Subject: Approval of Change Order No. 1 for Contracted Sidewalk Repairs with APEC, LLC.

Background Summary:
The City Commission approved $300,000.00 in funding in the current budget to perform contracted sidewalk
repairs and awarded the work to APEC, LLC, at the May 6, 2025, Commission Meeting. The initial
$125,173.33 of work awarded allowed the replacements to begin while Public Works completed tabulating the
list of publicly submitted locations requiring replacement. The list included various areas throughout the City
as documented in the GovPilot work order system, along with the entire length of Sabinal St. and a major
portion of Sparkling Water Circle which replaces approximately 6,200 linear feet of sidewalk. The additional
cost to complete these items is $534,688.01, giving a total cost of $659,861.34 and includes the cost of
securing a payment and performance bond per State Statute for work totaling over $200,000.00. The current
City budget included $300,000.00 for this work and the additional $359,861.34 required is available as
remaining funds in various completed Streets' Division projects as summarized in the Financial Impact. Public
Works recommends approval of the attached budget transfers and change order. Additionally, the Public
Works Team is in the process of completing a digitized GIS sidewalk inventory of the City to determine the
magnitude of contracted replacement required in order for the Team to perform repairs with in-house crews on
an annual basis.
Issue:
Should the Honorable Mayor and City Commissioners approve Change Order No. 1 for contracted sidewalk
repairs with APEC, LLC?
Recommendations:
Staff recommends the Honorable Mayor and City Commissioners approve Change Order No. 1 for contracted
sidewalk repairs with APEC, LLC, utilizing the existing competitively bid City of Kissimmee contract IFB2022-
002, in the amount of $534,688.01, and required budget transfers, and authorize the City Manager and Staff to
approve change orders to this contract up to the limit of his purchasing authority for each change order, and
up to the budgeted amount for this project for all change orders.
