SUMMARY OF MINUTES
Call to Order:
The special
Roll +fall.
Trustees Present. Bryan face, Joe Moy, Trey Littlefield and William Maxwell. The roll was
called and a quorum declared present.
Others present!
Attorney Pedro Herrera of Sugarman, Susskind, Braswell & Herrera via Zoom, Former Tire
Member Michael Menegat and. Livia Giuliani of Benefits USA.
New Business
Michael Menegat Informal Disability Hearin
Attorney Herrera opened the meeting noting that they we are gathered for an informal hearing to
determine the disability status of former firefighter Michael Menegat. He noted that the Board
will need to determine if the member was disabled, if the disability is total and permanent and if
it was °work. related. Attorney Herrera said that the Board will have; to make I of 3 motion. The
first motion would be to grant the disability, the second would be to deny the disability or the
third would be would be to table the matter which would require the Board reconvening and
essentially picking up where it left off today, If the disability is denied, Mr. Menegat will have a
chance to appeal the decision at a formal hearing. Should the Board elect to deny the disability,
at the formal hearing, Mr. Menegat would have one last opportunity to appeal the decision to the
circuit court.
Trustee Maxwell commented that he just wants to make sure that they don't have any problems
and that they maintain the integrity ofthe :Board. He said they have sufficient information`
regarding the disability and that they must ensure, that their decision today will be the right.
decision for the member as well as the Board. Trustee Moy said they will act in the highest
standards of the Board.

Member Menegat addressed the Board noting that he was actively employed when he submitted
his application in November 2023. He was asked to give a brief description of his injury. He
stated that he was on a call and afterwards he felt severe pain in his knee and was not able to
stand on it. He was transported to the hospital and several tests were taken which resulted in
having to have a knee replacement. At this time, he cannot put pressure on his knees. He also
stated that he was on light duty at the city and his last day was on June 3'. He noted that he did
not receive any compensation from Worker's Comp. After hearing from Mr. Menegat, the
Trustee's discussed the medical records and testimony as well as personal accounts from
colleagues. They determined Mr. Menegat was an active member at the time of the injury and
that the disability was service incurred..
Trustee Littlefield moved to grant the service mcurre&disability effiective on July 1, 2024. The
motion Was seconded by Trustee Moy and l3as§ed 4-0,
Next Regular Meeting date: Wednesday, August 7, 2024 at 1 -00 pm.
Adjourn- Trustee Maxwell moved to 4ournznd Trustee LittlefieUseconded the motion and it
passed. The meeting adjourned at �.19 pin.
