Subject: Public Hearing for Walmart Neighborhood Market Sign Variance; Project No. VR-26-

Background Summary:
The subject property is in Commission District 1 and is located at 10738 Clarcona Ocoee Road. It is zoned
PUD-COMM (Planned Unit Development Commercial) and is within the Ocoee Village Center PUD. Although
the property is within the Ocoee Village Center PUD, per the approved revised PUD/Land Use Plan for Ocoee
Village Center, there is no waiver within the PUD pertaining to the City's Land Development Code Article VIII,
"Signs." Due to this, the project to subject to the signage standards as set forth in the Land Development
Code.
Per Article VIII, Section 8-6A of the Land Development Code, for a building up to 50,000 square feet, the
maximum allowed sign area is 100 square feet, and the sign height is four (4) feet. On corner lot buildings, an
additional one (1) square foot per lineal foot of building frontage facing the secondary street may be permitted
at a maximum sign area of 100 square feet and a maximum height of four (4) feet. Article VIII, Section 8-6D.
further establishes that the sign located under a canopy or awning shall not exceed six (6) inches in height or
extend more than sixty (60) percent of the width of the awning or canopy. Although the code section only
describes signs located under the canopy or awning, the requirement will also apply to signs installed on the
canopy, as this section aligns most closely with that type of sign. This sign type, along with other signage, will
be addressed with the Land Development Code (LDC) update.
The subject property is the recently approved Ocoee Village Center New Grocery and Fuel Station Large-
Scale Final Site Plan. The applicant, Walmart Neighborhood Market, represented by Susie Stone, is
requesting variances to Article VIII, Section 8-6A. and 8-6D. of the Land Development Code. Specifically, the
applicant is requesting the following variances:
• A sign height of 10'-4" in lieu of the maximum three (3) feet for the north sign elevation, representing a
158% increase, and
• A sign height of 7'-9" in lieu of the maximum three (3) feet for the east sign elevation, representing a
94% increase, and
• A sign area of 459.7 square feet in lieu of the maximum 100 square feet for the north sign elevation,
representing a 360% increase, and
• A sign area of 159.8 square feet in lieu of the maximum 100 square feet for the east sign elevation,
representing a 60% increase.

• A sign height of 1'-6" in lieu of the maximum six (6) inches for the north canopy, representing a 200%
increase, and
• A sign width of 22' in lieu of the maximum 21' for the north canopy, representing a 5% increase.
According to Article IV, Section 4- 9A, approval of a variance requires that the applicant demonstrate
compliance with four (4) criteria, as follows:
1. That special conditions and circumstances exist which are peculiar to the land, structures, or required
subdivision improvements involved and which are not applicable to other lands, structures, or required
subdivision improvements;
2. That a literal interpretation of the provisions of these regulations would deprive the applicant of rights
commonly enjoyed by other properties with similar conditions;
3. That the special conditions and circumstances do not result from the actions of the applicant; and
4. That the granting of the variance requested will not confer on the applicant any special privilege that is
denied by these regulations to other lands, structures, or required subdivision improvements under
similar conditions.
Applicant's Response: The applicant's justification is as follows:
The request for a variance in the allowable square footage of wall signage is intended to provide the best
possible customer experience. The proposed wall signage serves as a wayfinding tool to help customers know
which services are offered and where.
Staff Analysis: Staff finds that the justification provided by the applicant does not support or sufficiently
demonstrate compliance with the four (4) evaluation criteria. Staff's analysis is summarized below:
Criteria 1: Special Circumstances and Conditions: There are no special conditions or circumstances that exist
that are peculiar to the land. There are various non-residential buildings in the city with previously permitted
signage that were designed to comply with the city code sections. Staff identifies no special conditions or
circumstances of the building that sufficiently justify the variance requests.
Criteria 2: Literal Interpretation of the Code: The literal interpretation of the provisions of these regulations
would not deprive the applicant of rights commonly enjoyed by other properties of similar conditions. Due to
the proposed building's size of approximately 48,583 square feet, the building is permitted a wall sign area of
100 square feet and a height of four (4) feet. Additionally, because the property is a corner lot with frontage
along Clarcona Ocoee Road and N Lakewood Avenue, the building is allotted an additional sign on the east
elevation, with a sign area of 100 square feet and a height of four (4) feet. For the canopy sign, there is also
no justification to increase the sign's height and width, as a 6 (six) inch tall, 21-foot-wide sign provides ample
copy area to be legibly read by motorists. Staff finds that the literal interpretation of the code sections does not
deprive the applicant but rather provides ample signage as allowed for both elevations.
Criteria 3: Actions of the Applicant: The circumstances of the variance request result from the applicant's
request to increase the copy area and height of the various signs located on the north and east elevations of
the building. There is no valid justification to rationalize the need for the significant increase in copy area,
height, and width of the various signs, as the size of the letters and logos can be reduced.
Criteria 4: Conference of Special Privilege: Granting the requested variances would confer a special privilege
to the applicant that is denied by these regulations to other non-residential properties under similar conditions,
as other non-residential buildings are subject to the maximum allowed height and copy area of wall signage,
as well as height and width of canopy signs. If the signs are constructed to meet the standards set in the
respective code sections, the building will have a 100 square foot wall sign on the north and west elevation of
the building and a six (6) inch tall, 21-foot wide canopy sign on the north elevation. Staff believes that the
signs, with their copy, area, height, and design, are in conformance with the sign code sections and will

provide sufficient signage for the building.
Staff does not support the requested variances, as there is insufficient code-based justification.
Issue:
Should the Honorable Mayor and City Commission approve the requested variances to Article VIII Sections 8-
6A. and 8-6D. of the Land Development Code as follows: (1) a maximum sign height of 10'-4" for the north
sign elevation, (2) a maximum sign height of 7'-9" for the east sign elevation, (3) a maximum sign area of
459.7 square feet for the north sign elevation, (4) a maximum sign area of 159.8 square feet for the east sign
elevation, (5) a maximum sign height of 1'-6" for the north canopy, and (6) a maximum sign width of 22 feet for
the north canopy?
Recommendations:
Planning & Zoning Commission (PZC) Recommendation:
The Planning and Zoning Commission (PZC) considered this item at its June 2, 2026, hearing. The PZC
asked whether the proposed sign areas are consistent with those at other stores, such as the one at 10500 W
Colonial Drive. Staff verified that the Walmart store located at 10500 W Colonial Drive is significantly larger
than the subject store of this application and, therefore, was allowed greater copy area and height.
Following the discussion and based on the variance request not demonstrating compliance with the approval
criteria in Section 4-9A of Article IV of the Land Development Code, the PZC voted unanimously (5-0) to
recommend denial of the requested variances to Article VIII Sections 8-6 A. and 8-6D. of the Land
Development Code to not allow the following: (1) a maximum sign height of 10'-4" for the north sign elevation,
(2) a maximum sign height of 7'-9" for the east sign elevation, (3) a maximum sign area of 459.7 square feet
for the north sign elevation, (4) a maximum sign area of 159.8 square feet for the east sign elevation, (5) a
maximum sign height of 1'-6" for the north canopy, and (6) a maximum sign width of 22 feet for the north
canopy.
Staff Recommendation:
Staff recommends that the Honorable Mayor and City Commission deny requested variances to Article VIII
