Bluford Avenue Ocoee, Florida February 20, 2024 MINUTES 6:15 PM REGULAR CITY COMMISSION MEETING • CALL TO ORDER 6:16 PM Mayor Johnson called the regular session to order at 6:15 PM in the Commission Chambers of City Hall. The invocation was led by Commissioner Hart, followed by the Pledge of Allegiance to the Flag led by Brad Lomneck, Ocoee Resident. City Clerk Sibbitt called the roll and declared a quorum present. Present: Mayor Johnson, Commissioner Kennedy, Commissioner Wilsen, Commissioner Firstner, Commissioner Hart Also Present: City Manager Frank, City Attorney Geller, City Clerk Sibbitt • PRESENTATIONS AND PROCLAMATIONS - None • STAFF REPORTS AND AGENDA REVIEW 6:17 PM City Manager Frank announced the Emergency Item for the First Amendment to the Utility Use Agreement for the Ocoee Village Center, and advised that this agreement will allow the opening of Lakewood Avenue. Commissioner Wilsen questioned who would be responsible for the road. Assistant City Manager Shadrix responded to her inquiry and outlined the project's pertinent concerns that have led to the request for approval of the proposed agreement. Motion: Move to approve Emergency Item for the First Amendment to the Utility Use Agreement, and grant authorization for the City Manager to sign off on the Chipotle interior alteration permit. Additionally, authorize the City Manager and City Attorney to undertake any necessary actions concerning the sureties should the Consortium fail to sign the agreement. Moved by Commissioner Kennedy, seconded by Commissioner Wilsen; Motion carried unanimously. • PUBLIC COMMENTS 6:21 PM The following persons addressed the City Commission: - Jim Moyer, Ocoee Resident, spoke about the signage at the 429, and the lack of mention to I-4 or State Road 408. He voiced the need for better signage. - Norine Dworkin, Editor-in-Chief of VoxPopuli, announced that their election guide is currently available. She briefly highlighted the information that is available on the guide, and provided her website information. • CONSENT AGENDA 6:26 PM Consent Agenda Motion Motion: Move to adopt the Consent Agenda Item #1-5 with Item #3 being pulled for discussion and separate consideration. Moved by Commissioner Kennedy, seconded by Commissioner Hart; Motion carried 5- 0. Regular City Commission February 20, 2024 2 | Page 1. Approval of Minutes from the Regular City Commission Meeting held February 6, 2024. (City Clerk Sibbitt) 2. Approval of New Appointment to the Code Enforcement Board. (City Clerk Sibbitt) 3. Approval of Resolution Establishing Rules and Procedures for the City Commission. (City Attorney Geller) Commissioner Kennedy requested for City Attorney Geller to make a presentation on this item. City Attorney Geller summarized the proposed rules and procedures being considered and explained the need for these general principals. He informed the City Commission that they have the authority to adopt these rules and procedures in accordance with C-13 of the Charter. The floor was opened for members of the City Commission to comment. Motion: Move to approve Item #3 - Approval of Resolution 2024-04 Establishing Rules and Procedures for the City Commission. Moved by Commissioner Hart, seconded by Commissioner Kennedy; Motion carried 5-0. 4. Approval of Wynwood Phase 3 & 4 Final Subdivision Plan - LS-2023- 006. (Development Services Director Rumer) 5. Approval for the Carpet Replacement at Ocoee Police Department. (Acting Police Chief Ogburn) • FIRST READING OF ORDINANCE 6:39 PM 6. First Reading of Ordinance on City Commission Initiated Charter Amendments to Sections C-9, C-10, and C-17. (City Attorney Geller) City Attorney Geller explained the City Commission has two options on the initiated Charter Amendments, which are: (1) reconvene the Charter Review Commission to consider the recommended Charter amendments; or (2) conduct two readings and approve of one or all three of the proposed Charter amendments to Sections C-9, C-10, and C-17 of the City Charter. He further read the title of the ordinance. City Attorney Geller provided a brief overview of the issues stemming from a Circuit Court's Order, prompting the discussion on the proposed Charter amendments. Discussion ensued on the two options proposed, and members of the City Commission asked questions related to the timeline for the amendment questions being placed on the upcoming November ballot. Motion: Move to proceed with a Second Reading of Ordinance on City Commission Initiated Charter Amendments to Sections C-9, C-10, and C-17. Moved by Commissioner Wilsen, seconded by Commissioner Firstner; Motion carried 4-1 with Commissioner Hart opposing. First Reading of Ordinance Updating the City's Code of Ordinances Chapter 45, Arbor Code. (Development Services Director Rumer) Mayor Johnson commented that this ordinance should be shared with all Homeowner’s Associations. City Attorney Geller read the title of the ordinance, and it was announced this will be presented as a second reading and public hearing at the next scheduled City Commission meeting on March 5, 2024, at 6:15 PM or soon thereafter. 8. First Reading of Ordinance for FY 2024 Budget Amendment. (Finance Director Roberts) City Attorney Geller read the title of the ordinance, and it was announced this will be presented as a second reading and public hearing at the next scheduled City Commission meeting on March 5, 2024, at 6:15 PM or soon thereafter. 9. First Reading of Ordinance Amending the City of Ocoee Police Officer’s and Firefighters’ Retirement Trust Fund Section 27 – Deferred Retirement Option Plan. (Pension Board Attorney Herrera) City Attorney Geller read the title of the ordinance, and it was announced this will be presented as a second reading and public hearing at the next scheduled City Commission meeting on March 5, 2024, at 6:15 PM or soon thereafter. 