CODE OF ORDINANCES OF THE CITY OF OCOEE, FLORIDA, AMENDING

INSTALLATION"; PROVIDING FOR INSTALLATION OF NATURAL GAS
LINES WITHIN SUBDIVISIONS s OR

EFFECTIVE DATE.
WHEREAS, natural gas provides an affordable, reliable; environmentally friendly and
efficient alternative means of addressing the energy needs of citizens and residents of the City of
Ocoee, Florida, and
WHEREAS, natural gas provides a reliable source of meeting energy needs after hurricane
and storm events that may affect the safety • of
of Ocoee, Florida; and
WHEREAS, many individuals moving to the City of Ocoee, Florida, have previously
enjoyed natural gas appliances in their homes and businesses, and desire to continue to utilize

WHEREAS, the costs of installing natural gas infrastructure in already developed
subdivisions; and retrofitting existing homes to allow homeowners to use natural gas appliances
may be too expensive to allow the citizens and residents of the City of Ocoee to do so; and

WHEREAS, the costs of installing natural gas infrastructure in subdivisions up -front, as
they are being constructed, are significantly lower than the costs of retrofitting developments after -
the -fact; and
WHEREAS, the citizens and residents of the City of Ocoee benefit from the freedom of
choice among appliances and energy sources, as well as the lower energy costs for natural gas; and
WHEREAS, the Lake Apopka Natural Gas District is the natural gas provider for the
geographical area of the City of Ocoee; and
WHEREAS, the territorial limits and area of service of the Lake Apopka Natural Gas
District embrace and include the geographical boundaries of the City of Ocoee, and
WHEREAS, the Board of Commissioners of the Lake Apopka Natural Gas District have
considered, and unanimously support the adoption of this model ordinance by each of the cities
within the territorial limits and area of service of the Lake Apopka Natural Gas District; and
WHEREAS, the City Commission of the City of Ocoee, Florida; has determined it to be
in the best interests of the City of Ocoee and of the health, safety and welfare of the citizens and
residents of the City of Ocoee that future subdivisions and re -subdivided areas be developed with
natural gas infrastructure and related improvements, as hereinafter provided.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE
CITY OF OCOEE, FLORIDA, as follows:
SECTION ONE: SECTION 6-8 C, "OTHER UTILITIES", of SECTION 6-8, "UTILITIES", of
ARTICLE VI, "DESIGN AND PERFORMANCE STANDARDS", of CHAPTER 180, "CITY
OF OCOEE LAND DEVELOPMENT CODE", of the CODE OF ORDINANCES OF THE CITY

OF OCOEE, FLORIDA, Florida, is hereby amended to adopt new SUBSECTION 7, "NATURAL
GAS INSTALLATION", to read as follows:
CHAPTER 180, CITY OF OCOEE LAND DEVELOPMENT CODE
ARTICLE VI - DESIGN AND PERFORMANCE STANDARDS
§ 6-8. -UTILITIES.
C. Other Utilities.
7. Natural Gas Installation.
(a) Generally. Natural gas line installation shall be required in all new re -subdivisions and
new subdivisions over five (5) lots.
(b) Cost of Installation.
(1) Natural Gas Distribution Lines and Facilities. The cost of installation, including
construction and materials, of all natural gas distribution lines and appurtenances
must be borne by the developer, subdivider or re -subdivider,
(2) Natural Gas Mains. The cost of extension of an existing natural gas main to the
subdivision or re -subdivision property shall be borne by the developer, subdivider
or re -subdivider, provided the existing natural gas main is determined by the Lake
Apopka Natural Gas District, as natural gas provider, to be reasonably situated to
the subdivision or re -subdivision.
a. Where the Lake Apopka Natural Gas District determines that there is no existing
natural gas main reasonably situated to the subdivision or re -subdivision, the Lake

Apopka Natural Gas District may offer the developer, subdivider or re -subdivider

the option of cost -sharing of off -site improvements to extend the main to the
property.
b. Subdivisions or re -subdivisions shall not be required to install natural gas lines
where the Lake Apopka Natural Gas District has determined that service is not
reasonably available.
(3) Construction. Construction of natural gas installation and main extension shall be
performed by the Lake Apopka Natural Gas District and/or its designee. Before
the Lake Apopka Natural Gas District and/or its designee commences any natural
gas installation and/or main extension construction, the cost for labor and materials,
as estimated by the Lake Apopka Natural Gas District's engineer, must be paid to
the Lake Apopka Natural Gas District in cash or a bond sufficient to cover the cost
of construction. The cost will be determined from the point of the nearest available
natural gas supply to the subdivision. Any excess payment or underpayment will
be refunded or invoiced upon completion of installation.
(4) Easements and Permits. The developer, subdivider or re -subdivider shall grant the
Lake Apopka Natural Gas District the use of such easements or rights -of -way, or as
otherwise approved by the City, required for the purpose of constructing, operating and
maintaining the natural gas pipeline distribution system. The Lake Apopka Natural
Gas District shall obtain all required permits and authorizations from the City for
installation of the natural gas pipeline system.

(5) Ownership and Maintenance. All distribution mains, lines, services and other
installations on the inlet/upstream/street side of the meter, as well as the meter, shall be
the property of the Lake Apopka Natural Gas District, who shall be responsible for
their safe operation and proper maintenance. All facilities on the
outlet/downstream/house side of the meter, including the house piping system and all
natural gas appliances, shall be the property of the builder and/or their assigns, who
shall be responsible for safe operation and proper maintenance of all such facilities.
SECTION TWO: Conflicting Ordinances. All ordinances or parts of ordinances
which are in conflict with any of the provisions of this ordinance are hereby repealed to the extent
necessary to alleviate the conflict, but shall continue insofar as they are not in conflict herewith,
unless repeal of the conflicting portion destroys the overall intent and effect of any of the
conflicting ordinances, in which case those ordinances so affected shall be hereby repealed in their
entirety.
SECTION THREE: Severability. If any portion of this ordinance is declared invalid
or unenforceable, then, to the extent it is possible to do so without destroying the overall intent and
effect of this ordinance, the portion deemed invalid or unenforceable shall be severed herefrom,
and the remainder of this ordinance shall continue in full force and effect as if it were enacted
without including the portion found to be invalid or unenforceable.
SECTION FOUR: This ordinance shall not apply to any subdivision or re -subdivision
which meets all current, applicable requirements of the City's Land Development Code as of the
effective date of this ordinance, and which has received final approval of construction plans prior
to the effective date of this ordinance.

SECTION FIVE: Effective Date. This ordinance shall become effective upon its
passage and adoption according to law.
