Background Summary:
The proposed sidewalk easement is intended to provide coverage over a new eight (8) foot sidewalk located
on the Northeast corner of the intersection at N. Lakewood Ave and Sable Run Way. The subject easement is
located in the Ocoee Village Center PD, between the newly constructed roundabout and Pond (Tract D-1).
The sidewalk had to be shifted two (2) feet out of the right of way during installation and onto the Ocoee
Village Center Common area property, therefore creating the need to provide an easement for public access.
Issue:
Should the Honorable Mayor and City Commissioners accept the Sidewalk Easement as provided by Ocoee
Village Center Development?
Recommendations:
Staff recommends the Honorable Mayor and City Commissioners approve and authorize the Mayor to execute
the Sidewalk Easement for the Ocoee Village Center development

SIDEWALK EASEMENT
THIS GRANT OF EASEMENT made this day of , 2023, by
OCOEE VILLAGE (SOUTH) PROPERTY OWNERS' ASSOCIATION, INC., a not -for -
profit corporation, whose mailing address is 5200 Vineland Rd, Suite 200, Orlando, FL 32811,
hereinafter referred to as the "POA" and the CITY OF OCOEE, a Florida municipal corporation,
hereinafter referred to as the "City".
WHEREAS, the POA, in consideration of the sum of $1.00 and other valuable
considerations, paid by the City, the receipt whereof is hereby acknowledged, does hereby give
and grant to the City and its assigns an easement for sidewalk purposes with full authority to enter
upon, construct, and maintain, as the City and its assigns may deem necessary, a paved sidewalk
upon the following described lands situated in Orange County aforesaid, to -wit:

TO HAVE AND TO HOLD said easement unto City and its assigns forever.
The City herein and its assigns shall have the right to clear and keep clear all trees and
other obstructions that may interfere with normal usage or maintenance of the paved sidewalk and
easement. The POA, successors and assigns, agree not to build, construct or create, nor permit
others to build, construct, or create any fence, wall or other structure on the herein granted
easement.
