HomeMy WebLinkAbout08-28-2007 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING AUGUST 28, 2007 CALL TO ORDER Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order at 7:00 p.m. in the Commission Chambers at City Hall. Member Hopper led the Invocation and Member Morton led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Godek, Vice-Chair Chancey, Members Hopper, Morton, Stanley and Alternate Member Lowery. Also present were Code Enforcement Supervisor Loeffler, Code Enforcement Officer Siegrist, Code Enforcement Officer Rodriguez, Code Enforcement Officer Delgado, Division Chief Stanley, Permitting Clerk Everett, Attorney Sneed, and Deputy City Clerk Sibbitt. ABSENT: Members Ballard and M. Godek were absent excused. GUESTS: None. Permitting Clerk Everett administered the oath to Code Enforcement Officer Loeffler, Code Enforcement Officer Siegrist, Code Enforcement Officer Rodriguez, Code Enforcement Officer Delgado, Division Chief Stanley and anyone intending to speak regarding a case. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD. IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. Division Chief Stanley stated this case was a continuance from last month and as of July 30, 2007, the business was in compliance and they are asking for an administrative recovery cost of $124.05. Raoul Lallo, on behalf of the respondent, briefly stated he was not aware of the fact that he had to call the inspector back out for a re-inspection since he has always complied and Mr. Dingman had told him that he would be back. Mr. Lallo announced he complied with the violation on July 4,2007, and did not realize he was still in violation until he received a letter to come before the board on July 24th. Division Chief Stanley stated that Mr. Dingman did go out to re-inspect the business on July 30th which is one week after the July 24th hearing. Attorney Sneed advised the board that at the last meeting the board did not make a finding of violation so they can not award cost if a finding of violation was not made. She further stated before the board can make a finding it is the City's job to prove that there was a violation. So, if the inspector does not go back out to re-inspect the business, even if they had asked the respondent to call them, it is still the inspector's job to prove that there was a violation past the designated compliance date. A brief discussion ensued regarding the history of the case and when they came into compliance. Member Morton, seconded bv Vice Chair Chancev, moved in Case No. 07-115F to find the respondent in compliance as of Julv 30, 2007, and no administrative costs be assessed. Room addition east side of house. Officer Siegrist gave a detailed history of the case and provided exhibits. He further stated as of August 28, 2007, the property was in non-compliance. James and Myrna Rogers, respondents in violation, stated he did put the room addition up and would like to apply for a permit. He further stated he will do whatever he needs to and feels that if given 30 days he can finish the addition. Member Hopper advised Mr. Rogers to be careful on asking for just 30 days because the City still needs to issue a permit and that could be a lengthy process. Chairman Godek stated they usually do give respondents 30 days and if more time is needed they can apply for an extension. Vice Chair Chancey inquired as to why a permit was not pulled before construction was started. Mr. Rogers stated he had a violation for debris in his yard and since there was a slab fountain already existing he took the materials from his yard to build the room addition. Member Morton advised Mr. Rogers that when building a room addition it is required that you follow the Building Code so that it is up to hurricane requirements. Alternate Member Lowery also advised Mr. Rogers that he may have to get permission from the County as well for his addition. He further stated the property is in non- compliance as of today's date (8-28-07) but there is a crew currently working on fixing pond and City is looking for a reasonable time to get fountain repaired. He further stated that the property was found to be in non-compliance of NFPA 14.14.1.5, 7.9 as of August 28, 2007. They were however in compliance of NFP A 11.1.5. Member Morton inquired from the Board Attorney if they should be making motions incorporating some of the future administrative costs. Attorney Sneed stated if they do not have any evidence or testimony regarding administrative costs then there is nothing the board members can do. Member Morton. seconded bv Alternate Member Lowerv, moved in Case No.07-131F to find the respondent in violation as cited as of Julv 19, 2007, and be given until September 4,2007, to come into compliance for violations remaining or be fined $150/ a day per violation thereafter.
