(Development Engineer Keaton) Background Summary: The subject 7-Eleven property is in Commission District 1, located on Clarcona Ocoee Road, southeast of the intersection of Clarcona Ocoee Road and N. Lakewood Avenue, within the Southeast Commercial at Ocoee Village Center development. The developer has completed construction of the development's infrastructure improvements and has requested a Certificate of Completion. The infrastructure improvements include potable water, sanitary sewer, reclaimed water, utilities, stormwater collection system, perimeter wall/fencing, and associated landscaping. All identified punch list repairs have been completed, and the developer is ready to start the two-year warranty period for the public improvements. As a requirement of the Land Development Code, the developer must furnish to the City a Surety to cover any possible damage discovered or occurring during a two (2) year time period. Should any damages be discovered or occur within such two-year period and should the developer choose not to make needed repairs, 7-Eleven, Inc. has provided the City with a check in the amount of $1,651.61 as a form of Warranty Surety, which is 10% of the constructed improvements costs. The attached Maintenance, Materials, and Workmanship Agreement (Form 8 of the Land Development Code) acts as the executable document between the developer and the City. The Surety will be returned to the developer upon completion of the two-year warranty period, less the cost of repair of any damages discovered or that occurred over those two years. Issue: Should the Honorable Mayor and City Commissioners accept the Surety provided by 7-Eleven, Inc. for 7- Eleven #41318 (Southeast Commercial at Ocoee Village Center) warranty and execute the Maintenance, Materials, and Workmanship Agreement? Recommendations: The Development Services Department recommends that the Honorable Mayor and City Commissioners approve the acceptance of the Surety and the execution of the Maintenance, Materials, and Workmanship Agreement with 7-Eleven, Inc. for 7-Eleven #41318 (Southeast Commercial at Ocoee Village Center).
