of City Hall. The invocation was led by Chair Lomneck, followed by the Pledge of Allegiance

City Attorney Geller presented an overview of Sunshine Law, Public Records, and Quasi -
Judicial proceedings while addressing questions from the Board.
• DISCUSSION
1. Status of 2045 Comprehensive Plan Update (Zoning Manager Whitfield)
Zoning Manager Whitfield presented a brief overview of the Comprehensive Plan, as
required by Section 163.3177, Florida Statutes, which is implemented through goals,
objectives, and policies (GOPs). She explained that the City is working on its 2045
Comprehensive Plan update and proposes reorganizing the requisite Comprehensive Plan
elements into the following chapters to facilitate implementing such GOPs:
• Introduction
• Vibrant, Attractive & Inclusive Community
• Efficient, Reliable & Well -Maintained Infrastructure
• Safe & Convenient Mobility
• Environment -Friendly, Resilient & Sustainable Community
• Responsible, Accessible & Open Governance
• Appendix
Zoning Manager Whitfield requested consideration and feedback on the presented draft
goals and objectives. She, along with Acting Assistant City Manager Rumer and Acting
Development Services Director Corless, addressed the Board's questions and comments.

1. Project Status Report
Acting Assistant City Manager Rumer inquired if the Board had any questions regarding
current development within the City, and accordingly updated the Board with the following:
• The Regency mixed -use project on the west side of Maguire Road at the
intersection of Old Winter Garden Road is moving forward pending a
preconstruction meeting
• The warehouse building at 626 S. Bluford is finalized
• Hampton Inn on S.R. 50 is finalized
• Cambria Suites at Ocoee should begin construction soon
• There are no new developments regarding City Center West Orange

The proposed Land Use Plan also incorporates the recommendations from the Healthy West Orange Trails
Connection Trailside Development Design and Policy Guidelines relative to buffering, screening, and protecting the
trail from development, as well as promoting trail integration and activation. The proposed Land Use Plan and
development will provide a shaded and landscaped park/picnic area (with a sidewalk built to the property line) that is
open to the public, including trail patrons, should Orange County provide or permit a path from the West Orange
Trail to this development's proposed sidewalk.
Consistency with Florida Statutes: N/A
Consistency with JPA Agreement: N/A
Consistency with Adopted Comprehensive Plan: The proposed Future Land Use Map amendment and rezoning are
consistent with the adopted 2002 Comprehensive Plan based on the following findings:
• Future Land Use Element VII.F: Commercial uses within this designation "shall be confined to certain arterial
and collector roadways". Section 6-14C(1)(d), LDC, designates Clarcona Ocoee Road as a primary road,
similar to Clarke Road, Apopka Vineland Road and Silver Star Road.
• Future Land Use Element IX.E., states "Neighborhood commercial uses are anticipated in the Clarke
Road/Clarcona Ocoee Road area to serve the existing and proposed residential development."
• FLUE Policy 1.6: "The City shall control strip commercial development through access limitations by
restricting commercial land uses to intersections of arterial and non-residential collector roads, along
designated arterial and collector roads and within Planned Unit Developments."
• FLUE Policy 7.2: "The City shall permit only low intensity office and low intensity commercial development
adjacent to residential areas except where well buffered." Per the proposed Land Use Plan, the proposed
intensity, or FAR, is 0.12, which is well below the allowable maximum of 3.0 FAR. Additionally, the Land
Use Plan proposes a wider landscape buffer, supplemented by additional landscaping, along the
development area facing the trail and residential uses west of the trail.
• FLUE Policy 7.7.1: The proposed development will provide the minimum 35% open space required within
the Wekiva Protection Area due to the presence of Type A soils, which is indicative of effective recharge
areas.
Access: Access will be from Clarcona Ocoee Road via a full -access driveway at the more easterly side of the
development. The applicant's engineer has indicated that the proposed driveway location has been selected in
coordination with Orange County. Additionally, in response to a comment from the Fire Department, an emergency
services access driveway is proposed at the westerly end of the development and will be signed accordingly. Two
(2) pedestrian walkways are proposed for connectivity to Clarcona Ocoee Road, and one (1) sidewalk connecting
the subject development to the West Orange Trail property line.
Transportation: As the request is for a Future Land Use Map amendment and rezoning to PUD, which requires an
accompanying Land Use Plan, the applicant was asked to provide a Traffic Impact Analysis (TIA) based on both the

