Oakland Avenue Reconstruction. (Acting Utilities Director Bolling) Background Summary: The approved W. Oakland Avenue Reconstruction Project includes the construction of a gravity sewer system that will provide service to the parcels along W. Oakland Avenue, East of Florida Central Railroad Company, LLC's (FCEN) railroad tracks. Due to the elevation constraints of the existing gravity sewer system along Bluford Avenue, and the strict depth requirements from FCEN, the original gravity sewer design did not extend west of FCEN’s railroad tracks. Staff worked with CPH, the Engineering Consultant for this project, to overcome the elevation and depth constraints. As a result of this effort, the existing manhole cone will be modified and a 16-inch steel casing will be installed underneath the railroad tracks to provide future developments west of the railroad tracks the ability to connect to gravity sewer. Change Order No. 1 will allow for the Contractor, J Malever Construction Company, of the W. Oakland Avenue Reconstruction Project to modify the existing manhole cone and construct the 16-inch steel casing at a cost of $81,945.00. Issue: Should the Honorable Mayor and City Commissioners approve Change Order No. 1 for ITB #24-002 W. Oakland Avenue Reconstruction at a cost of $81,945.00? Oakland Ave Reconstruction CHANGES ORDERED: I. REQUIRED CHANGES 1. This change order will cause a net increase to the contract total in the amount of $81,945.00 2. Added Pay Items to complete the project: CO1.01 Additional Work to replace Existing Manhole Cone by One (1) Lump Sum in the amount of One Thousand Four Hundred Forty-Five and 00/100 ($1,445.00) Dollars CO1.02 Additional Work to install 16-inch Steel Casing Under Railroad Right-of-Way by One Hundred Fifteen (115) Linear Feet in the total amount of Eighty Thousand Five Hundred and 0/100 ($80,500.00) Dollars II. JUSTIFICATION CO1.01 Due to changes in design for the road elevation for Phase II of this project, the existing manhole has to be modified. The Contractor will be removing the existing manhole cone and replacing it with a short cone section. CO1.02 Due to the elevation constraints from the existing manhole on Bluford Ave and the strict elevation requirements to cross under the railroad tracks, the gravity sewer designed in this project cannot extend past the railroad tracks. The installation of a 16” sleeve under the railroad tracks will allow for a future force main to be constructed under the railroad tracks and connect to the gravity sewer designed in this project. This will allow for parcels west of the railroad tracks to connect to City sewer. III. NARRATIVE OF NEGOTIATIONS The Contractor has agreed to do the additional work to construct a 16” Steel Casing under the Railroad Right-of-Way as part of the W Oakland Ave Phase II Project. IV. PAYMENT The Utilities Department provided funding in the amount of $47,000 for the construction of sanitary sewer as part of this project. This funding only covers the cost of the Utility Sewer Infrastructure items bid in this project. Additional funding will be need to cover the expenses of Change Order #1. Funding for CO1.01 of this Change Order in the amount of $1,445.00 shall come from 417- 535-10-6302 of Job #P000302. There is adequate funding for CO1.02 of this Change Order in the amount of $80,500.00 in the Capital Improvements Fund. These changes will not affect the funding for Utility Potable Water Infrastructure funding and Public Works Infrastructure funding. Change Order # 1 (Commission) ITB #24-002 W. Oakland Ave Reconstruction V. APPROVAL AND CHANGE AUTHORIZATION The original project and funding allocation was established by issuance of a CITY purchase order, subject to the terms and conditions contained in the CITY’s solicitation, Project Manual, Drawings, Specifications, and/or the CONTRACTOR’s service and price proposal, which collectively form the terms of an agreement between the CITY and the CONTRACTOR for the performance of the Work. This proposed change to the agreement requires approval by the City Commission under the CITY’s Purchasing Rules and Regulations and is consistent with any prior action by the City Commission to award the Work to the CONTRACTOR. It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original agreement other than matters expressly provided herein. CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the adjustments in contract price and time shown hereon constitute full and complete compensation and satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No other claim for increased costs of performance or modifications of time will be granted by the CITY for the Work covered by this Change Order. We will need to remove that old cone (36" tall) and reinstall a shorter cone (20" Tall) to meet the plan elevation. The cost to purchase and install the shorter cone is $1,445.
