Subject: Approval of a Partial Release of the Two-Year Warranty Surety for Ocoee Village
Center Offsite Maintenance, Materials, and Workmanship Agreement. (Development Engineer
Keaton)
Background Summary:
Ocoee Village Center Offsite located in Commission District 1, includes all public Rights of Way from the
roundabout at the intersection of Fuller’s Cross and North Lakewood Ave, going north on N. Lakewood Ave to
the entrance of The Serenza at Ocoee Village, fka Allure Apartments, Parcel ID 05-22-28-6160-14-181. The
roadways consist of North Lakewood Ave, 2nd Ave, the roundabout at the intersection of Fullers Cross and N
Lakewood Ave, a portion of Westbridge Ct., and a portion of Banyan Cove Blvd. The developer has completed
the construction of the infrastructure improvements and has requested a Certificate of Completion. The
infrastructure improvements include road work, potable water, sanitary water, reclaimed water, a public lift
station, a stormwater collection system, and associated landscaping. All identified punch-list repairs have
been completed, and the developer is ready to begin the two-year warranty period for the public
improvements.
As a requirement of the Land Development Code, Ocoee Village Developer’s Consortium provided the City
with a maintenance, materials, and workmanship agreement (recorded on November 7, 2023) and an escrow
fund in the amount of $370,727.69 to cover any possible damages discovered during the 2-year warranty
period. To complete the remaining repairs, the developer is requesting $90,000 from the Escrow fund. With
this partial release, the remaining balance of the existing Escrow fund will be $280,727.69.
Issue:
Should the Honorable Mayor and City Commission approve a Partial Release of the Two-Year Warranty
Surety for Ocoee Village Center Offsite Maintenance, Materials, and Workmanship Agreement?
Recommendations:
The Development Services Department recommends the Honorable Mayor and Commission approve a Partial
Release of the Two-Year Warranty Surety for Ocoee Village Center Offsite Maintenance, Materials, and
Workmanship Agreement requested from Ocoee Village Developer’s Consortium for the Ocoee Village Center
Offsite repairs.