maximum development potential at a 3.0 FAR under the Commercial FLU designation (based on 70% of total land
area, as a minimum 35% is required to be set aside as open space) and the proposed 23,052 SF of commercial
uses, using the City's approved traffic methodology.
City Road segments evaluated included Clarcona Ocoee Road from Lakewood Avenue to Apopka Vineland Road (3
segments), Clarke Road from A D Mims to Clarcona Ocoee Road (2 segments), Hackney Prairie Road from Clarke
Road to Apopka Vineland Road (1 segment), and Ingram Road from Clarcona Ocoee Road to McCormick Road (1
segment). Segments of McCormick Road and Apopka Vineland Road (County facilities) were also evaluated for
significance, in accordance with the approved methodology. Intersections evaluated included Clarcona Ocoee
Road at Clarke Road (signalized), Clarcona Ocoee Road at Grapevine Crest (unsignalized), Clarcona Ocoee Road
at Apopka Vineland Road/CR 435 (signalized) and Clarcona Ocoee Road at Project Access driveway
(unsignalized). Both TIA documents showed that neither the CPA nor the LUP/development program would cause
the area roadways and intersections to operate below the adopted level of service standard.
Additionally, a review of warrants for a left and right turn deceleration lane on Clarcona Ocoee Road at the project
full access driveway was conducted to determine if auxiliary turn lanes are necessary to maintain integrity of traffic
flow and capacity during peak hours (methodology of National Cooperative Highway Research Program (NCHRP)
Report 457), which determined that both left and right turn lanes are warranted at the project access on Clarcona
Ocoee Road. The lengths of the turn lanes recommended and proposed in the LUP (at 235 feet for westbound left -
turn lane and 185 for eastbound right -turn lane, inclusive of the minimum 50-foot taper) are in accordance with the
FDOT Design Manual.
Utilities: The site will be served by Orange County Utilities for water and sewer service. Although the site is within
the City's reclaimed water service area, reclaimed service is not within reasonable proximity to the property, and as
such, the development will not be required to connect to reclaimed water service.
Stormwater: Stormwater drainage will be provided on -site and will be finalized at the time of site plan review.
Environmental Analysis: The subject property contains Type A soils but does not contain any floodplains or
wetlands. Thus, development of the site will not result in adverse impacts to wetlands or floodplains. The proposed
development will be required to maintain a minimum of 35% of the site as open space.
Schools: N/A
Public Safety: The property is currently within fire and police protection and service zones.
ISSUE:
Should the Planning & Zoning Commission, acting as the Local Planning Agency, make a recommendation of
approval of the proposed ordinances for a Small -Scale Comprehensive Plan Future Land Use Map Amendment
from Low Density Residential (LDR) to Commercial (COMM) and corresponding Rezoning from R-1AA (Single
Family Dwelling District) to PUD (Planned Unit Development District) for the development of a commercial plaza on
the properties assigned parcel ID numbers 33-21-28-0000-00-023 and 04-22-28-0000-00-012?
RECOMMENDATIONS:
Development Review Committee (DRC) Recommendation
The DRC considered this item at its July 30, 2024, meeting. The discussion was relative to the list of permitted
uses, building perimeter landscaping, bike parking, and location of signage. Following discussion, the DRC made a
recommendation of approval subject to revision of the Land Use Plan to:
• Clarify that "recreation facility, neighborhood" would be an allowed use via approval of a special exception,
exclusion of coin laundry uses and other similar commercial convenience uses,
• Inclusion of bike parking in front of both buildings,
• Annotation of the distance of the monument sign from right-of-way lines and sidewalks, and
• Any needed landscape waiver.

