Fowler called the Code Enforcement Special Magistrate Hearing to order at 11:02 a.m. in the Commission Chambers of City Hall, located at I North Bluford Ave, Ocoee, Florida. SWEARING |NK}FWITNESSES Code Enforcement Clerk Justin Mieras administered the oath to the Code Enforcement Officers and to anyone intending tospeak regarding mcase presented today. | DFRCERRODRIGUEZ | 94O1VVCOLONIAL DR | WEST OAKS MALL FLLLC | Violation Cited: §150-20�� Summary: Discharge of polluting matter in natural waters or stormwater management systems is prohibited. Polluting matter includes, but is not limited to Petroleum products such as oil, gasoline and grease. Observation: Draining waste (gneae)into the stormwetersystem Officer Rodriguez presented the case and gave its history. She further explained that as of April 18, 2024, the property is in compliance, The City asked to find the property in Violation as of March 20th , 2024, and 15 days to address the tenant. Henry Manwill Operations Manager of West Oaks Mall explained they observed a tenant, Jerkman Chicken, dumping oil in a City storm drain weekly, The mall has scheduled a deep cleaning of the affected drains on April 22nd 2024,and plans toevict the tenant. Special Magistrate James A. Fowler ordered that in Case in #2024-00766 the respondent be found in violation as cited as , 2024, and is compliant as of April 18, 2024. The respondent is to address the violation of the tenant, Jerkman Chicken, within 15 days or fines will be assessed against the propertZ at the MaZ 16, 2024, Special Magistrate meeting. Violation Cited: §108-34.A.&C. A. All parts of the premises under the control of the owner or operator shall be kept in a clean and satisfactory condition, and the occupant shall refrain from performing any acts which would render other parts of the premises unclean or unsanitary or which would obstruct the owner or operator from performing any duty required hereunder or maintaining the premises in a clean and sanitary condition. C. Every owner and operator shall be responsible for repairing damage to any part of the premises. Observation: Broken light pole in the premises, inclining tothe street atOcoee Hills. Officer Rodriguez presented the case and gave its history. She further explained that as of April18,2024 the property b day until the property comes into compliance. �=l Special Magistrate James A. Fowler ordered that in Case in #2024-00524, the respondent be found in violation as cited as of March 08, 2024, and be given until April 28, 2024, to come into compliance or be Lined $200.00 per day until found in compliance.
