Property Size: 1.65 acres Existing Future Land Use Designation: Low Density Residential Existing Zoning: R-1A Actual land use, proposed land use and unique features of the subject property: The property is currently vacant with no unique environmentally sensitive features. The property owner currently does not have a proposed use and only seeks to amend the FLUM designation and rezone the property to allow for commercial development in the future. However, based on the maximum development potential of the FLU designation, the current Low Density Residential (LDR) FLU designation would allow up to six (6) dwelling units. If the proposed Commercial FLU designation were approved, the property would be allowed a floor area ratio (FAR) of 3.0, which could yield up to 215,662 square feet of commercial land use. As the proposed C-2 zoning district is a conventional zoning classification, the development of the property will be required to comply with the requirements of the C-2 zoning district, in terms of permitted uses, building setbacks, building heights, maximum impervious surface area, etc., and with other Land Development Code (LDC) design requirements for commercial uses, including stormwater, parking, circulation, access, landscaping, buffering, etc. Special Overlays. The subject property is located within Sub -Area A of the Business Center Character Area of the State Road (SR) 429 Overlay District, adopted by Ordinance No. 2017-020 on July 18, 2017. Prior to the adoption of the Overlay, the City held three (3) public hearings on June 13, 20217 (Planning and Zoning Commission), June 20, 2017 (City Commission First Reading/Public Hearing), and July 18, 2017 (City Commission Second Reading. No citizens spoke in opposition to the proposed Overlay or raised concerns relative to transportation or impacts on residential uses within the Overlay area. The property owner's request to convert the property to Commercial with a C-2 zoning district is consistent with the intent of the Business Center Character Area to provide opportunities for office and retail uses in Sub -Area A. Wekiva Study Area. The subject property is in the Wekiva Study Area; however, based on the Figure 6.5 of the City of Ocoee Guide to the Wekiva Study Area Requirements, there are no karst features, Type A soils, sensitive natural habitats, or other protected features. Transportation. The property will continue to be accessed via Palm Drive, which has been approved for realignment at its intersection with Ocoee Apopka Road. The transportation network in this area, in terms of both capacity and circulation, will be improved with planned traffic improvements associated with the Florida Department of Transportation (FDOT) State Road 438/East Silver Star Road Complete Streets Project as well as planned project -related improvements north of this area. Furthermore, because of LDC requirements for minimum parking, circulation, landscape, buffer, and stormwater requirements, evaluation of traffic demands based on the maximum development potential for the proposed Commercial FLUM designation is not necessary. However, a traffic operations analysis may be required at time of site plan review when a development comes in for consideration by the City. Utilities. The property can be served by City water service, but sewer service is not available. At time of site plan review, the developer would need to coordinate with Ocoee Utilities for connection to sewer services or any needed upsizing of water service lines. City of Ocoee - 1 N. Recommendations: Development Review Committee (DRC) Recommendation: The DRC met on Tuesday, November 7, 2023, to consider the proposed Small -Scale Comprehensive Plan Future Land Use Map Amendment and associated Rezoning, and, identifying no issues, made a recommendation of approval to convert the property from Low Density Residential (LDR) to Commercial (COMM) and rezone the property from R-1A to C-2. Planning & Zoning Commission (PZC) Recommendation: The PZC considered this item at its Tuesday, November 14, 2023, public hearing and, identifying no issues, made a recommendation of approval for the proposed Small -Scale Comprehensive Plan Future Land Use Map Amendment and associated Rezoning to convert the property from Low Density Residential (LDR) to Commercial (COMM) and rezone it from R-1A to C-2. Staff Recommendation: Staff recommends that the Honorable Mayor and City Commissioners approve the proposed ordinances for a Small Scale Comprehensive Plan Future Land Use Map Amendment from Low Density Residential to Commercial and corresponding Rezoning from R-1A to C-2 for the Chinapen Property, assigned parcel ID number 18-22-28-0000-00-109. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. RECITALS. The foregoing recitals are hereby ratified and confirmed as true and correct and incorporated herein by this reference. SECTION 2. AUTHORITY. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapters 163 and 166, Florida Statutes. SECTION 3. COMPREHENSIVE PLAN AMENDMENT. The Future Land Use Map within the Future Land Use Element of the Ocoee Comprehensive Plan is hereby amended to change the future land use designation of the Subject Property, as particularly described in Exhibit "A" and depicted in Exhibit "B", from Low Density Residential (LDR) to Commercial (COMM). SECTION 4. COMPREHENSIVE PLAN. The City Clerk is hereby authorized and directed to revise the adopted Future Land Use Map of the City of Ocoee in order to incorporate the Comprehensive Plan Amendment enacted by this Ordinance. SECTION 5. CONFLICTING ORDINANCES. This ordinance prevails in the event of any inconsistency with all ordinances or parts of ordinances in conflict herewith. SECTION 6. SEVERABILITY. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 7. EFFECTIVE DATE. This Ordinance shall become effective thirty-one (31) days after adoption, unless challenged prior to that date pursuant to Section 163.3187(5), Florida Statutes. The Ocoee City Commission has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapters 163 and 166, Florida Statutes. SECTION 2. REZONING.