Since the time of the DRC meeting, the applicant has addressed the DRC comments/conditions.
Staff Recommendation
Staff recommends that the Planning & Zoning Commission, acting as the Local Planning Agency, make a
recommendation of approval of the proposed ordinances for a Small -Scale Comprehensive Plan Future Land Use
Map Amendment from Low Density Residential (LDR) to Commercial (COMM) and corresponding Rezoning from R-

AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA, AMENDING
THE CITY OF OCOEE COMPREHENSIVE PLAN AS ADOPTED IN 19919
AS AMENDED; AMENDING THE FUTURE LAND USE MAP OF THE
OCOEE COMPREHENSIVE PLAN TO CHANGE THE FUTURE LAND
USE MAP DESIGNATION FROM LOW DENSITY RESIDENTIAL TO
COMMERCIAL FOR CERTAIN REAL PROPERTIES CONTAINING
APPROXIMATELY 4.29 ACRES LOCATED ON THE NORTH SIDE OF
CLARCONA OCOEE ROAD, BEGINNING APPROXIMATELY 400 FEET
EAST OF THE NORTH CLARKE ROAD AT CLARCONA OCOEE ROAD
INTERSECTION; PROVIDING FOR AND AUTHORIZING THE
REVISION OF THE OFFICIAL CITY FUTURE LAND USE MAP;
PREVAILING IN THE EVENT OF ANY INCONSISTENCY; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Ocoee (the "Ocoee City Commission")
has adopted the City's Comprehensive Plan (the "Ocoee Comprehensive Plan") by Ordinance No.
91-28 on September 18, 1991 pursuant to Chapter 163, Part 11, Florida Statutes, the Growth Policy
Act (the "Act"); and
WHEREAS, Chapter 163, Part 1I, Florida Statutes, sets forth procedures and requirements
for a local government to adopt a comprehensive plan and amendments thereto; and
WHEREAS, the owner (the "Applicant") of certain real properties located within the
corporate limits of the City of Ocoee, Florida, assigned tax parcel identification numbers 33-21-
28-0000-00-023 and 04-22-28-0000-00-012, more particularly described in Exhibit "A" and
depicted in Exhibit `B", has submitted an application to the Ocoee City Commission to amend
the Comprehensive Plan Future Land Use designation (the "Comprehensive Plan Amendment")
of said real properties from Low Density Residential to Commercial; and
WHEREAS, pursuant to Section 5-9(C) of Article V of the Land Development Code of
the City of Ocoee, Florida, the Development Services Director has reviewed said Comprehensive
Plan Amendment application and determined that said Comprehensive Plan Amendment is
consistent with the Ocoee Comprehensive Plan, as amended from time to time; and
WHEREAS, pursuant to Section 163.3174(4)(a), Florida Statutes, the City's Local
Planning Agency (LPA) conducted a publicly noticed and advertised public hearing on Tuesday,

