HomeMy WebLinkAbout06-26-2007 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING JUNE 26, 2007 CALL TO ORDER Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order at 7:00 p.m. in the Commission Chambers at City Hall. Member Hopper led the Invocation and Member Ballard led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Godek, Vice-Chair Chancey, Members Ballard, M. Godek, Hopper, Morton, Stanley and Alternate Member Lowery. Also present were Code Enforcement Supervisor Loeffler, Code Enforcement Officer Siegrist, Code Enforcement Officer Rodriguez, Division Chief Stanley, Permitting Clerk Everett, Attorney Sneed, and Records Coordinator Rittenhouse. ABSENT: GUESTS: None. Permitting Clerk Everett administered the oath to Code Enforcement Officer Loeffler, Code Enforcement Officer Siegrist, Code Enforcement Officer Rodriguez, Division Chief Stanley and anyone intending to speak regarding a case. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. Division Chief Stanley gave a detailed history of the case and provided exhibits. The property was re-inspected on June 4, 2007 and found in compliance. They requested an administrative cost recovery of$107.88. John Russell, Manager, stated that he took over the office on May 5, 2007 and was unaware of any violations or inspections. He wasn't made aware of the issue until May 21 st when the Fire Dept. came back to re-inspect the location. As soon as he was made aware of the situation he had it taken care of on May 23,2007. Mr. Russell stated that he called in and left a message for the location to be re-inspected. Apparently, that message did not make it to the right person. He stated that it may have been his fault for not following up, but it was in compliance as of May 25th as required. Division Chief Stanley stated that he called the correct number. He was unsure what happened. Vice-Chair Chancey inquired about the violation cited. Division Chief Stanley stated that this violation is part of many codes. Attorney Sneed stated that the Notice of Violation was for NFPA 10. She also stated that since the compliance date was May 25,2007, and there is testimony that he was in compliance before then and the City said they weren't, the board needs to make a decision on that. Member M. Godek stated that they shouldn't really be in compliance until the City says they are. If he does something wrong and says he fixed it two months ago, that doesn't stand up unless he follows proper procedure. Attorney Sneed stated that the board needs to look at the testimony provided and make a decision based on what they heard. Division Chief Stanley stated that they were notified on June 4th that they were in compliance. At that time the inspector went out and determined that they were in compliance. Mr. Russell stated that he has the documentation stating that he had the problem resolved on Page 3 of 13 Code Enforcement Board Minutes June 26, 2007 May 23,2007. Member Hopper stated that the fine is for administrative cost and not saying that he did something wrong. Division Chief Stanley stated that he explained that to Mr. Russell and he understood. Attorney Sneed asked if the board finds substantial evidence to support that they were in compliance before the required date. Division Chief Stanley stated that if Mr. Russell has documentation that supports that he had the work done by May 23rd, they would have no problem waiving the administrative cost. Division Chief Stanley reviewed the documentation and stated that it did verify that the extinguisher was certified on May 23, 2007. Vice Chair Chancev. seconded bv Member HODDer. moved in Case No. 07-086F to find the respondent in compliance as o( May 23, 2007, with no fine assessed at this time. Motion carried 5-1, with Member M. Godek opposed. Case No. 07-023 - Sun Body Tanning Salon 8821 W. Division Chief Stanley gave a brief history of the case and provided exhibits. The business was re-inspected on June 14, 2007 and found to be in compliance on that date. They are requesting an administrative cost recovery fee of $1 07.3 7. Member Hopper inquired as to why they were requesting a fee. Division Chief Stanley stated that this case was from last month. At the previous meeting there was some confusion with the respondent. Division Chief Stanley stated that they are in compliance as of May 23, 2007. They are requesting administrative cost of$112.34. Officer Rodriguez Officer Rodriguez gave a detailed history of the case and provided exhibits. She further stated the respondent remained in non-compliance. Officer Loeffler stated that this property has been a habitual problem for the Home Owners Association. He added that the ownership has changed and he has since contacted the mortgage company. He added that no one is residing at the home and the water and electricity have been turned off. He also added that the City requests that the Code Enforcement Board ask that the City or contracted agent mow the property in the case that that resident does not Page 5 of 13 Code Enforcement Board Minutes June 26, 2007 comply with the