Chair Lomneck called the regular session to order at 6:30 PM in the Commission Chambers
of City Hall. The invocation was led by Chair Lomneck, followed by the Pledge of Allegiance
to the Flag. Recording Clerk Justice called the roll and declared a quorum present.

Commercial); Project No(s). CPA-2024-005 & RZ-24-03-04 (Development Services
Director Rumer)
Development Services Director Rumer presented a brief overview of the subject parcel.
The property is currently vacant and located in an area that is transitioning to commercial;
therefore, the property owner wishes to reclassify the future land use from Low Density
Residential (LDR) to Commercial (COMM) and rezone it from R-1AA (Single-Family Dwelling
District) to C-2 (Community Commercial). There is no proposed use at this time.
Vice-Chair Forges inquired what the property at the northwest corner of Bluford Avenue and
Silver Star Road is zoned. Development Services Director Rumer addressed his question.

3. Amendment to the Ocoee Land Development Code (LDC) Pertaining to Part IA, Article
VII, Floodplain Management (Zoning Manager Whitfield)
Development Services Director Rumer briefly explained National Flood Insurance
Program (NFIP) Community Rating System (CRS), which provides discounts on the cost of
flood insurance premiums for NFIP policyholders, depending on the Rate Class awarded to
the local government. He further introduced Staff Engineer Burch and GIS Analyst
Martinez, and explained that City staff is working to improve the rating score.
Zoning Manager Whitfield, along with Staff Engineer Burch and Development Services
Director Rumer detailed the activities that City staff has undertaken over the past two years
to qualify the City to participate in the CRS, and that the City was awarded admittance to the
program in December. Proposed changes to the LDC in conjunction with entry into the
program are in an effort to improve the City’s rating score, which will in turn lead to greater
flood insurance cost savings. The points system was further explained, as well as the cost of
compliance, the 500-year floodplain, and critical facilities.

Development Services Director Rumer updated the Board with the following:
The pickleball facility was denied by City Commission
Gardenia Pointe was continued to the May 21st Commission Meeting
Vice Chair Forges inquired about if the pickleball project would return. Development
Services Director Rumer addressed his question.
Chair Lomneck inquired about City Center West Orange and reopening Maine Street.
Development Services Director Rumer addressed his question. Discussion ensued.
Member Keller thanked Development Services Director Rumer for the Planning classes
and inquired about a group membership for the Planning and Zoning Commission.
Discussion ensued.
Chair Lomneck thanked Member Williams for her service and long tenure on the Planning
and Zoning Commission, and thanked Member Crocker for his completion of a term.
Member Williams shared a message of gratitude for her time on the Planning and Zoning
Commission.
Member Crocker thanked everyone for the opportunity to participate on the Planning and
Zoning Commission.

Owner/Applicant: The property is owned by GW Real Estates LLC, represented by Larry Gaboury, and the applicant
is Goodwill Industries of Central Florida.
Site Location: The property is within Commission District 1 and is generally located on the north side of Fountains
West Boulevard, approximately 342 feet north of West Road.
Property Size & Parcel Identification Number: The property consists of 3.04 acres and is assigned parcel ID number
06-22-28-2863-01-0000.

Proposed Development: The applicant is requesting an amendment to the 2nd Amendment to Lot 8 of the Fountains
West PUD in order to increase the maximum building square footage for retail from 18,000 SF to 24,932 SF for the
construction of a Goodwill Retail Store. No other changes are proposed relative to the PUD Land Use Plan or
Conditions of Approval.

Transportation and Access: The subject property is within one (1) mile of several corridors, including Fountains
West Boulevard, West Road, Clarcona Ocoee Road, and Ocoee Apopka Road. Based on the transportation
analysis in 2018 prepared for the 1st Substantial Amendment to Lot 8, Lot 8 had 519 daily trips and 38 PM Peak
Hour Trips allotted to it. This transportation analysis further stated that, as a condition of approval for the mini-
warehouse/self-storage development (phase 1 of the Lot 8 Substantial Amendment, "impacts from any development
beyond the mini-warehouse should be assessed with a traffic impact study and mitigated for as appropriate". Of the
519 daily trips available at that time, the self-storage development used 155 daily trips and 17 PM Peak Hour Trips,
leaving 364 daily and 21 PM Peak Hour Trips for Lot 8. Since that time, Lot 8 has been split into multiple lots. The
Goodwill development is on Lot 1 of that certain Fountains West Commons Replat. Using the ITE Code 814 (11th
edition) for a Variety Store, which is a more conservative (higher trip rate) than a discount store or retail strip center,
the 18,000 SF of retail approved in 2018 could generate approximately 1,146 daily trips. The proposed 24,932 SF
retail (increase in retail square footage of 6,932 SF) could generate a total of 1,587 daily trips (a net difference of
441 daily trips). The proposed project trips (1,587 daily) minus the vested trips (364 daily) yields a net increase of
1,223 daily trips. Adding 100% of these trips (without accounting for any trip distribution or trip-capture along the
various segments and intersections) to the existing 2023 "background plus vested trips" data in the City's current
Concurrency Management System (CMS) for all segments showed that no segments are anticipated to operate
below the adopted levels of service standard for each of the respective roadway segments.

