Bluford Avenue Ocoee, Florida September 13, 2023 MINUTES 6:00 PM TENTATIVE BUDGET PUBLIC HEARING • CALL TO ORDER Mayor Johnson called the final budget hearing to order at 6:02 PM in the Commission Chambers of City Hall. The invocation was led by Mayor Johnson followed by the Pledge of Allegiance to the Flag led by Commissioner Wilsen. City Clerk Sibbitt called the roll and declared a quorum present. Present: Mayor Johnson, Commissioner Kennedy, Commissioner Wilsen, Commissioner Firstner Absent: Commissioner Hart Also Present: City Manager Frank, City Attorney Geller, City Clerk Sibbitt, Finance Director Roberts, and Chief Accountant Hovanec • PUBLIC HEARING A. Mayor's Announcement This is a public hearing on the tentative budget and proposed millage rate for the City of Ocoee. Notice of this hearing was contained in the Notice of Proposed Property Taxes mailed by the Property Appraiser. The City Commission has previously set a proposed millage rate of 4.950 mills which represents an 8.36% increase in millage over the rolled -back rate of 4.568 mills. B. Briefing by City Attorney The preliminary millage rate set by the City Commission and contained in the TRIM Notice is 4.950 mills. The maximum millage rate, which may be levied by the City by regular majority vote for the 2023-2024 fiscal year is 6.9091 mills, such maximum millage rate having been determined pursuant to Section 200.185(3)(a), Florida Statutes. The establishment of a millage rate between 6.9092 mills and 7.600 mills requires a two-thirds vote (supermajority) of the membership of the City Commission (or 4 votes). The establishment of a millage rate between 7.601 mills and 10.000 mills requires a unanimous vote of the City Commission. Additionally, any millage rate adopted above the preliminary millage rate of 4.950 mills would require notice by first-class mail to each taxpayer. The tentative millage rate adopted at this hearing will become the maximum millage rate which may be adopted by the City Commission at the public hearing on the final millage rate. A unanimous vote or a two-thirds vote may be required to adopt the tentative millage rate as the final millage rate. At the final public hearing, the City Commission may adopt a millage rate which is less than the tentative millage rate. Page 3 of 253 Tentative Budget Public Hearing September 13, 2023 C. Briefing by Finance Director Director of Finance Roberts announced the budget is balanced at 4.950 mills which is no change from 2023. She summarized the proposed budget and commitments for FY 2023- 2024, and provided an update on the changes proposed by the City Commission during the Budget Workshop. Highlights in the presentation covered: • Economic Highlights • Fiscal Sustainability • Budget Commitments • Debt Service • Incorporated Staff Changes • Commission Directed Changes from the Workshop • Changes Subsequent to Publication 1. Public Comments Mayor Johnson opened the floor for public comments. The following persons addressed the City Commission: - Dorcas Dillard, Ocoee Resident and OYC Coordinator, inquired about the elimination of the $10,000 from the Ocoee Youth Council Budget, and where the funding was placed. Commissioner Kennedy addressed her question and clarified that the funding is not being eliminated but was requested to be moved into a new line item for scholarships. Brief discussion ensued on the scholarship program proposal, the Consulting Service Fee for the OYC Coordinator, and having the Ocoee Youth Council Program overseen by City staff with volunteer assistance. 2. Commissioners Comments Commissioner Wilsen commented that the Spring Fling is being re -branded and will be changing to a Spring Conservation themed event. She requested that the line item be renamed to reflect this change. She further voiced her contentment with the sidewalk budget being increased. Mayor Johnson commented on adding a part-time Cemetery staff member to maintain the cemetery, if it does not affect the millage rate. City Manager Frank confirmed it would not affect the millage rate. Consensus of the City Commission was to approve the addition of a part-time Cemetery staff member to the budget. Mayor Johnson commented on increasing the Discretionary Funding from $10,000 to $15,000. Consensus of the Citv Commission was to increase the Discretionary Fund to $15,000. City staff confirmed the millage rate would not be affected by this request. NOTE: RECESS (if needed) to recompute the proposed millage rate and rolled -back percentage increase. 21 Page 4 of 253 Tentative Budget Public Hearing September 13, 2023 D. Announcement by Finance Director: Finance Director Roberts announced there would be no adjustments to the millage rate to accommodate any of the changes requested. Therefore, the proposed millage rate would remain at 4.950 mills which is 8.36 % greater than the rolled -back rate of 4.568 mills. 