request. Member Ballard stated that if that were the case, it could be moved one time and then within a couple weeks be overgrown again. Officer Loeffler stated that could be and they may have to start action all over again or it could be a foreclosure. Attorney Sneed stated that a compliance date could be set, start a fine and then once the compliance date has come and passed, have the City mow and place a lien on the property for the costs inquired to do such mowing. Member Morton inquired how costly it would be for the City to mow the property. Officer Loeffler stated that he was not sure if the City would be willing to mow the property otherwise they would have to contact with a lawn company. Member Stanley asked if they could lien for a flat amount or does the amount have to be specific to how much it actually costs. Member Chancev. seconded bv Member Morton. moved in Case No. 07-040 to find the respondent in violation as cited as of April 4. 2007. and be $liven until Julv 2. 2007. to come into compliance or be fined $250/ a day thereafter. and also authorize the Citv to bring the property into compliance after Julv 2, 2007. and assess the costs to do so to the property. New canopy structure with metal roof and wall on northwest side of the building. Officer Siegrist gave a detailed history of the case and provided exhibits. An application for permit was submitted and as of June 26, 2007, the property remains non-complaint. He further stated that it has been denied twice, once by planning and the 2nd by building. Comments have gone back to the property owner. Officer Siegrist went over some of the issues that need to be addressed. Trees had already been cut down when observed and photographed. Officer Loeffler gave a detailed history of the case and provided exhibits. He further added that as of to day's date, the property is in compliance. The property owners replaced the trees and in doing so received the needed permits. Attorney Sneed stated that even though they complied, it is still an irreparable violation. Officer Loeffler stated that the City is very satisfied with the compliance as it was received. Godek, moved in Case No. 07-066 to find the respondent in violation as cited as of June 26, 2007, and in compliance as of June 26, 2007, with no fine bein$l assessed at this time. Officer Rodriguez gave a detailed history of the case and provided exhibits. She further added that as of to day's date, the property remains in non-compliance. Member Morton clarified that the property owner is allowed 24 inches of growth due to it being unimproved property. Officer Rodriguez stated that the property is in a neighborhood, but the lot is not developed. Officer Rodriguez stated that this was a complaint. Officer Loeffler gave a detailed history of the case and provided exhibits. Officer Loeffler added that one of the compliance requirements was that the company determined an appropriate system to dispose of the adhesive substance. They came up with a system to filter the substance through the soil and grass which is approved by the need regulations. The storm water pond has been cleared and opened. It still needs a higher bank and requires some more sod. Officer Loeffler stated that staff is requesting an additional 30-day compliance period to get the storm water pond into its needed state. Member M. Site Plan required landscaping and landscaping maintenance has been neglected and abandoned. Required plant types and landscaping dead and missing. Irrigation not operable. Property not maintained with overgrown tall weeds and vegetation. Property is a nuisance and an eye sore impacting the economic vitality of the Highway 50 commercial and retail corridor. Current plant-life and landscape damage and neglect. Current condition and appearance are irreparable and/or irreversible in nature and warrant expedited presentation at June 7 CEB Public Hearing date. Additionally, main signage on Highway 50 has missing panels with exposed interior components further contributing to the blighted appearance, conditions and impact. Officer Loeffler gave a detailed history of the case and provided exhibits. As of June 15, 2007 the property was in partial compliance. The only remaining issue is the covering face panels for the main signage. COMMENTS Officer Loeffler stated that he did not have any statistics due to the case load. He thanked the citizens for their compliance and thanked the board for their patience. He added that he and Officer Siegrist attended a training conference in Jacksonville. He stated that the City of Ocoee was acknowledged regarding their minimum housing standards. Officer Loeffler also announced that Officer Ramos is now Officer Delgado. Chairman Godek congratulated Officer Delgado. Division Chief Stanley introduced his assistant, Bridgett Ballard to the Board. Vice-Chair Chancey thanked the board for their vote of confidence. Member Morton stated that he has been informing people that a vacant lot can have up to 24 inches of grass. But he will change his answers to include information regarding the 500 ft.