September 10, 2024, to consider and make recommendation of said proposed Comprehensive Plan
Amendment; and
WHEREAS, pursuant to Section 163.3184(11), Florida Statutes, on Tuesday, October 1,
2024, the Ocoee City Commission held a de novo advertised public hearing with respect to the
proposed Comprehensive Plan Amendment and determined, after consideration of public
comments, that the proposed Comprehensive Plan Amendment is consistent with the Ocoee
Comprehensive Plan.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION L RECITALS. The foregoing recitals are hereby ratified and confirmed as
true and correct and incorporated herein by this reference.
SECTION 2. AUTHORITY. The City Commission of the City of Ocoee has the
authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida
and Chapters 163 and 166, Florida Statutes.
SECTION 3. COMPREHENSIVE PLAN AMENDMENT. The Future Land Use
Map within the Future Land Use Element of the Ocoee Comprehensive Plan is hereby amended to
change the future land use designation of the Subject Property, as particularly described in Exhibit
"A" and depicted in Exhibit "B", from Low Density Residential (LDR) to Commercial (COMM).
SECTION 4. COMPREHENSIVE PLAN. The City Clerk is hereby authorized and
directed to revise the adopted Future Land Use Map of the City of Ocoee in order to incorporate
the Comprehensive Plan Amendment enacted by this Ordinance.
SECTION 5. CONFLICTING ORDINANCES. This ordinance prevails in the event
of any inconsistency with all ordinances or parts of ordinances in conflict herewith.
SECTION 6. SEVERABILITY. If any section, subsection, sentence, clause, phrase,
or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct, and independent
provision and such holding shall not affect the validity of the remaining portion hereto.
SECTION 7. EFFECTIVE DATE. This Ordinance shall become effective thirty-one
(31) days after adoption, unless challenged prior to that date pursuant to Section 163.3187(5),
Florida Statutes.

AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA, CHANGING
THE ZONING CLASSIFICATION FROM R-IAA (SINGLE FAMILY
DWELLING DISTRICT) TO PUD (PLANNED UNIT DEVELOPMENT
DISTRICT) ON CERTAIN REAL PROPERTIES CONTAINING
APPROXIMATELY 4.29 ACRES LOCATED ON THE NORTH SIDE OF
CLARCONA OCOEE ROAD, BEGINNING APPROXIMATELY 400 FEET
EAST OF THE NORTH CLARKE ROAD AT CLARCONA OCOEE ROAD
INTERSECTION; FINDING SAID ZONING TO BE CONSISTENT WITH
THE OCOEE COMPREHENSIVE PLAN; PROVIDING FOR AND
AUTHORIZING THE REVISION OF THE OFFICIAL CITY ZONING
MAP; PREVAILING IN THE EVENT OF ANY INCONSISTENCY;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the owner (the "Applicant") of certain real properties located within the
corporate limits of the City of Ocoee, Florida, as hereinafter described, has submitted an
application to the City Commission of the City of Ocoee, Florida (the "Ocoee City Commission")
to rezone said real property (the "Rezoning"); and
WHEREAS, the Applicant seeks to rezone certain real properties containing
approximately 4.29 acres, more particularly described in Exhibit "A" attached hereto and by this
reference made a part hereof, from R-lAA (Single -Family Dwelling District) to PUD (Planned
Unit Development District); and
WHEREAS, pursuant to Section 5-9(B) of Article V of the Land Development Code of
the City of Ocoee, Florida (the "Ocoee City Code"), the City Development Services Director has
reviewed said Rezoning application and determined that the Rezoning is consistent with the City
of Ocoee Comprehensive Plan as set forth in Ordinance No. 91-28, adopted September 18, 1991,
as amended (the "Ocoee Comprehensive Plan"); and
WHEREAS, said Rezoning application was scheduled for review and recommendation by
the Planning and Zoning Commission of the City of Ocoee, Florida (the "Planning and Zoning
Commission"), acting as the Local Planning Agency; and
WHEREAS, on September 10, 2024, the Planning and Zoning Commission held a public
hearing and reviewed said Rezoning application for consistency with the Ocoee Comprehensive
Plan and determined that the Rezoning is consistent with the Ocoee Comprehensive Plan and is in
the best interest of the City, and recommended to the Ocoee City Commission that the zoning

