Keller ISSUE: Should the Honorable Mayor and City Commissioners approve the Final Subdivision Plan for Ingram Estates? BACKGROUND SUMMARY: The Ingram Estates property includes approximately 33.5 acres. The property is located on the southeast corner of the intersection of Ingram Road and McCormick Road. The subject property contains a house, several agricultural buildings with several significant size trees along Ingram Road and along McCormick Road. The surrounding land to the north is in unincorporated Orange County with the County owning and operating a solid waste disposal facility, (Orange County) zoned A-1. To the east there is another unincorporated parcel (+/- 40 acres) which is heavily treed containing a single-family residence, zoned (Orange County) A-1. To the south there is a planned unit development (Arden Park) which is projected to have a total of 925 residential units, zoned PUD. To the west is a residential subdivision (McCormick Woods) that will be developed as a 212 lot single-family residential subdivision, zoned R-1A. The Future Land Use designation is "Low Density Residential" which allows up to 4 dwelling units per acre. The surrounding future land use is "Low Density Residential" except for the property to the north which is "Public Facilities/Institutional". On January 4, 2005, the City Commission reviewed and approved the Preliminary Subdivision Plan (PSP) for Ingram Estates. The Final Subdivision Plan as proposed is consistent with the Preliminary Subdivision Plan. DISCUSSION: The Final Subdivision Plan proposes 95 single-family residential lots on approximately 33.5 acres. The property is zoned R-1AA requiring a minimum living area of 1,400 square feet, a minimum lot width of 75 feet, and a minimum lot size of 9,000 SF. As shown in the Final Subdivision Plan, Ingram Estates will be developed in one phase, and will include an amenity package of a Pavilion (600 square feet), Volleyball Court, Picnic Area and a Tot Lot. As shown in the Final Subdivision Plan, Ingram Estates will have one access point from Ingram Road and one additional future connection to the property to the east. Along with the usual road and utility improvements, the documents indicate that the property owner will provide 10 feet of additional road right- of-way on the south side McCormick Road for the projected road widening. Sidewalks will be provided along both sides of all internal streets. Sidewalks will also be installed along the subdivision where it fronts on Ingram and McCormick Roads. This subdivision will not be gated. There will be a 6-foot brick wall with appropriate landscaping on both sides of the entrance with the wall extending northward along Ingram Road to the north boundary of the subdivision and eastward along McCormick Road to the east property boundary. Water and wastewater will be provided by Orange County while reclaimed water, solid waste and police and fire protection will be provided by the City. Several off-site improvements already exist as a result of the collaboration of the developer and the adjacent development (McCormick Woods subdivision). They are a northbound left turn lane on Ingram Road at McCormick Road, paving Ingram road with curb and gutter along the length of the property and a southbound turn lane for traffic entering the site. The developer is further obligated to construct a right and left turn lane on McCormick at Ingram Road with this approval. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) reviewed the Ingram Estates Final Subdivision Plan on September 26, 2007. The DRC discussed the items in the review memorandums from the City Attorney's office, Engineering Department and the Planning Division. The developer agreed to make all the requested changes. The Engineering Department had one outstanding issue. It was requested that the potable water be fed into the site with two connections in order to create a proper loop system and to provide additional water pressure for fire suppression. The developer agreed to coordinate with Orange County to provide another water feed into the site. When the discussion was finished, the Committee voted unanimously to recommend approval of the Final Subdivision Plan, subject to making the changes agreed upon at the DRC meeting before the Ocoee Planning & Zoning Commission meeting. PLANNING & ZONING COMMISSION RECOMMENDATION: The Planning and Zoning Commission reviewed the proposed Ingram Estates Final Subdivision Plan on October 9, 2007. City Staff presented a brief overview of the project. City Staff and the Applicant answered several questions regarding the subdivision plan. All of these questions were addressed adequately in the P&Z meeting. There was no one from the public to speak regarding this Final Subdivision Plan. After finishing its deliberations, the Planning & Zoning Commission voted unanimously to recommend approval of the Ingram Estates Final Subdivision Plan as date stamped received by the City on October 4, 2007, subject to resolving the last remaining issues addressed on the attached Engineering Department review memorandum prior to the City Commission Meeting. After subsequent submittal and review, the Final Subdivision Plan (date stamped October 26,2007) addressed all remaining City Staff issues. STAFF RECOMMENDATION: Based on the recommendation of the DRC and Planning & Zoning Commission, Staff recommends that the Mayor and City Commissioners approve the Ingram Estates Final Subdivision Plan date stamped received by the City on October 26,2007.
