cost to construct the Clarke Road improvements. Lennar will need an additional $2,903,699.90 to construct. This is the amount that needs to be added to the Developer and Escrow Agreement. Public Works would like to create a contingency fund of $250,000 for any change orders. Additionally, the City will need a maximum of $100,000 for acquisition and legal fees associated with the Lift Station Driveway property acquisition. This item will be brought to the City Commission as an amendment to the development agreement at the next meeting. PURPOSE The City of Ocoee is progressing in its Downtown Revitalization and is pleased to announce the next significant action item by publicizing a Request for Letters of Interest (RFLOI) for a Master Developer for Downtown Properties. All interested parties, individual firms, or teams with experience in Downtown Urban Development to include Public and Private Partnerships and Downtown Lake Front Development are encouraged to submit. The Master Developer must demonstrate their expertise, track record, and financing capabilities to further the City's Downtown Master Plan (2017 Florida APA Award of Excellence Winner) by utilizing City owned land for development. The City is also engaged in securing additional strategic properties which could be added to the holdings. The City is using the RFLOI process to actively engage Master Developers interested in taking the lead in the aforementioned categories to include the City owned lands and lakefront portions of the Downtown. Individual firms or teams (Respondents) interested in responding to this request are invited, on a non -binding basis, to express their interest, qualifications and methodology to help Ocoee realize our vision to recapture, reinvigorate and create an authentic downtown for Ocoee. The Downtown Master Plan speaks to several bold moves to realize our vision; they are as follows: 0 A Better -Connected Community for all modes of Circulation ® Creating a Place of Lasting Value, New Investment, and Economic Activity ® A More Dynamic Linkage of Lake+Park+Community ® The Lakefront is the Cultural, Recreational, Civic, and Environmental Heart of the City The purpose of this RFLOI is to generate responses that contain information which will help the City understand the prospective Development Teams ability to articulate the vision, demonstrate capabilities to design and construct with and bring end users to projects. This RFLOI does not constitute a Request for Proposal (RFP) nor an Invitation to Bid (ITB) Ocoee to contract for any service or services contemplated. Failure to respond to this RFLOI in whole or in part does not preclude the ability to respond to any future RFP opportunities. Responders are advised that the City of Ocoee will not pay any cost incurred in responding to this RFLOI and that any or all such costs are the sole responsibility of the Responder. The City of Ocoee is publicizing this RFLOI as inquiry only; no contract or agreement is expected as a result of this process. By responding to this RFLOI or otherwise participating in this process, no contract or agreement will be formed and there will be no legal obligation between the City and the Respondents. Individual firms or teams that have not responded to this RFLOI will not be precluded from participating in any future formal solicitation processes. The City is in discussions with a single landowner with 12 properties in the Downtown which are located between Bluford Avenue and Maguire Road. TO: City Council: Mayor and Commissioners 14 August 2023 1 Bluford Avenue Ocoee, Florida 34761-2371 Subject: Ocoee Police & Firemen's Pension Board Vacancy Mayor and Commissioners, this is an appeal to the Council for your consideration in the selection of the next candidate to fill the void in the Pension Board's membership; a condition created by the announced resignation and departure of the Past Chairman, former Police Chief Charles Brown on 2 August 2023, a day before our scheduled quarterly meeting. The position of a Pension Board Trustee is not one to be taken lightly in that it is deeply rooted in the industry of Financial Management; the assumption, and satisfactory performance of the fiduciary responsibilities as prescribed under Florida Statutes Chapter 112.658: Fiduciary Duties (1), (2), (3). The Complete outline of duties and responsibilities of a Pension Board Trustee for Police and Firemen are detailed in Chapters 175 and 185 of Florida Statutes. The Board is now in dire need of its Fifth Member, which will require an appointment by the Council, of an individual from within the geographical and physical boundaries of the City of Ocoee. To find such an individual is a tedious undertaking, which can be eliminated with a majority vote to waive the "Residency Provision," for a "Variance of the City Ordinance," as it relates to the residency of a person to serve on a Municipal Board as a Trustee. The Board also has a requirement that each member becomes certified as a Trustee by attendance, and successful completion of the Trustee Certification Training Program. Trustee Training Schools are conducted twice annually by the Florida Public Pension Trustee Association (FPPTA). This is an organization sanctioned by the state of Florida for the conduct of Trustee Certification Training, of which all current members have completed. The certification process is divided into three phases of intense, eight hours per day, in -classroom instructions on all aspects of Florida Statutes as may be applicable to Public Pension Trust Funds management; up to date lectures on the many and varied complexities of the Financial Industry as it is globally dispersed. Each phase of formal instruction is concluded with the administration of a Performance Examination of each enrolled and attending Trustee. A passing grade of Seventy (70%) Percent must be obtained in order to move to the next phase of the training, which is the Intermediate Phase. When a Trustee has attended and successfully completed all three phases of training (Basic, Intermediate and Advanced), they are awarded by the Education Committee of the FPPTA, the designation of Certified Public Pension Trustee (CPPT). Because the organization only conducts two training school sessions per calendar year, the normal time for a newly appointed Trustee to become certified is one -and -one half years. There is a cost factor associated with the attainment of the required certification. Categorically, those costs are: Travel and Per Diem, Hotel accommodations for an average of three nights stay at the Venue. Course Registration Fees for each attending individual, all related forms of local taxation and parking. The average cost per individual is approximately $1,800.00, per training session, times three. The above costs can easily be defrayed by the appointment of Police Sergeant, William "Bill" Wagner to the Ocoee Police & Firemen Pension Trust Fund Board. Sergeant Wagner is already CPPT Certified, and would only need to resume the completion of the Continuing Education Units (CEU's) required of each Trustee after they have completed the initial Certification Training. This is the most cost- effective manner of bringing the Board of Trustees, immediately back to its required membership level, and is a, "Win -Win" scenario for both the City and the Pension Trust Fund Board.