classification of said real property be rezoned as requested by the Applicant and that the Ocoee
City Commission find that the Rezoning requested by the Applicant to be consistent with the
Ocoee Comprehensive Plan; and
WHEREAS, on October 1, 2024, the Ocoee City Commission held a de novo advertised
public hearing with respect to the proposed Rezoning of said real property and determined that the
Rezoning is consistent with the Ocoee Comprehensive Plan; and
WHEREAS, this Ordinance has been considered by the Ocoee City Commission in
accordance with the procedures set forth in Section 166.041(3)(a), Florida Statutes.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE
CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION 1. AUTHORITY. The Ocoee City Commission has the authority to adopt
this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapters 163
and 166, Florida Statutes.
SECTION 2. REZONING. The zoning classification, as defined in the Ocoee City
Code, of the Properties described in Exhibit "A" containing approximately 4.29 acres located
within the corporate limits of the City of Ocoee, Florida, is hereby changed from R-IAA (Single -
Family Dwelling District) to PUD (Planned Unit Development District). A map of said land herein
described which clearly shows the area of the Rezoning is attached hereto as Exhibit "B" and by
this reference is made a part hereof.
SECTION 3. COMPREHENSIVE PLAN. The Ocoee City Commission hereby
finds the Rezoning of the lands described in this Ordinance to be consistent with the Ocoee
Comprehensive Plan.
SECTION 4. ZONING MAP. The City Clerk is hereby authorized and directed to
revise the Official Zoning Map of the City of Ocoee in order to incorporate the Rezoning enacted
by this Ordinance, and the Mayor and City Clerk are hereby authorized to execute said revised
Official Zoning Map in accordance with the provisions of Section 5-1(G) of Article V of the Ocoee
City Code.
SECTION 5. CONFLICTING ORDINANCES. This ordinance prevails in the
event of any inconsistency with all ordinances or parts of ordinances in conflict herewith.
SECTION 6. SEVERABILITY. If any section, subsection, sentence, clause, phrase,
or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct, and independent
provision, and such holding shall not affect the validity of the remaining portion hereto.

SECTION 7. EFFECTIVE DATE. This Ordinance shall become effective ten (10)
days after its passage and adoption.

BACKGROUND SUMMARY:
Applicant/Owner: West Road Real Estate LLC, represented by Russel Maynard of Central Florida Engineering
Consultants, LLC
Site Location: The subject property is located in Commission District 1 on the south side of West Road. It consists of
Lot 2 of the existing Ladybird Academy Planned Unit Development (PUD).
Property Size: The subject site consists of one (1) parcel totaling approximately 3.71 acres.
Existing Future Land Use Map Designation: Commercial (COMM)
Existing Zoning Classification: PUD-COMM (Commercial PUD)
Actual land use, proposed land use, and unique features of the subject property: A portion of the subject property
previously had one (1) Single -Family Residence, which has since been demolished. The remainder of the property
consists of a wooded area and part of the PUD's master stormwater pond. Based on the available information, there
are possibly 0.81 acres of impacted wetlands on the property, excluding the existing stormwater pond. The
boundaries have been flagged and verified. The property is not within the City's Special Area Overlay Districts. The
table below summarizes the future land use designations, zoning classifications, and existing land uses of the
surrounding properties:

Proposed Development: The applicant is proposing a 4-story, 124-room hotel. Section 5-8A of Article V establishes
and implements Table 5-1, listing the principal uses permitted on a parcel or lot in the various zoning districts. Per
Table 5-1, a Special Exception is required for a hotel or motel use on property zoned C-2. While this property is
zoned PUD-COMM, the PUD specifies all C-2 uses as the intended zoning for this site. Section 4-8B of Article IV
establishes the standards for review and approval of a Special Exception, as summarized and analyzed below.