1. Public Comments Mayor Johnson opened the floor for public comments. No speaker reservation forms were received, therefore, the public hearing was closed. 2. Commissioners Comments — None E. Motion to Adopt the Tentative Millage Rate City Attorney Geller read the title of the ordinance. AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA, ESTABLISHING A TENTATIVE MILLAGE RATE of 4.950 MILLS FOR AD VALOREM TAXES FOR THE CITY OF OCOEE FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2023, AND ENDING SEPTEMBER 30, 2024; PROVIDING FOR MILLAGE ADJUSTMENT; PROVIDING FOR COLLECTION OF TAXES; PROVIDING FOR 8.36% INCREASE IN MILLAGE RATE OVER THE ROLLED -BACK RATE; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. Motion carried 4-0 with Commissioner Hart absent. F. Motion to Adopt the Tentative Budget City Attorney Geller read the title of the ordinance. AN ORDINANCE OF THE CITY OF OCOEE, ORANGE COUNTY, FLORIDA, ADOPTING A TENTATIVE BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2023, AND ENDING SEPTEMBER 30, 2024; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. Motion: Move that the Citv Commission adopt the tentative budqet as distributed alonq with the revisions resultinq from the Budqet Workshop and as amended at this Tentative Budqet Public Hearinq for the fiscal vear beqinninq October 1. 2023, and ending September 30, 2024, Moved by Commissioner Firstner, Seconded by Commissioner Kennedv. Motion carried 4-0 with Commissioner Hart absent. 31- Page 5 of 253 Tentative Budget Public Hearing September 13, 2023 Mayor Johnson announced the public hearing to consider the final millage rate, and final budget, is scheduled to be held Wednesday, September 20, 2023, at 6:00 PM in the City Hall Commission Chambers. The hearing has been advertised in accordance with the provisions of Section 200.065, Florida Statutes, and Section C-37 of Article VI of the Ocoee City Charter. The appropriate Ordinances necessary to adopt the Final Millage Rate and Final Budget will be prepared by City staff, and all other action necessary to comply with the requirements of Section 200.065, Florida Statutes, will be undertaken. -ADJOURNMENT The meeting was adjourned at 6:30 PM. The invocation was led by Commissioner Hart, followed by the Pledge of Allegiance to the Flag led by Mayor Johnson. City Clerk Sibbitt called the roll and declared a quorum present. Present: Mayor Johnson, Commissioner Kennedy, Commissioner Wilsen, Commissioner Firstner, Commissioner Hart Also Present: City Manager Frank, City Attorney Cookson, City Clerk Sibbitt • PRESENTATIONS AND PROCLAMATIONS Proclamation for September 2023 - 2023 Hispanic Heritage Month, proclaimed by Mayor Johnson. Fire Chief Jim White, Program Manager, Commission on Fire Accreditation International (CFAI), introduced himself and presented the Ocoee Fire Department with an Accreditation Plaque from the CFAI. He detailed the criteria linked to achieving this recognition. Ocoee Fire Chief Smoother expressed gratitude to the Elected Officials and Management for granting them the chance to complete the accreditation process and recognized several City Staff members for their diligent efforts to secure this award. The Commission applauded them for their outstanding achievement. • STAFF REPORTS AND AGENDA REVIEW - None • PUBLIC COMMENTS The following persons addressed the City Commission: Jim Moyer, Ocoee Resident, 1) Provided feedback on the modification of wording on Charter Review question #3, 2) Pointed out the absence of signage in the northern part of Ocoee, expressing concerns that visitors might not recognize they are in Ocoee, 3) Mentioned his recent appointment as Chair of the Human Relations Diversity Board (HRDB), 4) Expressed disagreement with the chosen date for celebrating Hispanic Heritage Month, and 5) Expressed a wish to see the City commemorate Veteran's Day on the actual day, not a weekday, to ensure a larger turnout. Mayor Johnson requested for the City to tackle the issue of signage citywide. Commissioner Hart stated that he had conversations with City staff concerning the Hispanic Heritage Month Event and emphasized that they are actively addressing this issue. Mayor Johnson expressed that the Community Relations Department should adopt a more proactive approach in planning upcoming events to ensure the City's proper celebration of them. Commissioner Kennedy conveyed a proposal to allocate additional funds in the Parks & Recreation budget for a Community Event Coordinator, which is to be voted on at the Final Budget Hearing. Commissioner Wilsen requested a copy of the HRDB guidelines to better understand the Board's role. Mayor Johnson addressed her request. Page 7 of 253 Regular City Commission Meeting