(Concurrency & Commitment Coordinator McFarlane) Background Summary: The Magnolia Reserve Townhome Subdivision is located in Commission District 1, on the south side of Desert Candle Drive, east of Renaissance Charter School and West Orange Trail, and generally adjacent to the Greens at Forest Lake Townhome Subdivision. At the builder's request, the abandonment and vacation request is for the vacation of the front 34-foot portions of the 5-foot utility easements located on the side yards of eight (8) corner lots (specifically Lots 1, 12, 13, 24, 25, 36, 37, and 48) of the Magnolia Reserve Townhomes Subdivision. The request is to vacate an approximately 170 square foot area per lot, which equates to a total of 1,360 square feet of easement area for all eight (8) lots. The specific easement areas to be vacated for the 8 corner lots are all located on the external side yards of the properties and are all 5 feet wide and run 34 feet from the front of the property line towards the rear. The purpose of the partial vacate is to resolve an issue resulting from the construction of walkways and front porch columns for these 8 lots within the 5-foot utility easement area. For purposes of clarity and accuracy, the full legal descriptions and sketches for the easement areas to be vacated within all 8 lots have been included as exhibits to the proposed Resolution. However, to summarize, Figure 1 shows an example where walkway and part of the townhouse structure encroach into the easement. Staff notes that these easements are not shown on the stamped final subdivision plans (approved October 2023) but are shown on the recorded plat (approved May 2024). Figure 2 depicts the locations (not-to-scale) where the partial vacates for the 8 lots are requested. As part of the review process, staff sent letters to the standard list of utility providers for their determination of whether they had any concerns and would release their interests in the utility easements. Following receipt of no concerns or objections from the applicable utility providers, staff supports the applicants request for the partial easement vacations on these 8 listed corner lots and has advanced the vacation request to the City Commission for consideration and approval. Severability. If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held invalid or unconstitutional by any court of 3 competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto.