1. The proposed uses and structures would not violate the land uses, densities, or other directives of the adopted
Comprehensive Plan or the Code.
Staff Analysis: A conceptual site plan was submitted with the requested Special Exception for purposes of
determining compliance with land use density and intensity and other directives of the Comprehensive Plan and
Code. In terms of compliance with the intensity directive of the Comprehensive Plan, the Commercial Future Land
Use Designation would allow up to 485,223 SF of commercial development. The site plan proposes 52,432 SF of
total building area.
In terms of compliance with the directives of the Code, staff did identify 0.81 acres of possibly impacted wetlands on
the property. A wetlands impact plan will be provided during the Final Site Plan review and the proposed horizontal
layout of the site may be modified as a requirement for the approval of the Final Site Plan.
2. The proposed uses and structures would be compatible with the uses, structures, and activities on adjacent or
nearby land.
Staff Analysis: The proposed use is a commercial hotel within an established PUD. The proposed hotel would be
surrounded by commercial uses on the north and west sides and land zoned for commercial use on the east side. A
portion of the West Orange Trail is directly adjacent to the property on the south side, with State Road 429 nearby to
the south. The applicant has proposed a 30' natural landscape buffer between the West Orange Trail on the south
of the property. Thus, the proposed use and structure would be compatible with uses, structures, and activities on
adjacent and nearby lands.
3. The proposed uses and structures would not violate the health, safety, welfare, and/or convenience of those
residing, working, or owning land in the vicinity of the proposed use or structure concerning or with respect to (a)
density, bulk, or overcrowding of land or buildings, (b) pedestrian or vehicular movement on adjoining streets, (c) fire
safety, noise, odor, glare, or vibration, and (d) ability to adjoin property owners to the legal use of his/her property,
as outlined in Sections 4-813(3)(a) through (g), LDC. The proposed use and structure would not result in the
inadequacy of inability of any public facility or service to meet adopted standards. They would not violate any state
or federal law or regulation.
Staff Analysis: The proposed use/structure is not anticipated to adversely impact the health, safety, welfare, and/or
convenience of those residing, working, or owning land in the area. Staff finds that the proposed use/structure and
proposed site design and horizontal layout of the site will not violate the provisions of Sections 4-813(3)(a), (b), (d),
(e), (f), or (g). Orange County Utilities will serve the site with potable water and sewer. Reclaimed water may be
available through the City of Ocoee.
Staff does not identify any concerns relative to the proposed 4-story, 124-room hotel use on the C-2 property.
ISSUE:
Should the Planning and Zoning Commission make a recommendation of approval for a Special Exception for the
use of certain property zoned C-2, assigned parcel ID number 06-22-28-0000-00-008 for a hotel use?
RECOMMENDATIONS:
Development Review Committee (DRC) Recommendation:
The DRC met on Tuesday, July 30, 2024, to review and consider the proposed Special Exception for the hotel use
on the property. The concern discussed and raised by the DRC was relative to the rear landscape buffer and
potential wetland on the property. Following discussion, the DRC made a recommendation of approval subject to the
condition that the rear landscape buffer and potential wetland on the property be further evaluated at the time of site
plan submittal and review.
Staff Recommendation:
Staff recommends that the Planning and Zoning Commission make a recommendation of approval for a Special
Exception for the use of certain property zoned C-2, assigned parcel ID number 06-22-28-0000-00-008 for a hotel

The 49 foot building height shown on Civil Drawings is not correct. Please see attached
Architectural wall section, and excerpt from the 8th Edition Florida Building Code. FBC
Section 202 defines Building Height as "vertical distance from grade plane to the average
height of the highest roof surface". This height is actually (43'-6" PLUS DIST FROM GRADE
PLANE TO FFE). The roof parapets and the taller entrance structure are not part of the true
roof, but are "other structures" per the Exception to FBC Section 504.3, and are allowed to
be up to 20 feet taller than the building height.