September 19, 2023 - Bill Maxwell, Ocoee Resident, recalled a request he made about the waiving of the residency requirement for the Ocoee Police Officer's and Fire Fighter's Retirement Board. City Attorney Geller outlined the request and read Florida Statute 185.05 which prohibits the City from accommodating the request. Discussion ensued and City Attorney Geller addressed any further questions. - CONSENT AGENDA Consent Aqenda Motion Motion: Move to adopt the Consent Aqenda Item #1-13. (Utilities Director Croteau) -FIRST READING OF ORDINANCE - None -SECOND READING OF ORDINANCE — PUBLIC HEARING - None -PUBLIC HEARING 14. Howard Meadows Large Scale Preliminary Subdivision Plan (PSP) LS-2023- 016. (Zoning Manager Whitfield) Zoning Manager Whitfield presented a brief overview of the subject property which is located at 8708 A. D. Mims Road, on the south side, beginning approximately 160 feet west of Prairie Lake Boulevard. The property is approximately 2.25 acres, is currently vacant, and was recently annexed into the City and rezoned to City R-1AA. The applicant is proposing a six (6) lot residential subdivision on quarter (1/4) acre lots with one (1) stormwater tract and two (2) open space tracts. Zoning Manager Whitfield stated the Development Review Committee (DRC) reviewed this item and made a recommendation of approval subject to the following conditions: 1. Continuation of the utility easement along all lot fronts, and 2. Relocation of the water line from the utility easement within the lots to within the ROW between the sidewalk and roadway, and 3. Creation of open space tracts between Lots 1 and 6 (these tracts will also allow for utility, landscaping, and signage), and 4. Revision to Landscape Note that lot tree selection shall be from the Arbor Code. The public hearing was opened. Kim Fisher, attorney representing the applicant, introduced herself and expressed gratitude to the Staff for their cooperation. She offered to address any questions the Commission had. No questions were received. The public hearing was closed. Motion: Move to Approve the Howard Meadows Larqe Scale Preliminary Subdivision Plan WSPULS-2023-016), subject to the resolution of the DRC and staff comments; Moved by Commissioner Kennedv, seconded by Commissioner Hart; Motion carried 5- 0. 31 Page 9 of 253 Regular City Commission Meeting September 19, 2023 • REGULAR AGENDA 15. Discussion on Road Closures in the Downtown for Special Events Due to Downtown Infrastructure Work. (Development Services Director Rumer) Development Services Director Rumer detailed two significant projects scheduled to begin in October 2023 and continue until June 2024, which are aimed at enhancing the downtown infrastructure. He expressed apprehensions about these projects potentially leaving McKey Street as the sole east/west route connecting businesses at the heart of downtown; and further, requested that the Commission refrain from allowing any non -City -sponsored special events in the downtown area that necessitate road closures during the construction period. Development Services Director Rumer also disclosed a road closure request associated with an annual Christmas Party held in the Sleepy Harbour Subdivision which will be presented for their approval in the near future. Commissioner Kennedy inquired if staff had any knowledge of any requests for road closures in the affected area. Development Services Director Rumer addressed his question. Consensus of the Citv Commission was to approve a temporary hold on all Non -City Sponsored Special Event Permits that would require street closures in the Downtown Area. • COMMENTS FROM COMMISSIONERS Commissioner Kennedy — Commented on the following: 1) Announced that he is filing his Commissioner Report which will be available to the public. Commissioner Wilsen — Commented on the following: 1) Announced the transition of Spring Fling, into a new event called Spring into Conservation. 2) Acknowledged the success of the recent Shred -It event and shared plans to host the next Shred -It event in April 2024. 3) Inquired about celebrating the Town's 100th Anniversary during the Grand Opening of Unity Park. Additionally, she suggested that the City begin planning for the City's 100th Anniversary which is slated for 2025. Commissioner Kennedy conveyed his sentiments regarding the importance of not diminishing the current Unity Park Grand Opening Agenda. Discussion ensued about the tight schedule and the goal to recognize both the 100th Town Anniversary and the 100th City Anniversary. Consensus of the Citv Commission was to move forward with combininq the Grand Openinq of Unitv Park with the Town's 100th Anniversary celebration. 