Subject: Approval of Surety Bond for Banyan Cove Blvd. & Westbridge Ct. Realignment in
Order to Approve and Record a Plat; Project No. LS-2023-005. (Development Engineer Keaton)
Background Summary:
The Banyan Cove Boulevard and Westbridge Court Realignment is located in Commission District 1, on the
south side of Clarcona Ocoee Road, west of the realigned North Lakewood Avenue, near the Ocoee Village
Center Townhomes. A Plat has been submitted for internal review and approval in order to formally create the
associated street rights-of-way, tracts, and retention facilities of the realign Banyan Cove Boulevard and
Westbridge Court. The Plat also includes easements for emergency vehicle access, reclaim water lines,
drainage, stormwater retention pond, and other public utility easements. All of these improvements and items
were approved with the Ocoee Village Center site plan approval.
The applicant, DKC Ocoee Village Center SW, LLC, is platting Banyan Cove Boulevard and Westbridge Court
Realignment prior to receiving a Certificate of Completion; therefore, the developer is required to provide a
Surety covering the outstanding proposed improvements as approved in the Preliminary / Final Subdivision
Plans for the Banyan Cove Boulevard and Westbridge Court Realignment. As such, DKC Ocoee Village
Center SW, LLC, has provided the City with a Performance Surety Bond (Bond Number S2704047) from
Capitol Indemnity Corporation in the amount of $1,081,775.10.
Staff identifies no issues with the acceptance of the attached Surety.
Issue:
Should the Honorable Mayor and City Commissioners accept the Surety Bond for the Banyan Cove Boulevard
and Westbridge Court Realignment plat prior to issuance of a Certificate of Completion?
Recommendations:
The Development Services Department recommends the Honorable Mayor and City Commissioners accept
the Surety Bond for the Banyan Cove Boulevard and Westbridge Court Realignment Plat prior to the issuance
of a Certificate of Completion.
