Background Summary:
The attached Resolution provides support for the Community Contribution Tax Credit Program (CCTCP) which was
established as part of the Florida Department of Commerce to encourage private sector participation in community
improvement and housing projects. The program offers tax credits to businesses that have made donations to
approved community organizations. Approval of this resolution by the City Commission does not designate any
entity as an eligible sponsor. Each entity with a project located in the City of Ocoee must obtain its own resolution
for that specific project. This would result in the entity attending a City Commission meeting for its own resolution
adoption after being vetted by the City Manager's Office.
The Community Contribution Tax Credit Program (CCTCP) provides a financial incentive (up to 50% tax credit or
sales tax refund) to encourage Florida businesses to make donations toward community development and housing
projects for low-income persons. Businesses located anywhere in Florida that make donations to approved
community development projects may receive a tax credit of up to 50 percent of the value of the donation.
Businesses may take the credit on Florida corporate income tax, insurance premium tax, or as a refund against
sales tax if the business is registered to collect and remit sales taxes with the Department of Revenue (DOR).
Non-profit organizations and units of state and local governments may apply to become eligible sponsors and solicit
donations under the program.
Issue:
Should the Honorable Mayor and City Commissioners approve a Resolution expressing support for the

Recommendations:
Staff recommends the Honorable Mayor and City Commissioners approve a Resolution expressing support for
the Community Contribution Tax Credit Program (CCTC) Authorized under 212.08(5)(p) FL Statutes.

RESOLUTION NO. 2025-
A RESOLUTION OF THE CITY OF OCOEE, FLORIDA,
EXPRESSING SUPPORT FOR THE COMMUNITY
CONTRIBUTION TAX CREDIT PROGRAM (CCTC)
AUTHORIZED UNDER SECTION 212.08(5)(p), FLORIDA
STATUTES; AND PROVIDING FOR SEVERABILITY, AND
AN EFFECTIVE DATE.
WHEREAS, Section 220.183, Florida Statutes, provides for a Community
Contribution Credit Program (“CCTC Program”) to encourage donations to community
development programs in low-income communities by providing contributions with a 50%
credit against any state tax due for a taxable year, and
WHEREAS, any project for which a business seeks a tax credit must be undertaken by
an “eligible sponsor” which includes nonprofit, community-based organizations whose mission
is the provision of housing for low-income or very low-income households; and
WHEREAS, all projects must first be approved by application to the State of Florida
Department of Commerce; and
WHEREAS, the application for any project must include a resolution from the local
government where the proposed project is to be located, certifying that the project is consistent
with local plans and regulations; and
WHEREAS, this resolution shall become effective immediately upon passage and
adoption.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION 1. Authority. The City Commission of the City of Ocoee has the
authority to adopt this Resolution pursuant to Article VIII of the Constitution of the State of
Florida and Chapter 166, Florida Statutes.
SECTION 2. Support. The City Commission hereby expresses its support
for the Community Contribution Tax Credit Program authorized under Florida Statute Section
212.08(5)(p).
SECTION 3. Effective Date. This Resolution shall become effective
immediately upon passage and adoption.