10. First Reading of Ordinances for 440 Ocoee Apopka Road - Parrinello Property Annexation & Rezoning from County A-2 (Farmland Rural District) to City C-3 (General Commercial District); Project No(s). AX-10-23-07 & RZ-23-10-10. (Zoning Manager Whitfield) City Attorney Geller read the title of the ordinances, and it was announced this will be presented as a second reading and public hearing at the next scheduled City Commission meeting on March 5, 2024, at 6:15 PM or soon thereafter. 11. First Reading of Ordinance for Mansour Property Rezoning from R-1 (Single Family Dwelling District) to C-2 (Community Commercial District); Project No. RZ-23-12-11. (Zoning Manager Whitfield) City Attorney Geller read the title of the ordinance, and it was announced this will be presented as a second reading and public hearing at the next scheduled City Commission meeting on March 5, 2024, at 6:15 PM or soon thereafter. Delaware Street - West Property Small-Scale Comprehensive Plan Amendment from Public Facilities/Institutional to Low-Density Residential; Project No. CPA-2024-001. (Zoning Manager Whitfield) City Attorney Geller read the title of the ordinance, and it was announced this will be presented as a second reading and public hearing at the next scheduled City Commission meeting on March 5, 2024, at 6:15 PM or soon thereafter. 13. First Reading of Ordinance for Annual Comprehensive Plan Text Amendment to Adopt Five-Year Schedule of Capital Improvements and Update the Capital Improvement Element (CIE); Project No. CPA-2023-003. (Zoning Manager Whitfield) City Attorney Geller read the title of the ordinance, and it was announced this will be presented as a second reading and public hearing at the next scheduled City Commission meeting on March 5, 2024, at 6:15 PM or soon thereafter. • SECOND READING OF ORDINANCE – PUBLIC HEARING - None • PUBLIC HEARING - None • REGULAR AGENDA 7:03 PM 14. Discussion and Direction for Installation of School Zone Speed Enforcement Cameras. (Acting Police Chief Ogburn) Acting Police Chief Ogburn explained the item before them is for discussion and direction for the installation of school zone speed enforcement cameras within school zones in the City, preferably in the school zone area on Clarke Road. Commissioner Kennedy asked if this was a pilot program. Acting Police Chief Ogburn stated that the proposal is to commence with Clarke Road due to its high velocity traffic flow. Commissioner Wilsen expressed that this measure was enacted by the legislature and emphasized the importance of public awareness. Additionally, inquired about the specific fine amounts associated with the regulation. Acting Police Chief Ogburn stated he can bring back information related to the fines. City Manager Frank expounded on the renewal of the traffic enforcement agreement, which includes the potential addition of school zone enforcement cameras. He noted that if the City Commission supports the proposal, it would need to be presented as an ordinance at a later date. Brief discussion ensued regarding the proposed pilot program and associated fines. Members of the City Commission expressed the need for more data such as a study to warrant the need for the enforcement cameras. Brief discussion ensued about relocating the speed radar signs currently placed in different areas in the City. A representative from Verra Mobility addressed questions from the City Commission related to fines and conducting a speed study. It was decided to bring this back to a future meeting for discussion, after a study is conducted. Regular City Commission February 20, 2024 5 | Page 15. Discussion and Direction for Sleepy Harbour Golf Cart Community Designation Request. (Acting Police Chief Ogburn) Acting Police Chief Ogburn clarified that this matter was raised at the request of Commissioner Wilsen and emphasized the need for clarification regarding whether the request originated from an individual resident or the Homeowners Association (HOA). City Manager Frank provided additional context on how previous requests were initiated before the installation of signs are placed designating a subdivision as a golf cart community. Commissioner Wilsen shared it was a request from an individual but she can go before the Sleepy Harbour HOA to inquire if they support the golf cart community designation. Commissioner Kennedy shared his views on the need to review the golf cart community ordinance as he feels it needs to be revised, and not be regulated by the City. Brief discussion followed regarding the potential designation of areas near downtown Ocoee as a golf cart community, which may involve reducing the speed limit. Brad Lomneck, Ocoee Resident, highlighted discrepancies within the ordinance due to recent changes in Florida Statutes. Additionally, expressed concerns about individual subdivisions seeking golf cart designation, as neighboring homes may also desire similar benefits. • COMMENTS FROM COMMISSIONERS 7:28 PM Commissioner Kennedy – No further comments Mayor Johnson – Commented on the following: 1) Announced the date of the General Election, provided early voting dates, shared polling location details, and informed attendees that this information is available on the City's website. 2) Announced the Woman’s Club of Ocoee Political Forum date, time, and location. Commissioner Wilsen – Commented on the following: 1) Announced the Spring into Conservation event. 2) Announced the Shred to Protect event. 3) Shared she has received many concerns on Charter Amendments, specifically Question #1 and asked City Attorney Geller to please explain that amendment. She further shared information on the Charter Amendments can be found on the City’s website. Commissioner Firstner – Commented on the following: 1) Announced the Neighborhood Matching Grant Program is now open; there is $28,000 available within the grant, with a maximum of $2,000 per community. The deadline for application submittal is March 15th. Commissioner Hart – Commented on the following: 1) Shared the recent passing of a dear friend who was a resident of Ocoee. 2) Shared what Black History Month means to him.