Temporary Moratorium Ordinance on the Processing and Consideration of Development

BACKGROUND SUMMARY:
City staff is in the process of evaluating and rewriting the city's Land Development Code (LDC) and rewriting the
Comprehensive Plan to a 2045 planning horizon to reflect the vision that the City Commission and citizens of Ocoee
have articulated. Each of these, individually, presents a monumental challenge for staff with far-reaching impacts for
the next 20 years. Both documents, as adopted, last underwent major revisions in the late 1990s. Since these
revisions in the late 1990s, the city has undertaken numerous studies and other public events whereby Commission
and citizen input has been solicited. These events included: the CRA Target Area hearings in 2008, Downtown
Master Plan workshops in 2016, SR 429 Overlay Character Areas in 2019, Downtown Workshop in 2023, Ocoee
Music Festivals, Best Fests, and more recently, comments and direction from Commissioners and citizens on recent
denials of development applications.
During this period of evaluation and rewrite, city staff recommends a six (6) month moratorium be established on the
acceptance, processing, and consideration of applications for map amendments, rezoning & special exceptions, and
site and subdivision plan reviews concerning properties located within the city limits. This proposed development
moratorium is a temporary halt or suspension of new construction or development projects. The objective of a
development moratorium is to provide time for staff to focus on writing standards that will improve the city's place -
making standards and to develop context -based development regulations so that architecture of buildings,
placement, and context of streets, frontages, and other infrastructure reflect the vision as stated by the Commission
and citizens on numerous occasions before allowing new developments to proceed. During this moratorium, existing
projects may continue, but no new applications for development permits are processed. If the moratorium is not
approved, new development proposals would be subject to the current LDC and Comprehensive Plan rules and
regulations, irrespective of the imminent approval of new regulations.
If the ordinance is approved, the moratorium will expire on March 17, 2025, unless terminated earlier or extended by
action of the City Commission.
ISSUE:
Should the Planning and Zoning Commission recommend approval of an ordinance establishing a temporary
moratorium on the acceptance, processing, and consideration of applications for map amendments, rezoning &
special exceptions, and site and subdivision plan reviews concerning properties located within the city limits?
RECOMMENDATIONS:
Staff respectfully recommends the Planning and Zoning Commission recommend approval of an ordinance

APPROVALS, TO ALLOW THE PLANNING AND ZONING
DIVISION TIME TO THOROUGHLY REVIEW, STUDY,
AND PREPARE AMENDMENTS TO THE CITY OF OCOEE
COMPREHENSIVE PLAN AND THE CITY OF OCOEE
LAND DEVELOPMENT CODE; PROVIDING FOR
SEVERABILITY; AND PROVIDING AN EFFECTIVE

WHEREAS, as provided in Article VIII, Section 2 of the Constitution of the State of
Florida and chapters 163 and 166, Florida Statutes, the City of Ocoee (the "City") enjoys all Home
Rule governmental, corporate, and proprietary powers to conduct municipal government, perform
municipal services, and exercise any power for municipal purposes except as otherwise provided
by law, including police power and authority over land development and zoning; and
WHEREAS, the City Commission has determined that land development and zoning
regulations are in the best interest of the health, safety, and welfare of City's residents, businesses,
and visitors; and
WHEREAS, the City adopted its original Comprehensive Plan in April 15, 1980, and
original Land Development Code in July 21, 1992; and
WHEREAS, the City's Comprehensive Plan and Land Development Code guide decision -
making by setting policies for future land use, development standards, transportation mobility, and
public services; and

WHEREAS, the City has found a need to create a global vision for the development and
redevelopment of properties located within the City to reflect the City's growth and changing
dynamics; and
WHEREAS, the Planning and Zoning Division is in the process of evaluating the City's
Land Development Code and rewriting the Comprehensive Plan with a focus on elevating the
City's place -making standards and to develop context -based development regulations so that
buildings, streets, frontages, and other infrastructure better reflect, and are more compatible with
their intended settings;
WHEREAS, the Planning and Zoning Division intends to present to the City Commission
a proposed ordinance or ordinances that would amend the City's Comprehensive Plan and Land
Development Code, and may affect permitted uses, conditional uses, prohibited uses, land
development standards, building design standards, and other development regulations governing
properties within the City limits; and
WHEREAS, the City wishes to place the public and all parties on notice of pending
legislation to amend the City's Comprehensive Plan and Land Development Code; and
WHEREAS, the processing of applications to: (a) amend the Comprehensive Plan text or
Future Land Use map; (b) to rezone land in the City; (c) to obtain a special exception allowing
certain use(s) on land in the City; and (d) for preliminary or final site plan or subdivision approval
consume enormous time and personnel resources of the Planning and Zoning Division such as to
interfere with the Division's ability to thoroughly review, study, and prepare recommended
amendments to the Comprehensive Plan and Land Development Code;

