REGULAR CITY COMMISSION MEETING
-CALL TO ORDER 6:.5 P M
Mayor Johnson called the regular session to order at 6:15 PM in the Commission Chambers of
City Hall. The invocation was led by Commissioner Hart, followed by the Pledge of Allegiance
to the Flag led by Commissioner Firstner. City Clerk Sibbitt called the roll and declared a
quorum present.
Present: Mayor Johnson, Commissioner Kennedy, Commissioner Wilsen, Commissioner
Firstner, Commissioner Hart
Also Present: City Manager Frank, City Attorney Ardaman, City Clerk Sibbitt
-PRESENTATIONS AND PROCLAMATIONS 617 PM
2023 Week of the Family Proclamation, read and proclaimed by Mayor Johnson. Proclamation
presented to Victoria Laney, Representative with Week of the Family Organization. Victoria
Laney thanked the Commission for their support.
2023 Fire Prevention Month Proclamation, read by Commissioner Firstner and proclaimed by
Mayor Johnson. Proclamation presented to Deputy Fire Chief Van Camp and Fire Dept. staff.

-PUBLIC COMMENTS 25 PM
The following persons addressed the City Commission:
- Tom Lowery, Ocoee Resident, spoke about the challenge of combating veteran suicide
and shared a video that highlights Challenge 22, an organization committed to suicide
prevention. He encouraged the community to show their support by participating in the
Challenge 22 Walk scheduled in November.
- Jim Moyer, Ocoee Resident, reiterated previous concerns about signage on the 429 and
shared that he has spoken to several community leaders. Invited the public to attend Human
Relations Diversity Board meetings.
- Steven Hewitt, Winter Garden Resident, expressed concerns about the N. Lakewood
Avenue detour and inquired about the project's duration and expected completion date.
Development Services Director Rumer addressed his concerns and provided an update on
the project.

Motion: Move to adopt the Consent Agenda Items #1-15 with Items #3 and #4 being pulled
for separate consideration.
Moved by Commissioner Wilsen, seconded by Commissioner Hart; Motion carried 5-0.

1. Approval of Minutes from the Regular City Commission Meeting held October 3, 2023.

2. Approval of 2024 Orange County Supervisor of Elections Vote Processing Equipment Use
Agreement and Elections Services Contract for Municipal Elections. (City Clerk Sibbitt)
3. Assignment of Purchase and Sale Agreement for the Chevron Property to Montierre
Development, PLLC. (Assistant City Manager Shadrix)
4. Authorization to Transmit and Execute, subject to de minimis changes, a Brownfield Site
Rehabilitation Agreement (BSRA) between Chevron, the City of Ocoee, Montierre
Development PLLC, and the Florida Department of Environmental Protection (FDEP), with
Montierre named as the Responsible Party. (Assistant City Manager Shadrix)
Motion: Move to adopt the Consent Agenda Items #3 and #4 with the approval
contingent upon the review and approval by the City Manager or his designee of the
terms of conditions of the Assignment, Brownfield Site Rehabilitation Agreement,
and the insurance policy the City is to receive for this matter. Moved by
Commissioner Wilsen, seconded by Commissioner Hart; Motion carried 5-0
5. Approval of Utility Use and Indemnification Agreements for Ocoee Village Center PUD.

6. Approval of Two -Year Warranty Surety and Maintenance, Materials, and Workmanship
Escrow Agreement for Ocoee Village Center, Phase 1 Off -Site. (Development Engineer
Keaton)
7. Approval for Fire Department to Piggyback NAFECO Contract # 22 -7301 with Lake
County. (Deputy Fire Chief Van Camp)
8. Approval to Accept the Florida Firefighter Cancer Decontamination Equipment Grant for
the Purchase of Structural Firefighting Gloves. (Deputy Fire Chief Van Camp)
9. Approval of Educational Affiliation Agreement with Valencia College (Citywide). (Deputy
Fire Chief Van Camp)
10. Approval for Declaration of Surplus and Disposal of Assets from FY22/23 Annual
Inventory. (Finance Director Roberts)
11. Approval to Award RFQ #23-008 Continuing Contract for Transportation Planning

16. Second Reading of Ordinance for The Backyard Annexation & Rezoning from County A-
1 to City C-2 - AX-07-28-06 & RZ-23-07-06. (Zoning Manager Whitfield)
Development Services Director Rumer announced that due to an advertisement issue, this
item is being continued to the November 7t" Regular City Commission Meeting, and will be re -
advertised for that meeting date.
17. Second Reading of Ordinance for FY 2024 Budget Amendment. (Finance Director
Roberts)
City Attorney Ardaman read the title of the ordinance.
Finance Director Roberts explained the Fire Chiefs request to buy a ladder truck, which
would result in a cost savings of $1 million.
Mayor Johnson inquired about the cost. Finance Director Roberts addressed his question.
The public hearing was opened. As no one wished to speak, the public hearing was closed.
Motion: Move to adopt Ordinance No. 2023-20, Amending the FY 2024 Budget; moved
by Commissioner Firstner, seconded by Commissioner Kennedy; Motion carried
unanimously.
18. Second Reading of Ordinance Approving of Proposed Amendments to the City Charter to
be Placed on the 2024 General Election Ballot. (City Attorney Geller)
City Attorney Ardaman read the title of the ordinance.
The public hearing was opened. As no one wished to speak, the public hearing was closed.
Motion: Move to adopt Ordinance No. 2023-21, Approving the Proposed Amendments to
the City Charter to be placed on the 2024 General Election Ballot; Moved by
Commissioner Kennedy, Seconded by Commissioner Hart; Motion carried unanimously.

Commissioner Kennedy — Commented on the following:
1) Commented on the traffic on N. Lakewood Avenue and asked residents to be careful.
Commissioner Wilsen — Commented on the following:
1) Acknowledged that cooler weather draws people outdoors and encouraged drivers to reduce
their speed and remain attentive.
2) Announced Halloween Howl Night date, time, and location.
3) Announced the Veteran's Day Event date, time, and location.
Commissioner Firstner - None
Commissioner Hart — Commented on the following:
1) Shared the persistent question he has been receiving concerning the mysterious tree left
within the construction zone for the Clarke Rd widening project, and asked staff for an
explanation.
2) Emphasized the significance of family and community, expressing his joy in residing in a
community that not only celebrates both but also fosters unity.
3) Spoke about Veterans and PTSD, acknowledged the challenge, and urged the community to
come together to provide assistance and support to one another.
4) Urged citizens to exercise caution on October 31 st as the little ghosts and goblins trick -or -treat.
5) Discussed the upcoming charter review questions for the next election and urged residents to
thoroughly research and make informed votes to help shape Ocoee's future.
Mayor Johnson — Commented on the following:
1) Announced the Jolly Jamboree event date, relayed a request for a Christmas golf cart parade,
and informed that staff was actively working on a plan.
2) Shared that two separate organizations have expressed interest in hosting a local Farmer's
Market and explained his ongoing efforts to help establish an Ocoee Farmer's Market for the
community.
3) Encouraged residents to be mindful of speeding and inquired about the lighted stop sign for
McKey Street. City Manager Frank addressed his question.
4) Next City Commission meeting is scheduled for November 7, 2023.