Per the previous condition of approval for Lot 8 Amendment, the applicant will be required to remit payment of their

proportionate share of the cost of the installation of the traffic signal at the intersection of Fountains West Boulevard
and West Road using the methodology previously approved in 2018 prior to the issuance of a site work permit.
Utilities: The Utilities Department did not identify any concerns.
Stormwater: A storm water facility has been constructed within Lot 8 as part of the self-storage facility and will
accommodate drainage from this development. Per the approved Land Use Plan for Lot 8, development of the
subject property must comply with the approved 70% maximum impervious surface area.

ISSUE:
Should the Planning and Zoning Commission, acting as the Local Planning Agency, make a recommendation of
approval for the proposed 2nd Substantial Amendment to Lot 8 of the Fountains West PUD to increase the
maximum building square footage for retail from 18,000 SF to 24,932 SF on the property assigned parcel ID
number 06-22-28-2863-01-0000 for purposes of constructing a Goodwill Retail Store?
RECOMMENDATIONS:
Development Review Committee (DRC) Recommendation:
The DRC met on this item on May 7, 2024. Following discussion regarding how the Goodwill Store will manage
garbage/solid waste on the site, the DRC made a recommendation of approval of the 2nd Substantial Amendment
to Lot 8 of the Fountains West PUD subject to the condition that, at the time of site plan review, the applicant
provides documentation to support not having on-site dumpster facility to serve the use.
Staff Recommendation:
Staff recommends that the Planning and Zoning Commission, acting as the Local Planning Agency, make a
recommendation of approval of the 2nd Substantial Amendment to Lot 8 of the Fountains West PUD to increase the
maximum building square footage for retail from 18,000 SF to 24,932 SF on the property assigned parcel ID
number 06-22-28-2863-01-0000 for purposes of constructing a Goodwill Retail Store subject to the following
conditions:
1. At the time of site plan review, the applicant shall provide documentation to support not having on-site
dumpster facility to serve the use, and
2. Prior to the issuance of a site work permit, the applicant shall remit payment for their proportionate fair share
of the cost of installation of the traffic signal at the intersection of Fountains West Boulevard and West Road.

Development Review Committee (“DRC”) on May 7, 2024; and
WHEREAS, the DRC recommended approval of said Amendment; and
WHEREAS, the Amendment was scheduled for study and recommendation by the
Planning and Zoning Commission of the City of Ocoee ("P&Z");

WHEREAS, on June 11, 2024, the P&Z held an advertised public hearing on the
Amendment and, after discussion, recommended approval; and
WHEREAS, on July 16, 2024, the Ocoee City Commission has held an advertised
de novo public hearing with respect to the proposed 2nd Substantial Amendment and this Ordinance
and determined that the Amendment to the PUD to increase the building square footage for retail
use from 18,000 square feet to 24,932 square feet and this Ordinance are consistent with the City of
Ocoee Comprehensive Plan, as amended; and
WHEREAS, this Ordinance has been considered by the Ocoee City Commission in
accordance with the procedures set forth in Section 166.041(3), Florida Statutes.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION 1. Authority. The City Commission of the City of Ocoee has the
authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida
and Chapter 166, Florida Statutes.
SECTION 2. Amendment to PUD. The Amended PUD, prepared by The
S/L/AM Collaborative, dated May 3, 2024, with such additional revisions thereto, if any, as may be
reflected in the minutes of the City Commission of the City of Ocoee meeting approving same, is
hereby approved. The Amended PUD is attached hereto as Exhibit “A”, and by this reference
made a part hereof. As described therein, the Amended PUD amends the previously approved PUD
for Fountains West PUD. All references to the PUD or the Amended PUD for Fountains West PUD
shall hereafter refer to the previously approved PUD for Fountains West PUD as amended by the
attached Amended PUD.

SECTION 3. Ocoee Comprehensive Plan. The Ocoee City Commission
hereby finds that this Ordinance is consistent with the Ocoee Comprehensive Plan.
SECTION 4.CONFLICTING ORDINANCES. This ordinance prevails in
the event of any inconsistency with all ordinances or parts of ordinances in conflict herewith.
SECTION 5. Severability. If any section, subsection, sentence, clause,
phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any
court of competent jurisdiction, such portion shall be deemed a separate, distinct, and
independent provision and such holding shall not affect the validity of the remaining portion
hereto.
SECTION 6. Effective Date. This Ordinance shall become effective ten (10)
days after its passage and adoption.