4) Noted a prior discussion they had regarding the inclusion of a report on discretionary funds on the Consent Agenda each month. City Manager Frank recalled the discussion and summarized its content. Commissioner Wilsen requested for the item to be presented before the Commission as a separate Agenda Item after the final budget has been officially approved. 41 IP . Page 10 of 253 Regular City Commission Meeting September 19, 2023 5) Asked about the available options for residents residing on Floral Street concerning the obligatory $7,500.00 sewer line connection fee. City Manager Frank outlined potential options. Commissioner Hart emphasized the importance of developing a plan for addressing such situations in the future. Mayor Johnson inquired about the authorization of the $7,500 fee. City Manager Frank clarified that it was established based on an approved Ordinance. Consensus of the City Commission was to have staff brinq back a plan to address the required sewer line connection fees. Commissioner Firstner — Commented on the following: 1) Congratulated the Fire Department for their CFAI accreditation. 2) Applauded the Fire Union Leadership and City staff for successfully negotiating the Union contract in a timely and professional manner. Commissioner Hart — Commented on the following: 1) Reiterated Commissioner Firstner's comments on the Union negotiations. 2) Encouraged patience within the community as the City continues to grow. 3) Pleaded with citizens to support and recognize our veterans. Briefing by Finance Director Director of Finance Roberts summarized the changes to the budget as requested by the City Commission during their Budget Workshop and Tentative Budget Hearing. She further announced the budget is balanced at 4.950 mills which is 8.36% increase in millage over the roll -back rate of 4.568 mills. The ad -valorem revenue generated at this rate will be used to provide City wide services such as public safety and parks and recreation. 1. Public Comments Mayor Johnson opened the floor for public comments. The following persons addressed the City Commission: - Jim Moyer, Ocoee Resident, asked if some of the funds for the Public Works Department could be earmarked for signage on the North side of the City. City Manager Frank addressed his concerns, and inquired from the City Commission on how they would like to proceed with signage. Mayor Johnson shared they can have staff look into this request and verify the area he is referring to, and if signage is needed. Page 12 of 253 Final Budget Public Hearing September 20, 2023 - Brad Lomneck, Ocoee Resident, voiced that instead of the additional funds that were placed in the Discretionary Fund for travel of spouse and items of that nature, if they could create a travel policy and place those funds in a separate line item for that type of request. Mayor Johnson agreed with his concerns and expressed his desire to return the resolution to its previous state before the recent amendment. Commissioner Wilsen voiced her disagreement regarding taxpayers covering the expenses of spouses' travel. Brief discussion ensued on travel of spouses and intended uses for Discretionary Funds. 2. Commissioners Comments — Discussion and amendments to the Budget, as reflected below. C. Amendments to Proposed Tentative Budget 1. Motion(s) on Amendments to the Adopted Tentative Budget Motion: Move to amend the tentative budqet of the Citv of Ocoee as follows: remove $25,000 from Discretionary Funds, to be reallocated back into the beginninq cash balance fund (Reserves), Moved by Commissioner Kennedy. Seconded bii Commissioner Hart. Motion passed 5-0. Commissioner Kennedy commented on the use of Discretionary Funds and his reporting on his Commissioner's Report to inform the public. He further shared that his spouse attends all conferences with him, and not having her able to attend is an inconvenience. He shared his support in updating the travel policy. Commissioner Wilsen shared that comments were made during the Regular City Commission Meeting about the lack of planning on City events; therefore, she is recommending they discuss placing funds in the budget for extra events the City Commission may be requesting. Discussion ensued on the planning and funding of events by the Community Relations Department. 2. Public Comments Mayor Johnson opened the floor for public comments. City Manager Frank addressed his question. Mayor Johnson inquired if there was still funding in the budget for the monument at Unity Park. Finance Director Roberts addressed his question. E. Adoption of Final Millage Rate City Attorney Geller announced the name of the taxing authority is the City of Ocoee. The rolled -back millage rate is 4.568 mills. The percentage by which the proposed millage rate exceeds the rolled -back rate is 8.36%. The millage rate proposed by the Ordinance is 4.950 mills. City Attorney Geller read the title of the ordinance.
