Subject: Approval of a Two-Year Warranty Surety and Maintenance, Materials, and
Workmanship Agreement for Lake Lilly Apartments Private Access Road (Public Right of Way
Portion). (Development Engineer Keaton)
Background Summary:
Lake Lilly Private Access Road Begins at the roundabout on S. Bluford Ave, just south of the intersection at
Old Winter Garden Rd and S. Bluford. The roadways consist of all public Rights of Way on South Bluford Ave
from the intersection of Old Winter Garden Rd and S. Bluford to the roundabout and from the private access
entrance to phase 6 of the Alibi (Lake Lilly) Apartments. The developer has completed the construction of the
infrastructure improvements and has requested a Certificate of Completion. The infrastructure improvements
include road work, a stormwater collection system, and associated landscaping. All identified punch list repairs
have been completed, and the developer is ready to start the two-year warranty period for the public
improvements.
As a requirement of the Land Development Code, the developer is required to furnish the City with a Surety to
cover any possible damages discovered during the next two years. Should the developer not choose to make
those repairs, Lake Lilly Apartments LLC, has provided the City with an Escrow fund in the amount of 10% of
the constructed improvements. The surety amount is a total of $4,571.89 in the form of a check. The attached
Maintenance, Materials, and Workmanship Agreement (Form 8 from the Land Development Code) acts as the
executable document between the developer and the City. The Surety will be returned to the developer upon
completion of the two-year warranty period and the repair of any damages caused over those two years.
Issue:
Should the Honorable Mayor and City Commissioners accept the Surety as provided by Lake Lilly Apartments
LLC, for the two-year warranty for the Public ROW portion of the Lake Lilly Apartments Private Access Road
and execute the Maintenance, Materials, and Workmanship Agreement?
Recommendations:
The Development Services Department recommends the Honorable Mayor and City Commissioners approve
the Surety and the execution of the Maintenance, Materials, and Workmanship Agreement with Lake Lilly
Apartments LLC, for the Public ROW portion of the Lake Lilly Apartments Private Access Road.
