Subject: Approval of Demolition of 611 N. Lakewood Ave. (Police Chief Ogburn)
Background Summary:
The property located at 611 N. Lakewood Avenue, owned by Rental Home Holdings LLC, has been the
subject of ongoing code enforcement proceedings regarding unsafe structural conditions and the accumulation
of junk and debris. The violations were cited pursuant to Section 108-35 of the City Code, which addresses
nuisance conditions or hazards impacting structures to the extent that repair, removal, securing, or demolition
is necessary to protect public health, safety, and welfare.
On June 24, 2025, the Code Enforcement Board heard Case No. 2025-01222 regarding the unsafe structure
and associated debris conditions at the property. During the hearing, Code Enforcement Officer Rodriguez
advised the Board that the property remained noncompliant and requested an Order of Compliance requiring
corrective action by August 23, 2025, or the imposition of a $100.00 per-day-per-violation fine thereafter.
Additionally, the City indicated that if the property became vacant and remained non-compliant, it could
proceed with abatement by demolition.
At that hearing, the owner’s representative, real estate broker Eric Spivey, informed the Board that contractors
had been hired to address the violations and requested additional time to bring the property into compliance.
Following the discussion, the Code Enforcement Board unanimously found the property in violation as of April
23, 2025, ordered compliance by August 23, 2025, imposed daily fines for continued noncompliance, and
authorized the City to abate the property and assess the associated costs if it became vacant.
The property was subsequently brought back before the Code Enforcement Board on March 19, 2026. During
that hearing, Code Enforcement Officer Loeffler advised the Board that the property remained non-compliant
and continued to be an unsafe structure, with junk and debris littering the site. The Code Board and Staff are
requesting authorization from the Commission to demolish the structure due to ongoing unsafe conditions and
the property owner's failure to achieve compliance.
Following presentation of the case, the Code Enforcement Board unanimously approved a motion finding the
property located at 611 N. Lakewood Avenue, Ocoee, Florida, to be in violation and authorizing the City to
abate the property through demolition, with the costs of abatement to be assessed against the property.
Staff is seeking authorization to demolish the structure at 611 N. Lakewood Avenue, Ocoee, FL 34761. The
cost of the demolition and the asbestos survey is expected to be less than $20,000. The property has
remained in substantial non-compliance despite prior orders, extensions, and opportunities provided to the
owner to correct the violations. The continued existence of the unsafe structure and associated debris
presents an ongoing threat to the health, safety, and welfare of the surrounding community.

Issue:

Recommendations:
Staff recommends that the Mayor and City Commission authorize the City to proceed with demolition and
abatement of the unsafe structure located at 611 N. Lakewood Avenue, Ocoee. FL 34761. Staff further
recommends that all demolition, abatement, administrative, and related enforcement costs incurred by the City
be assessed against the property in accordance with applicable City Code provisions and Florida law.

Financial Impacts:
The City will incur costs resulting from demolition, debris removal, site stabilization, and any related
administrative and legal expenses. Funding for the demolition and abatement services will initially be paid from
the appropriate Code Enforcement, demolition/abatement GL# 001-521-40-3400. Pursuant to the Code
Enforcement Board’s order and applicable City Code provisions, all costs incurred by the City will be assessed
against the property and will become a lien recoverable by the City.

Case #3025-01491 together, providing the history for each. Both properties are owned by the same individual,
involve the same violation, and were cited onthe same day. She further explained that as of June 24, 2025, the

the health and safety of his neighbors as in the five years that he has lived in the neighborhood the trash has not
stopped growing and now there are rodents surrounding the properties. Matthew Moulton,
HOA board member and neighbor to the respondent, spoke and confirmed the statements from . Dr. St. Louis.
He stated that the respondent's backyard has an increasing accumulation of trash, along with rodents and wildlife in the
pool. While he acknowledged that code enforcement has limited authority over the rear of the property, he expressed concern
for his own health and safety, as well as that of his neighbors, due to the worsening conditions. Member Smalldon,

Respondent Speros Vouriotis explained that the trees fell during a storm last October and the tree limb in violation had
come from a neighbor's yard but left on his property. He further explained that he currently does not have the resources
to remove the tree as he is currently being quoted upward of $20,000 by tree -removal companies. Additionally, he advised
he has filed a claim with his insurance and is waiting on them and that his public adjuster is aware he has a code
enforcement case. He asked for more than 15 days to come into compliance.
Member Schultz, seconded by Vice -Chair Lewis, moved that in Case #2025-03919 the respondent be found in violation

Respondent That Cao Vi Ton stated he was helping his dad to take this tree down and he was approached by a contractor

to remove the tree. He advised that he looked into a permit from the HOA, but he overlooked the part of the permit for
the City. He was not aware that he could apply for an after -the -fact permit. He additionally advised they were waiting for
the hearing to get clarification on their next steps.

remains non -compliant and becomes vacant, it may proceed with a demolition or a removal of junk and debris through
abatement.

Respondent Melvin Jenner advised that he has been at his property for 25 years and he has stored his camper in the
empty lot next to his property for the past 20 years. He advised he does not understand what the issue is, especially when
other properties like the one in the mayor's neighborhood look worse than his and they do not have a violation. He
additionally advised that he understood when he had the food truck and boat on his property that he would consider
storing, but that should not be the case anymore as it is just his camper left.

Summary:
108-35. — When nuisance conditions or hazards degenerate or cumulatively impact on structures, dwellings or other
buildings regulated by the Minimum Standards Codes, to the extent that repair, removal, securing or demolition is
necessary for the public health, safety and welfare
Observation:
108-35. - Unsafe Structure with Junk and Debris Littering the Property.
Officer Loeffler explained that as of March 19, 2026, the property is still in non-compliance. The City asked to demolish
the property.

Vice -Chair Lound in violation asLewis,, seconded by Member Schultz, moved that in Case #2025-01222the respondent be cited
as otApril 28, 2025, and authorize the City to abate the property through demolition and assess the cost of abatement against

COMMENTS Vice -
Chair Lewis and members Fernandez and Schultz stated that if this is to be the last Code Board meeting they
are grateful for the Code Officers, Staff, and fellow board members. Chair
Bandur shared the same sentiment but additionally stated that he hopes the Commissioners and Mayor will
rethink over their decision to end the Code Board and that one of the issues of them not reaching quorum is
due to them not having enough members. APPROVED:

SEC 108-35. - Public nuisances Public nuisances are defined in the definiƟons of § 108-3 of this
Chapter. When nuisance condiƟons or hazards degenerate or cumulaƟvely impact on
structures, dwellings or other buildings regulated by the Minimum Standards Codes, to the
extent that repair, removal, securing or demoliƟon is necessary for the public health, safety
and welfare, then the Enforcement Officer or his designee or the Code Enforcement Board is
authorized to order the property owner or City agents to repair, remove, secure, vacate or
demolish such structures according to procedures outlined herein. These powers are hereby
declared to be remedial and essenƟal for the public interest, and it is intended that such
powers be liberally construed to effectuate the purposes stated herein. [Amended 9-17-2013
