Subject: Approval of Resolution Designating Administrative Official Authorized to Approve
Plats and Replats. (Deputy Development Services Director Whitfield)
Background Summary:
Senate Bill (SB) 784, which was signed by the Governor on June 20, 2025, and incorporated into Chapter
2025-164 Laws of Florida on June 23, 2025, went into effect on July 1, 2025. SB 784 amended Section
177.071, Florida Statutes, to stipulate that a plat or replat must be administratively approved and that no
further action by the governing body of a local government is required if the plat or replat complies with the
requirements of Section 177.091, Florida Statutes. SB 784 also amended Section 177.071, Florida Statutes,
to require local governments to designate, by ordinance or resolution, an administrative authority to receive,
review, and process the plat or replat submittals, including the designation of an administrative official
responsible for approving, approving with conditions, or denying the proposed plat or replat.
Although SB 784 also contains provisions for a sufficiency review process and timeline as well as other
provisions, this Resolution is intended to comply with the provisions of Section 177.071(1)(a) and (b), Florida
Statutes, in that it designates the Development Services Department as the administrative authority for
receiving, reviewing, and processing plats and replats and the City Manager as the administrative official
authorized to approve, approve with conditions, or deny plat and replat submittals in accordance with Sections
177.071 and 177.091, Florida Statutes.
Issue:
Should the Honorable Mayor and City Commissioners approve a Resolution designating an Administrative
Official authorized to approve plats and replats which are in compliance with the provisions of Section 177.071
and 177.091, Florida Statutes, in accordance with House Bill 784?
Recommendations:
Staff recommends that the Honorable Mayor and City Commissioners approve the Resolution designating an
Administrative Official authorized to approve plats and replats which are in compliance with the provisions of
Section 177.071 and 177.091, Florida Statutes, in accordance with House Bill 784.

RESOLUTION NO. ______
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
OCOEE, FLORIDA, DESIGNATING THE CITY MANAGER AS THE
ADMINISTRATIVE OFFICIAL AUTHORIZED TO APPROVE PLATS
AND REPLATS PURSUANT TO SECTION 177.071, FLORIDA
STATUTES, AND PROVIDING FOR CONFLICTS, SEVERABILITY, AND
AN EFFECTIVE DATE.
WHEREAS, Section 177.071, Florida Statutes, as amended, requires that plats and replats
be administratively approved by a designated authority of the local government, and no further
action or approval by the governing body is required if the plat or replat complies with the statutory
requirements; and
WHEREAS, the amended statute requires that each local government designate, by
ordinance or resolution, an administrative authority and official responsible for reviewing,
processing, and administratively approving plats and replats; and
WHEREAS, the City Commission of the City of Ocoee desires to comply with the
requirements of Section 177.071, Florida Statutes, and facilitate the efficient review and approval
of plats or replats.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF OCOEE, FLORIDA THAT:
SECTION 1. Recitals. The foregoing recitals are true and correct and are incorporated
herein by reference.
SECTION 2. Designation of Administrative Authority and Official. Pursuant to
Section 177.071, Florida Statutes, the City Commission hereby designates the Development
Services Department as the administrative authority for receiving, reviewing, and processing plat
and replat submittals. The City Commission further designates the City Manager as the

administrative official authorized to approve, approve with conditions, or deny plat and replat
submittals in accordance with Section 177.071, Florida Statutes, and based on compliance with
the requirements of Section 177.091, Florida Statutes.
SECTION 3. Delegation of Duties. The City Manager is authorized to delegate review
and processing duties to appropriate staff within the Development Services Department or other
relevant Departments, consistent with the provisions of Section 177.071, Florida Statutes.
SECTION 4. Conflicts. In the event of a conflict or conflicts between this Resolution and
any other Resolution or Ordinance or provision of law, this Resolution controls to the extent of the
conflict, as allowable under the law.
SECTION 5. Severability. If any section, subsection, sentence, clause, phrase, or portion
of this Resolution is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such
holding shall not affect the validity of the remaining portions hereof.
SECTION 6. Effective Date. The Resolution shall become effective immediately upon its
adoption.
PASSED AND ADOPTED at a regular meeting of the City Commission of the City of
Ocoee held in City Hall, Ocoee on this ________day of ________________________ 2025.