WHEREAS, the Planning and Zoning Division reasonably requires at least six (6) months
to thoroughly review, study, and prepare amendments to the City's Comprehensive Plan and Land
Development Code;
WHEREAS, a moratorium temporarily suspending new applications to: (a) amend the
Comprehensive Plan text or Future Land Use map; or (b) to rezone land in the City; or (c) to obtain
a special exception allowing certain use(s) on land in the City; or (d) for preliminary or final site
plan or subdivision approval, would be in the best interests of the health, safety and welfare of the
citizens of the City, and would allow reasonable time for the Planning and Zoning Division's
review, study and preparation of amendments to the City's Comprehensive Plan and Land
Development Code, and for the City Commission's consideration of such amendments;
WHEREAS, the City Commission should reserve discretion to extend the moratorium up
to several months, if the City Commission deems it reasonably necessary, upon approval of one or
more Resolutions.

NOW, THEREFORE BE IT ENACTED by the City Commission of the City of Ocoee
SECTION 1: Incorporation of Recitals. The foregoing recitals are incorporated herein
as if set forth at length.
SECTION 2: Temporary Moratorium Suspending Application Processing. In order
to give the Planning and Building Department reasonably sufficient time to thoroughly review,
study and prepare amendments to the City's Comprehensive Plan and Land Development Code,
the City hereby imposes a six (6) month moratorium temporarily suspending new applications to:
(a) amend the City's Comprehensive Plan text or Future Land Use map; or (b) to rezone land in

the City; or (c) to obtain a special exception allowing certain use(s) on land in the City; (d) for
preliminary or final site plan or subdivision approval in the City. During this moratorium, the City
will not accept or process any new applications for any of the aforementioned land development
approvals.
SECTION 3. Extension of Moratorium. The City Commission may extend the
moratorium on accepting and processing the aforementioned applications by up to an additional
four (4) months upon passage of one or more Resolutions approving of such extension(s), if such
extension(s) appear reasonably necessary.
SECTION 4. Existinjj Applications. The moratorium shall not apply to the processing
of any existing and pending application to: (a) amend the Comprehensive Plan text or Future Land
Use map; or (b) to rezone land in the City; or (c) to obtain a special exception allowing certain
use(s) on land in the City; or (d) for preliminary or final site plan or subdivision approval provided
that the City's Planning and Zoning Division has received such application prior to the effective
date of this Ordinance. This moratorium shall not affect any business lawfully operating in the
City pursuant to valid licenses, permits, and approvals if the existing business is compliant with
all applicable Federal, State, County, and municipal code, ordinances, rules, regulations, and
policies. Nor shall this moratorium affect any emergency approval of any part of a preliminary
site plan or to otherwise permit drainage improvements, if required to protect persons or property
from flooding or to otherwise protect the health and safety of persons or property.
SECTION 5: Non -Codification. The provisions of this Ordinance shall not be included
or incorporated into the City Code or Land Development Code.
SECTION 6: Severability. The provisions of this Ordinance are declared to be severable
and if any section, paragraph, sentence or word of this Ordinance, or if the application as to any

person or circumstance is held invalid, that invalidity shall not affect other sections or words or
applications of this Ordinance. If a court of competent jurisdiction finds that any part of this
Ordinance is preempted or otherwise superseded, the remainder of this Ordinance shall
nevertheless be given full force and effect to the extent permitted by the severance of such
preempted or superseded part.
SECTION 7: Effective Date. This Ordinance shall take effect immediately upon its
passage and in accordance with Florida law.
