ISSUE:
Should the Honorable Mayor and Commissioners permit the Villages of Wesmere townhomes to phase
construction of three of the five required on-site amenities?
DISCUSSION:
On March 22, 2006, the City Commission approved a Final Subdivision Plan for the Villages of Wesmere
Townhomes, located on the east side of Maguire Road, south of the Florida Turnpike. This Preliminary/Final
Subdivision Plan permitted the construction of 369 townhome units on 49.48 acres. In accordance with Section 6-
15 of the Land Development Code, the Preliminary/Final Subdivision Plan approval required the completion of
several required on-site amenities concurrent with the completion of the construction of infrastructure for the
subdivision. The on-site amenities required include a tennis court, playground area, pool and clubhouse,
basketball court, and volleyball court.
Recently, staff received a request from the developer to phase construction of several of the required on-site
amenities. The first request is to allow deferment of the completion of the tennis court, and playground prior to or
concurrent with the issuance of the 50th Certificate of Occupancy in the subdivision. The second request is to allow
deferment of the completion of the pool area and clubhouse prior to issuance of the 100th Certificate of Occupancy
in the subdivision.
The developer has previously received approval from staff for a phasing plan which will allow the project to be
developed in three phases. The amenities for this subdivision are intended for the entire development, and are not
specific to each individual phase. The subdivision was approved as a gated community, which will have private
roads and private amenities that will be owned and maintained by a homeowners association. The on-site
amenities are for the use of the residents only, not the public. The City Commission has granted several similar
requests in the past for other developers.
STAFF RECOMMENDATION:
Staff respectfully recommends that the Mayor and City Commissioners approve the request to phase construction
of the requested on-site amenities as outlined above.

Dear Sirs:
As we have previously discussed this letter will serve as our formal
request to phase the construction of the amenities in the Wesmere
townhome project. We would like to request the following:
1. We would request that the tennis courts, playgrounds be
completed on or before the issuance of the 50th Certificate of
Occupancy for the subdivision.
2. We would request that the pool area and clubhouse be completed
prior to the issuance of the Certificate of Occupancy for the
100th unit in the subdivision.
3. We would request that the landscaping to be completed in the
common area tracts located between the buildings be completed
simultaneously with the Certificate of Occupancy of the last
building located within the block in which the building is
being constructed.
We will also outline the proposed construction schedule for buildings to
be located within Phase 1 of this subdivision. Prior to the recording
of any subsequent phases we would submit a Phase Construction Schedule
for the buildings within that phase as well.
